PROPOSITION

THE STATES are asked to decide whether they are of opinion

in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999, to appoint Mr. Graham Jennings as a member of the Jersey Police Complaints Authority for a period of 3 years, commencing on 2nd July 2018.

REPORT

Jersey Police Complaints Authority ("JPCA") membership

Paragraph 1(1) of the Schedule to the Police (Complaints and Discipline) (Jersey) Law 1999 ("the 1999 Law") stipulates that the JPCA "shall consist of a Chairman and not less than 6 or more than 8 other members".

The current membership of the JPCA is as follows –

Appointed 1st January 2017 for 3 years (see P.104/2016) Mr. H. Cooper (Chairman)

Appointed 1st January 2017 for 3 years (see P.118/2016) Mrs. R. Catchpole

Mr. M. Swan

Appointed 12th April 2016 for 3 years (see P.21/2016) Mr. G. Marett

Mrs. D. Taylor -Cox

Appointed 10th March 2018 for 3 years (see P.9/2018) Mrs. Gail McCourt

Mr. Duncan Baxter.

As outlined above, the JPCA is currently constituted of a Chairman and 6 members, and is therefore compliant with the 1999 Law. There is provision, however, for additional Members to be appointed.

Accordingly, a recruitment process was undertaken earlier this year by the JPCA, in line with Jersey Appointments Commission Procedures. This led to the recommendation that Mr. Graham Jennings be appointed as a member of the Authority for an initial 3-year period. Subject to the agreement of the Assembly, the appointment would be effective from 2nd July 2018.

Biography – Mr. Graham Jennings

Mr. Jennings was born in Jersey. He has spent his career working in Health and Social Services, initially training and working in the UK NHS as a clinical practitioner, lecturer and manager before returning to Jersey in 1985 as Post-Graduate Tutor for the Health Department. He subsequently took on a series of different service development and management roles before he became Deputy Chief Executive in 1989, and Chief Executive of Health and Social Services in 1996.

Unfortunately, Mr. Jennings required major heart surgery in 2002 and reluctantly retired on medical advice later that year.

Since his retirement, Mr. Jennings has been involved on a voluntary basis with a number of  local  organisations,  most  notably  Jersey  Cheshire  Homes  Trust  Foundation Committee as a member and Vice-Chairman; and more recently the Jersey Law Society Disciplinary Panel, from 2007–2017. For the latter, he has chaired many disciplinary

hearings into the professional conduct of local lawyers following complaints by either the general public or members of the judiciary.

During his career, Mr. Jennings has acquired wide experience in managing complaints, and disciplinary and professional conduct matters, across a wide range of professional groups at both a local and national level.

Collective responsibility under Standing Order 21(3A) Note: This statement is correct at the time of lodging.

The Council of Ministers has a single policy position on this proposition, and as such, all Ministers, and the Assistant Minister for Home Affairs, are bound by the principle of collective responsibility to support the proposition, as outlined in the Code of Conduct and Practice for Ministers and Assistant Ministers (R.11/2015 refers).

Financial and manpower implications

The posts are honorary, although reasonable expenses can be claimed.

There are no additional financial or manpower implications for the States arising from this proposition.
