1.  Harmful Telecommunications

The Panel met without agenda to discuss arrangements for the review. Members  agreed  a  number  of  dates  suggested  for  meetings  and hearings. Questions to be raised in the public hearing with the Assistant Chief Minister were discussed, and it was agreed that informal meetings with other witnesses would not require a question plan. The Chairman reported that he had been approached by a member of the public who might provide a written submission to the review relating to concerns around freedom of speech.

2.  Dormant Bank Accounts

The Panel discussed concerns with various aspects of the proposals, including:

  • Whether it would be possible to ensure that proper due diligence had been carried out by banks in respect of the source of funds to be transferred to the Reclaim Fund
  • If any reputational risk would be transferred from banks to the States if the origin of funds was not known
  • Who would decide where funds transferred to the Reclaim Fund would be spent, and for what purpose
  • Whether there should be limits on how much money was spent from the fund

Members also queried the fact that the consultation report had been presented to the States after the debate on the principles, despite the consultation having been completed in September 2015.
