PROPOSITION
THE STATES are asked to decide whether they are of opinion
in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999, to re-appoint the following people as members of the Jersey Police Complaints Authority for a period of 3 years, commencing on 10th March 2018 –

REPORT
Jersey Police Complaints Authority ("JPCA") membership
Article 1(1) of the Schedule to the Police (Complaints and Discipline) (Jersey) Law 1999 stipulates that the JPCA shall consist of a Chairman and not less than 6 or more than 8 other members.
The current membership of the JPCA is as follows –
Appointed 1st January 2017 for 3 years (see P.104/2016) Mr. H. Cooper (Chairman)

Re-Appointments
As outlined above, Mr. Baxter and Mrs. McCourt were first appointed as members of the JPCA on 10th March 2015 for 3 years. The Minister for Home Affairs is most grateful to Mr. Baxter and Mrs. McCourt for their dedicated service to the JPCA, which is provided on an honorary basis, and is pleased that they wish to seek re-appointment to the Authority for a further 3 years. This will ensure continuity in the membership of the JPCA, and that the Authority will continue to benefit from Mr. Baxter's and Mrs. McCourt's knowledge and experience.
Ms. Debbie Sebire was also appointed as a member of the JPCA on 10th March 2015 for 3 years, and has served as the Acting Deputy Chairman of the Authority for the past year. Ms. Sebire has indicated that she will not be seeking re-appointment. The Minister extends her appreciation to Ms. Sebire for her voluntary service to the JPCA, and is grateful for the commitment she has given to the role. The Minister wishes Ms. Sebire well for the future.

Should the States Assembly agree to the recommendation of the Minister that Mr. Baxter and Mrs. McCourt be re-appointed for a further 3 years, the JPCA would be constituted of a Chairman and 6 members, thus remaining compliant with the Law.
Following the end of Ms. Sebire's term of office, the Authority will need to identify a new Deputy Chairman. The process for this appointment, which can be made either from within the existing membership or through a new appointment, has commenced.
Biographies
Mr. Duncan Baxter
Mr. Baxter was born in England and educated in Zimbabwe. He worked in banking in Zimbabwe before taking up a position at Commercial Bank (Jersey) Limited (the predecessor to Swiss Bank Corporation) in 1984. Between 1988 and 1998 he was the Managing Director of Swiss Bank Corporation (Jersey). Since 1998 he has been involved in various consultancy projects with a number of financial institutions.
He is now mostly retired, but still holds a few non-executive directorships and sits on audit committees and remuneration committees.
Mrs. Gail McCourt
Mrs. McCourt was born and educated in Northern Ireland. She obtained an MA in Applied Languages for Business from the University of Ulster, having previously obtained her degree in Applied Languages from the same university. She relocated from Northern Ireland to Jersey in early 2003 and took up employment with Royal Bank of Canada Wealth Management.
She was recently appointed as Head of Fiduciary Management for RBC Wealth Management in the British Isles, with responsibility for the Fiduciary Management, Client Structure and Structure Administration teams across Jersey and Guernsey.
Her previous roles within RBC Wealth Management have included Head of Client Experience and Head of Marketing for the British Isles and Caribbean.
Collective responsibility under Standing Order 21(3A)
The Council of Ministers has a single policy position on this proposition, and as such, all Ministers, and the Assistant Minister for Home Affairs, are bound by the principle of collective responsibility to support the proposition, as outlined in the Code of Conduct and Practice for Ministers and Assistant Ministers (R.11/2015 refers).
Financial and manpower implications
The posts are honorary, although reasonable expenses can be claimed.
There are no additional financial or manpower implications for the States arising from this proposition.
