PROPOSITION
THE STATES are asked to decide whether they are of opinion
- to request the Council of Ministers to bring forward for debate the necessary legislative changes required to implement the proposed reorganisation of the Department of Justice and Home Affairs and to cease implementation of the proposed reorganisation (including any transfers of staff and budget but excluding any consultation or investigation) until those legislative changes have been adopted; and
- to request the Council of Ministers to agree, as a matter of policy, that in respect of any proposed departmental reorganisation which requires legislative changes to be enacted, any such reorganisation should not be implemented (including the transfer of staff and budget but excluding any consultation or investigation) until such time as the necessary legislative changes have been adopted by the Assembly.

REPORT
On 2nd February 2019, the Justice and Home Affairs Department published their proposed Target Operating Model ("TOM").
The TOM is currently under in-house consultation with the affected staff. This process will run for 30 days ending on 6th March 2019.
It is clear from the TOM that a number of the proposals will require significant adjustments to existing legislation to facilitate their introduction.
The TOM proposes high-level amalgamation of organisations such as Police, Customs and Immigration, and the Fire and Ambulance services, as shown in Appendix 1 to the TOM, which I have attached at the Appendix to this report.
For these departments and subsequent roles to be merged, there will need to be a number of changes to existing Laws, such as –
- States of Jersey Police Force Law 2012
- Customs and Excise (Jersey) Law 1999
- Employment of States of Jersey Employees (Jersey) Law 2005
- Fire and Rescue Service (Jersey) Law 2011.
What I am asking for in this proposition is that any organisational changes within Justice and Home Affairs requiring an alteration in law, should come to the Assembly first to ensure that we, as legislators, agree on the law changes before organisational restructuring is implemented.
In addition, I am asking that change to any department within the States of Jersey that is regulated in law should be preceded by a consultation with the Assembly through Scrutiny, followed by any necessary legislative changes, before organisational practice changes.
