1. Records of meetings

The Minutes of the meetings held on 24th and 29th January 2018 were approved and signed.

2. Consumer Protection (Unfair Practises) Jersey Law 201_

The Panel discussed the recent briefing provided by the Director of Trading Standards. Members were content with the detail of the briefing, and it was agreed that as a positive response to an EU-led initiative the Panel would support its introduction in due course. No further action was required.

 

 

3. Trusts (Jersey) Law 1984

The Panel noted that Amendment No. 7 to the Trusts Law had now been lodged, although some aspects had been withdrawn. The Panel had been well briefed by Financial Services. It was agreed that the Vice-Chairman would  review  the  latest  documentation  to  see  if  any  questions  or comments might be appropriate, and confirm by email.

4. Licensing Law

The Panel noted that the debate had now been further deferred at the request of the Assistant Minister for EDTSC until 20th March. Following the Panel's meeting with the Assistant Minister on 29th January, the department had confirmed that it had been instructed to co-operate with the Panel on a joint Amendment.

Members  discussed  the  need  for  various  assurances  concerning consultation arrangements for the SALPG. The Panel felt that it was important to ensure that there were more consultees than just the Medical Officer of Health; there needed to be a forum or similar body appointed on a statutory basis to enable all stakeholders to have an influence on the policy, not just the option for the SALPG to set up Sub-Groups if it so wished. The industry must be represented on the body, and it was considered that it would be better for it to be independent, rather than being chaired by a member of the SALPG. The SALPG would be required

to have regard to' its recommendations, but could decide not to follow them.

The Panel noted that while most of its recommendations were apparently being  accepted  by  the  department/SALPG  for  inclusion  in  the  joint Amendment, one or two outstanding differences might still need to be lodged by the Panel as a separate Amendment; for example to recognise economic and social benefits. Members also remained cautious about the possibility that the department/SALPG might try to make changes to the Joint Amendment at short notice.
