Jersey Public Services Ombudsperson Establishment
The Panel is appreciative of the briefing received on 15th August 2023 to provide an update on progress regarding the establishment of a Jersey Public Services Ombudsperson (JPSO). The Panel has now considered your letter dated 18th August 2023 and your request for its view regarding the establishment of the JPSO in shadow form.
The Panel is understanding of the requirement to progress the preparatory work in setting up the office of the JPSO prior to the Law being enacted. The Panel is, therefore, supportive of the principle to establish the JPSO in shadow form. However, considering the importance to ensure the accompanying legalisation is suitably constructed, wishes to emphasise that notwithstanding its support, the Panel will not in any way be inhibited from undertaking very careful scrutiny of the draft legislation, once lodged, as a result of the office of the JSPO being established or any appointments being made in shadow form.
I hope you find the Panel’s cooperation helpful in ensuring that the necessary preparations to establish the office of the JPSO can commence without delay, including any essential recruitment and training in expectation of the legal duties of the office once the Law is approved by the States Assembly and enacted.
