2. Ports of Jersey Incorporation

The Panel again raised the possibility of asking the Comptroller and Auditor  General  to  comment  on  the  updated  Memorandum  of Understanding (MOU) for the Incorporated Ports of Jersey, specifically on changes which the Panel had been told were designed to meet both her previous recommendations (in R.109/2015) and those of an earlier Deloitte report on incorporated bodies. Members were informed by the Scrutiny Officer that enquiries had been made via the Officer to the Public Accounts Committee, who thought it likely that the Comptroller and Auditor General would not be prepared to comment on matters directly relating to draft legislation. The Officer concerned then briefly joined the meeting and it was confirmed that this was the position.

The Panel then discussed the imminent debate. Nothing more had been heard from the department concerning a possible further delay, and members therefore agreed that bearing in mind the ongoing work on the MOU and Memorandum and Articles of Association (both of which had only been received quite recently from the department) this should now be the subject of a formal request. The Scrutiny Officer was asked to request  a  deferral  until  2nd  June  2015.  Assuming  that  this  was accepted, the Panel agreed that it would aim to present its comments to the  States  on  22nd  May  2015;  members  agreed  to  hold  an  extra meeting  at  9.30am  on  that  day  to  enable  any  final  details  or amendments to be confirmed.

Members  considered  detailed  draft  comments  on  the  MOU.  It  was agreed to inform the Minister for Treasury and Resources that the Panel had a number of questions and suggestions for further amendments, and to request an early meeting to discuss these points prior to the

debate. Members agreed that the draft comments could be shared with the Minister in advance of the meeting.

3. Quarterly Public Hearing

The  Panel  discussed  possible  topics  and  draft  questions  for  the Quarterly Public Hearing to be held on 11th May 2015. The Panel agreed the order in which it would address the topics; the Scrutiny Officer was asked to confirm this with the department.
