Thank you for your letter of Friday 2nd June.
The Memorandum of Understanding (MoU) you reference is between the UK Home Office and the Minister for Health and Social Services in her capacity as the Jersey Cannabis Agency. I understand that the MoU explains how the United Kingdom and the Minister for Health and Social Services will work together to ensure that Jersey continues to comply with the necessary regulation, legislation and any international agreements that Jersey is party to.
The Panel have access to a copy of the MoU as this was shared by the Minister for Health and Social Services with your predecessors. Pursuant to the terms of the MoU, the details cannot be disclosed publicly without the consent of both parties. I would note that the United Kingdom does not usually publish these types of agreements and it is my understanding that the UK Home Office has not given consent for the MoU to be published.
The Publication of MoUs, or other correspondence, between Government partners will be dependent on the content of the agreement, the external context, international precedent, and of course the views of the partner jurisdiction.
