1. Minutes

The Panel approved the minutes of its meetings of 2nd June and 13th July 2009, which were signed accordingly by the Chairman.

The  Panel  noted  that  the  Chairman  was  unable  to  sign  the minutes of its meeting of 6th July due to his absence from the

meeting in question.

2. Depositor Compensation Scheme

The Panel considered the way forward with regard to its review of P85/2009/ - Draft Public Finances (Depositors Compensation)

The Panel agreed the following actions:

  1. Having  given  due  consideration  to  e-mail correspondence from Deputy C. Labey the Panel agreed to conduct the review as a full Panel and to co-opt Deputy G.P. Southern as a member for the duration;
  2. Contact OXERA (Ms. Leoni Bell) to request a marked up' copy of their report detailing the changes made from the March version to the final version;
  3. Obtain documentation detailing the DCS of the Isle of Man, Guernsey and UK;
  4. Obtain EU guidance on DCS;
  5. The  Chairman  undertook  to  provide  flow  diagrams illustrating the proposed Jersey DCS;
  6. Establish  if  States  Greffe  can  use visio  viewer' to illustrate Chairman's flow diagram;
  7. Send the IADI core principles document to the Panel;

viii. Request  comparative  table  of  DCS  considered  by

 

 

OXERA;

  1. Request comparative table of DCS from IADI;
  2. Construct comparative table of DCS if OXERA or IADI are  unable  to  provide  one. Use  IADI  core  principles document to devise the table;
  3. The Panel noted that initial attempts to secure an advisor had  not  been  successful. It  was  agreed  to  follow  up advisor contacts and to contact directly Mr. D. Inscoe of the IADI;
  4. Arrange  public  hearing  with  Minister  for  Economic Development,  Mr.  Martin  De  Forest-Brown  (Director International  Finance)  and  Mr.  James  Mews  (Finance

Industry Development Executive) on Monday 3rd August; xiii. Establish the make-up of the banks in Jersey (branches,

stand alone, subsidiaries etc) and criteria for access to

the Island;

  1. The Panel considered the draft Terms of Reference and subsequently agreed amendments. It was further agreed to  distribute  accordingly  to  the  Chairmen's  Committee and Minister for Economic Development for information;
  1. Arrange Panel meeting for 9:30am on Monday 27th July;
  2. Panel to collect review folders from the Scrutiny Office; and

xvii.The Panel agreed to consider at their next meeting which

witnesses to invite to Public Hearings.

3. Sunday Trading

The Panel considered the potential outcomes of their meeting with the Assistant Minister for Economic Development to discuss P111/2009 Draft Shops (Regulation of Opening and Deliveries) (Jersey) Law 200-. It was agreed that due to time constraints and  resource  issues  the  Panel  would  produce  comments  for distribution to States members prior to the date of debate.

4. Tourism PPP

The Panel noted progress to date.

5. Fisheries Legislation – Bag Limits

The Panel received and noted copies of the latest draft of the report with comments by Deputy D. Wimberley and Deputy S. Pitman.

The Panel considered e-mailed comments form Deputy C. Labey proposing a full report be produced. Having given consideration to that proposal as well as the counter proposal to continue with a brief summary report the Panel agreed to consider the issue in

greater detail at its meeting of 27th July.

6. Annual Business Pan

The  Panel  noted  the  letter  form  the  Chief  Minister  to  the Chairman  of  the  Chairmen's  Committee  regarding  the  States Annual Business Plan and agreed to defer consideration of its approach to a review until their next meeting.

 

 

7. Ministerial Decisions

The Panel noted the recent Ministerial Decisions pertinent to its remit and agreed to request further detailing pertaining to MD-E- 2009-0108.

8. Future Meetings

The Panel noted that its next scheduled meeting would take place  at  9:30am  in  Le  Capelain  room,  States  Building,  on

Monday 27th July 2009.
