Question

“In respect of the hospital catering unit located at St Peter’s Technical Park, and the continuing impact this has on the residents of Ville du Bocage, will the Minister advise –

  1. what independent odour assessment, if any, has taken place, and what were the results of any such assessment;
  2. the number of complaints received by Government in relation to this matter since 2021 and the number of complainants in that time; and
  3. further to the response to Written Question 431/2020, what work, if any, has been progressed in relation to reviewing the Statutory Nuisances (Jersey) Law 1999?”

Answer

  1. Odour assessments have been conducted in 2021 and 2023 by competent and qualified officers within the Regulation Directorate investigating the matter under Statutory Nuisances (Jersey) Law 1999. The findings of the investigation in 2021 and 2023 indicated the threshold for statutory nuisance had not been met. Third party odour assessments have not been deemed necessary nor carried out, as independent and appropriate assessments are undertaken by qualified Government officers.
  2. There are three complaints held on record by the Directorate relating to odour at the hospital catering unit in St Peter’s Technical Park. In 2021, there were two recorded complaints, one from an individual complainant, and one from a petition including 49 signatories. In 2023, there was one recorded complaint, from 2 complainants. Of these recorded complaints, no statutory nuisance has been established.
  3. No further work on the Statutory Nuisances (Jersey) Law 1999 has commenced as this has been re-prioritised by the common strategic priorities. It remains in the pipeline for future legislative review.
