COMMENTS
The Council of Ministers does not support Proposition P.73/2021.
The Council of Ministers:
- Recognises that it is the duty and responsibility of the States Employment Board to undertake the recruitment to the Chief Executive position as set out in Law.
- Considers that a lawful process has been undertaken, which was adopted by the Assembly on a standing vote, as set out in Article 26AA of the Employment of the States of Jersey Employees (Jersey) Law 2005; and as a result, an offer has been made and accepted, and Heads of Terms exchanged and agreed all before the proposition was lodged. The Assembly should avoid intervening in the States Employment Board discharging their duty in a lawful manner.
- Agrees that the States Employment Board must not be requested by the States Assembly to go against the requirements of the 2005 Law, as the Board should not be asked to act in a manner contrary to the Law.
- Holds that the Chief Executive Officer role must remain apolitical at all times, and this proposition risks politicising the role, as well as introducing a fundamental uncertainty over our senior recruitment processes that is detrimental to our public service and the Island.
