Item 1 15/12/17

1.  Draft Marriage and Civil Status (Jersey) Law Review

The Panel held a public hearing with the Catholic Dean of Jersey. The hearing was recorded and transcribed.

Following the public hearing, the Panel continued its discussion about the effect of certain articles in the draft Law.

The Panel agreed to seek further advice on the following issues:

  • Protections for religious buildings;
  • Use of religious content in civil marriage ceremonies;
  • Retention of the terms mother and father', husband and wife' in Law; and
  • The impact of being able to validate any marriage held in an approved location.

The Panel continued its discussion, following on from its last meeting on the 15th December, on the possible amendments it could lodge.  It discussed an early draft of its law drafting instructions and made relevant changes.

Deputy Brée informed the Panel that he disagreed with pursuing an amendment for a Conscience clause.

The Panel noted that it was due to meet with the Bailiff on 19thDecember to discuss whether some of the amendments it was considering were within the scope of the draft Law.
