Legislative Timeline for Public Entertainment Regulations

I am writing in relation to the proposed timeline for the Unlawful Public Entertainments (Jersey) Regulations (the Regulations) following our discussion in yesterday’s hearing and our recent briefing of 28th March 2024, for which the Panel is grateful.

During the briefing it was confirmed that, as identified in correspondence from yourself of 18th September 2023, work to introduce bespoke events licencing legislation is being undertake and that it is anticipated this will likely take the remainder of this political term to complete.

The Panel is disappointed that such a long period of time is being proposed for the introduction of such legislation, particularly bearing in mind, as you have highlighted, the necessity has been identified by successive Governments and Scrutiny Panels since they were first introduced in 1992 following concern of the risks of individuals holding “raves”.

The Panel understands that it is your intention to seek the Assembly’s approval to renew the Regulations for an additional three years, up to July 2027. The Panel is, however, concerned that this will allow further delay in introduction of any new events licencing legislation and thus does not consider this timeline acceptable.

Due to the protracted timeline of the Regulations, and established need for change, the Panel is minded to recommend that the Regulations should only be extended by eighteen months, to January 2026. It is hoped that this will expedite the introduction of new legislation and enable debate within a timely manner, aligning these with the end of this term of office.

The Panel would be grateful for further clarification of the reasoning for proposing a three year extension, and confirmation of your views on a reduction of time period.

We would be grateful if you could respond no later than Tuesday 23rd April 2024 in line with the 5 working days approved for responses between Scrutiny Panels and Ministers.
