Item 3 20.04.16 515/36 | 2. Harmful Telecommunications The Panel discussed its approach to the review. Given the need to present comments before the resumption of the debate on 14th June it was agreed to focus on whether the draft legislation was fit for purpose, including any potential impact it might have on freedom of speech. Some consideration of relevant legal terminology might be required, for example the concept of mens rea (guilty mind'), but the review would concentrate on the draft legislation rather than the nature of the crimes it was designed to address. The Panel would meet with selected witnesses informally, and would aim to hold a public hearing with the Minister before finalising comments on the proposition at its scheduled meeting on 8th June. | MO |

It was noted that the transfer of functions might complicate comparisons with previous funding arrangements. It was further agreed that a meeting should be arranged with the adviser to the Corporate Services Scrutiny Panel to discuss possibilities for his providing assistance to the Panel.
