1.  Commissioner for Standards

The  Committee  welcomed  Dr  M.  Egan,  Greffier  of  the  States,  to discuss the position of Scrutiny in relation to the remit of the proposed Commissioner for Standards, which  was being progressed by the Privileges and Procedures Committee (PPC).

The Committee recalled its letter to PPC dated 14th January 2016, outlining that at that initial stage it had agreed in principle that it would be appropriate for the revised draft legislation to incorporate extending the remit of the Commissioner to include Scrutiny. However, once drafting was complete it would be grateful for the opportunity to make a  final  assessment  of  the  proposed  remit  and  provide  feedback accordingly.

Having  since  been  provided  with  additional  information,  the Committee gave further consideration to the matter and concluded that it would not be appropriate for the remit of the Commissioner to include the Scrutiny function, due to previously unforeseen potential consequences. It agreed to write to PPC to request that this position be  reflected  in  the  legislation  that  was  brought  forward  to  the Assembly.

The Committee further agreed to research the alternative framework of independent arbitrators seen within certain parts of the Australian parliamentary  system,  in  order  to  establish  if  there  was  merit  in pursuing such arrangements for relevant matters in relation to the Scrutiny function.
