1. Tourism Development Fund

The Panel noted that Tourism Development Fund: Assistance to the Private  Sector  (P.26/2012)  had  been  referred  to  the  Panel  under Standing Order 79. Consideration was given to the scope of the review and  it  was  agreed  to  form  a  Sub-Panel  with   Deputy  S.  Power  as Chairman and Deputy R.J. Rondel as Vice-Chairman. It was further agreed that Members of the Economic Affairs Scrutiny Panel would be invited to join the Sub-Panel. In that regard, the Panel was advised that the  Economic  Affairs  Panel  had  previously  considered  whether  to review the proposals contained in P.26/2012 and had agreed not to review the matter. The Panel noted that Senator S.C. Ferguson could not take part in the review due to a conflict of interest. It was agreed that the Sub-Panel would meet as soon as possible.

The Panel noted that, during the debate under Standing Order 79 on whether P.26/2012 should be referred to the Panel, some Members of other Scrutiny Panels had spoken against the referral. Consideration was given to whether this action had damaged the impression of a unified Scrutiny function. It was agreed that the Chairmen's Committee should be asked to consider the matter and to ensure that all Scrutiny Members were aware of the Standing Orders which applied to Scrutiny Panels.

2. Population and Migration

The Panel was informed of advice received from the Population Office that implementation of the Control of Housing and Work (Jersey) Law was likely to take place in September 2012. It was agreed that Deputy Power, who lead the work on Part 2 of the review, would write to Senator P.F. Routier MBE, Assistant Chief Minister and Chairman of the Migration Advisory Group, to confirm the anticipated timetable for implementation  of  the  Law. It  was  noted  that  a  delay  in  the implementation of the Law would afford the Panel time to undertake its review of Tourism Development Fund: Assistance to the Private Sector (P.26/2012) and that work on the Population and Migration Review was therefore not one of the Panel's current highest priorities.

The Panel considered the lines of enquiry which had been identified during  its  previous  discussions  and  it  was  confirmed  that  these represented courses of action which the Panel would pursue in due course. The Panel was advised that the Executive had been asked to provide an update on the implementation of accepted recommendations from previous Scrutiny Reports on the subject.

The Panel noted that ultimately a statement had not been made to the States  following  presentation  of  Population  and  Migration  Part  1 (SR1/2012).

3. Housing Capital Projects

The  Panel  recalled  its  agreement  to  present  comments  on  Social Housing Schemes: Funding (P.40/2012). Consideration was given to whether the work would be feasible, given the Panel's agreement to undertake a review of Tourism Development Fund: Assistance to the Private Sector (P.26/2012). It was agreed that work on P.40/2012 should continue.

It  was  noted  that  a  draft  Scoping  Document  and  draft  Terms  of Reference had been received by the Chairman. The Scrutiny Officers were requested to circulate the draft documents amongst the Panel.

4. Ministerial Decisions

The  Panel  considered  whether  it  should  include  recent  Ministerial Decisions as a regular agenda item at its meetings. The Panel was advised that the measure could potentially stretch resources, if the Panel decided to undertake work on several Ministerial Decisions at once,  or  that  any  work  undertaken  could  detract  from  the  Panel's priorities. Nevertheless, it was agreed that arrangements would be made  for  the  Panel  to  give  regular  consideration  to  Ministerial Decisions.
