Membership The Committee formally welcomed Deputy David Johnson following his appointment as Chair of the Economic and International Affairs Scrutiny Panel, subsequent to Deputy Kirsten Morel 's appointment as an Assistant Minister for Economic Development, Sport and Culture. 3. Activity and Work Programme Updates The Committee discussed the activity reports for the Scrutiny Panels, PAC and all current Review Panels. It further considered Panel work programmes and its own current actions. It agreed that options should be identified for a workshop style event to be held for all Scrutiny Members in the final quarter of 2021, to comprehensively inform the matters to be covered by the Committee's end of term legacy report. In the meantime, it agreed that options should also be identified, ideally through the Commonwealth Parliamentary Association, for a seminar in quarter two of 2021 for all Scrutiny Members on the topic government accountability to parliamentary committees, and associated governance and accountability frameworks. The Committee discussed the approach of Panels to a number of cross cutting topics, mindful amongst other challenges of the implications on Members' time and staff resources of creating any further Review Panels. In relation to Covid-19 it was noted that work would continue to be conducted by Panels on an individual basis relevant to their respective remits, liaising with other Panels and the Committee as required to avoid duplication or to invite additional input on cross-cutting matters. The structure for Brexit work on the UK-EU Trade and Economic Cooperation Agreement was noted, with fisheries matters being scrutinized by the Environment, Housing and Infrastructure Panel and all other trade elements by the Brexit Review Panel. regard to public sector office accommodation, the cross-over between the work of PAC on Estate Management and the Corporate Services Panel, and to a lesser extent the Environment, Housing and Infrastructure Panel, in respect of the proposed new Government headquarters, was considered. The Committee was satisfied by the structure of currently scoped or planned work on PAC and Corporate Services, and by the ongoing and active liaison. |

2. Activity and Work Programme Updates The Committee discussed the activity reports for the Scrutiny Panels, PAC and all current Review Panels. It further considered Panel work programmes and its own current actions. It was noted that the Corporate Services Panel had given consideration to lodging a Proposition in relation to R.19/2021 – Land Transaction SO168 (3) – Office Accommodation Project, Union Street, St Helier, presented initially to the States on 16th February 2021 with an addendum issued on 21st February, as further information was required be provided to the States about the transaction. The Panel had subsequently referred the matter to the Committee due to the nature of the issue, which crossed into the remits of several Panels. The Committee agreed that it would discuss the approach of Scrutiny to work on the Government of Jersey's Office Accommodation' project. Deputy David Johnson declared an interest as a member of the One Government Political Oversight Group, at which this project was an ongoing agenda item, and withdrew from the meeting for the duration of the discussion. The Committee agreed the necessity to seek deferral of approval of the land transaction agreement as proposed in the Reports R.19/2021 and R.19/2021 Add. pending the outcome of a Scrutiny review of the project, the provision to the Scrutiny review of the minutes of all meetings of the Council of Ministers, One Government Political Oversight Group and Regeneration Steering Group in relation to the project, and a States debate, with agreement or otherwise for the Minister to proceed with the land transaction. The terms of reference for the Scrutiny Liaison Committee were recalled. Standing Order 143 (a) provided that the Committee acted as a co-ordinating body for the work of the PAC, Scrutiny Panels and Review Panels, to ensure that there was no undue |

overlap in the work undertaken and to ensure that all aspects of the work of the Council of Ministers were, over time, reviewed. The Office Modernisation Programme connected with numerous Government workstreams including the Island Plan, estate management strategy, other major capital project programmes and the carbon neutral strategy. These in turn cut across multiple Panel remits, and it was agreed that in this context the Committee should seek to bring the Proposition in its name. 5. Scrutiny Public Engagement The Committee welcomed the Head of Digital and Public Engagement (States Greffe) who provided a comprehensive update on the development of a public engagement strategy for the States Assembly which was shared with the Committee, and included the development of a consistent but dedicated strategy for the Scrutiny function. The Committee welcomed both aspects. It stressed the importance of successful engagement to the work of Panels and the PAC, and its long-standing anticipation of proposed increases in resources and associated improvements in this area for the Scrutiny function. It looked forward to working closely with the Head of Digital and Public Engagement in the coming weeks to finalise the dedicated Scrutiny strategy. The Head of Digital and Public Engagement confirmed that a draft would be provided to the Committee by the end of March, and it was agreed that a further meeting would be held at this time to explore the proposals and discuss the Committee's feedback. | TO/J'OB | |||||||

With regard to the focus groups the Panel had identified a requirement to carry out two additional sessions with professionals within maternity services in order to reach them and hear their views, as well as the views of parents. In relation to the expert advisers, it had concluded that the extra four days would allow for greater stakeholder engagement and the development of best practice benchmarks of the Jersey maternity services model to further enable an objective assessment of current services. In particular, it discussed the cross-cutting nature of work on the emerging medicinal cannabis industry which fell within the remits of the Environment, Housing and Infrastructure Panel and the Economic and International Affairs Panel. It was noted that it was the intention for the respective Chairs and Panel Officers to liaise closely to avoid duplication or omission, and to actively identify appropriate opportunities for a collaborative approach as appropriate. 5. Codes of Practice The Committee received and approved updates to the Scrutiny/PAC Engagement' and Proceedings' Codes of Practice. It was noted that amendments to the Engagement Code' required States approval to be brought into effect. It was therefore agreed that the draft would be shared with the Chief Minister and arrangements made for discussions to take place on the proposed changes. In conjunction, the potential for the matter of access to minutes of meetings of the Council of Ministers and other such Government bodies would be re-visited. | TO | |||||||||||
6. Jersey Youth Parliament (JYP) The Committee welcomed the Senior Youth Worker responsible for the JYP to discuss engagement with the Scrutiny function. The first sitting of the Youth Parliament was held in the virtual States Assembly on 8th March, when the members decided which three policies they would campaign on during their term of office. Out of 15 options, the Jersey Youth Parliament voted for the following campaigns: • Improving Mental Health facilities in Jersey • Climate Change • Education in Jersey It was noted they would research their policies in smaller campaign groups and gather the views of other young people before compiling a report/presentation which would be available to all States Members. Mindful of the similarity of Scrutiny work to that of the JYP, the Committee agreed that relevant Panels and their Officers could offer helpful insight, support and information to the JYP in these areas, as well as more generally, as campaign groups set about their work. Equally, Panels more generally would welcome and benefit from the opportunity to engage with and listen to the views of the members of the JYP. 2. Activity and Work Programme Updates The Committee discussed the activity reports for the Scrutiny Panels, PAC and all current Review Panels. It further considered Panel work programmes and its own current actions. It was agreed that arrangements for two all scrutiny member events currently being pursued separately, in respect of training/learning and planning for the Committee's end of term legacy report respectively, should be combined into a single event held in September or October 2021. It was requested that arrangements should provide for a day split into a morning of facilitated training/learning that would include representation from the CPA Academy, and an afternoon facilitated session reflecting on the term office and identifying matters to be covered in the legacy report. | TO |
3. Privileges and Procedures Committee (PPC) The Committee noted a report from PPC providing an update on its recent activity. The Committee also considered correspondence from PPC regarding the trial of a 3- week cycle for States meetings, inviting feedback from the Committee. Given the range of views on the matter, it was agreed that this invitation would be relayed to all Panels and the PAC to reply directly to PPC if they wished to do so. As the Committee did not hold a collective view it would refrain from submitting a collective response, but noted that members were able to engage individually with PPC. |

4. Scrutiny Budget The Committee received an update on review expenditure in the year to date and the remaining available budget. It was anticipated that forecast expenditure would shortly exceed the allocated budget due to the unprecedented scale and technical nature of Panel Work programmes in the context of the ongoing pandemic, and Government priorities such as the new hospital project. Officials from the States Greffe and Treasury and Exchequer were in dialogue concerning the provision of additional funding to the Scrutiny function for Covid related work, in line with a Government |

Mindful of significant imminent disruption to work across the Scrutiny function, the Committee agreed to write to the Greffier of the States with a view to determining a swift and sustainable formal resolution to the budgetary situation. | TO |
5. Public Engagement The Committee welcomed Deputy Louise Doublet to discuss her ideas on initiatives to enhance engagement by Scrutiny Panels/PAC with children and young people. It was noted that whilst significant progress has been made in this area during the present Assembly, there remained considerable scope for improvement across the Scrutiny function in respect of knowledge sharing and practical measures. |

Welcoming the outline and analysis provided by Deputy Doublet , the Committee agreed with her that a working party should be established to develop this area in structured manner, with a view to producing a detailed framework that, upon approval by the Committee, would be included in the Committee's legacy report and could be implemented from the beginning of the new Assembly in 2022. Scrutiny Budget An update was provided to the Committee on review expenditure for the year to date and the remaining available budget, noting that additional funding of up to £80,000 had been agreed with the Minister for Treasury and Resources. This funding was in recognition of the exceptional expenditure required for technical work in relation to scrutiny of the hospital project and was ring-fenced accordingly for that purpose. This in turn enabled the Committee to consider the engagement of expert technical advice for scrutiny of the Government Plan, in addition to further, albeit limited, potential consultancy engagements by Panels to the year end. |

5. Public Engagement The Committee, having expressed its disappointment at the absence of a requested paper updating it about the implementation of initiatives in relation to the draft Scrutiny Public Engagement Strategy, discussed further concerns about the provision of communications and public engagement support to the Scrutiny function. It was agreed that the President would raise the matter directly with the Greffier of the States. Environment, Housing and Infrastructure Panel: Affordable Housing Supply and Delivery The Committee recalled its approval on 22nd June 2021 of a budget of £14,700 for the engagement of a specialist adviser for the Review. It was noted that the engaged adviser ARK Consultancy' had drawn attention to the Panel that it required more time than previously envisaged to complete their tasks, resulting in an extra 5 days' work. It was explained that ARK had advised that the variance was largely the result of the emerging scope of background study and lines of questioning raised. There had, furthermore, been an additional public hearing with Jersey Development Company and the analysis of written responses from Ministers which had incurred extra time analysing the evidence and, consequently, the time spent on the report and recommendations. The Panel had been satisfied with the explanation and funding request and sought the Committee's approval of the additional funds accordingly. The Committee approved the additional budget. |

Public Engagement The Committee welcomed the Head of Digital and Public Engagement (States Greffe) who provided an update on the implementation of a number of initiatives in relation to the Scrutiny Public Engagement Strategy. The Committee noted, in particular, recent progress with recruitment that would help to provide increased capacity to the Scrutiny function, in addition to the prioritisation of Scrutiny work within the digital and public engagement communications team. It was agreed that ongoing focus would be given to right first time' draft output, and that this aspiration would be assisted by the developing working relationships and processes between the communications team, Committee and Panel Officers and Chairs. The importance of the team working with and through the Committee and Panel Officers was stressed, and it was further agreed that greater exposure to Panel/PAC work through that | TO/JO'B |
framework, and attendance at more hearings and meetings, was pivotal to the team achieving high quality, scrutiny-oriented output in the initial drafting stage. A commitment to an agile approach in achieving appropriately timed output on relevant channels was discussed, alongside ensuring that consideration was given to ensuring that all Panels received a proportionate and consistent level of service. Separately, the Committee noted that apologies had been received from the Chair of the working group examining initiatives to enhance engagement by Scrutiny Panels/PAC with children and young people. The Chair would be unavailable for approximately one month and consequently, given her pivotal role in the initiative, the Committee agreed that progress of the working group would be restricted until her return. |

6. Jersey Public Services Ombudsman (JPSO) The Committee welcomed the Head of Policy, SPPP, who provided an update on the progress of developing associated legislation, and who requested consideration of the role of the Committee in respect of the JPSO. The Head of Policy outlined a possible role for the Committee in respect of the JPSO Board recruitment process, annual reporting and annual plan/holding to account processes that was broadly similar to that which it held in respect of the Children's Commissioner. She sought in principle support from the Committee to pursue the matter further as the legislation evolved. The Committee thanked the Head of Policy for her time and committed to respond to her in due course after further consideration of the matter. The Head of Policy withdrew from the meeting accordingly. Having considered the matter, the Committee agreed to confirm to the Head of Policy that it was supportive in principle of the role that had been outlined, should the Assembly agree to the creation of the Ombudsman. | TO |

1. Economic and International Affairs (EIA) Panel: Draft Income Tax (Amendment of Law – Taxation of Cannabis Companies) (Jersey) Regulations 202- The Committee approved a scoping document and Terms of Reference for the above Review. It was noted that the matter would typically fall within the remit of the Corporate Services Panel, however, due to the regulations relating to medicinal cannabis and the EIA Panel's ongoing review in that area, it had been agreed between the Panels that EIA would most appropriately undertake this review. The following budget was agreed: 2 x Public Hearings at £300 each = £600 Expert Advisor = £7,500 Total = £8,100 |

1. Minutes The Committee approved the records of its meetings held on 21st, 25th and 28th October 2021. |

2. Activity and Work Programme Updates The Committee noted the activity reports for the Scrutiny Panels, PAC and all current Review Panels. It was noted that the Care of Children Review Panel would shortly have fulfilled its terms of reference upon presentation of its forthcoming report. In accordance with Standing Orders of the States of Jersey and in consultation with the Chair of the Review Panel, Deputy Rob Ward , the Committee agreed that the Panel would therefore be formally disbanded once that phase of work and been completed. The Committee noted the Government Legislative Programme 2021/22, recalling that at its pervious meeting it had discussed concerns about the potential volume of Government legislation to be lodged for debate by the Assembly before the effective end of the current political term in early May 2022. It was agreed that this remained a significant challenge. Further concern was expressed about the inclusion in the Programme of a column that contained the Government's assessment as to the 'likelihood of scrutiny'. The basis for such assessment was unclear and it was agreed that each Panel should take note of associated ratings attributed to work within its remit and, if required, respond accordingly to respective Ministers. |

3. Privileges and Procedures Committee (PPC) The Committee noted a report from PPC providing an update on its recent activity. |

4. Scrutiny Budget An update was noted by the Committee on review expenditure for the year to date and the remaining available budget in 2021. |

5. Public Engagement |
|
The Committee welcomed the Head of Digital and Public Engagement (States Greffe) who provided an update on the implementation of a number of initiatives in relation to the Scrutiny Public Engagement Strategy. The Committee provided specific feedback on the recent initiative of a stand in the town centre that had been used to promote in person public engagement with the work of Panels by Members, in respect of the Government Plan. There was consensus that, in principle, the stand had been a welcome extension to the more typical approaches adopted by Panels and should be used again for appropriate Reviews. The QR codes were noted a having worked well, however, the complexity of the topic area and shortcomings in elements of the methodology, such as the absence of a simpler and shorter survey amongst other matters, had compromised the extent and depth of views gathered on this occasion. The Committee also expressed its reservations about aspects of a States Assembly branding project that were relevant to Scrutiny, in particular the adoption of a separate colour palette to that of the wider States Assembly, and the corresponding choice of the colour blue. |

2. Activity and Work Programme Updates The Committee noted the activity reports for the Scrutiny Panels, PAC and all current Review Panels. The Committee recalled that at its meeting held on 18th November 2021, it had noted that the Care of Children Review Panel would shortly have fulfilled its terms of reference. Upon presentation of its forthcoming report, it had been agreed by the Committee that the Panel would therefore be formally disbanded. The Committee was informed that while this had not yet occurred, the report was being finalised and the completion of the Panel's term was imminent. The Committee discussed the increasing workload of the Safer Travel Review Panel in response to the developing Omicron situation. It was considered that the remit of the Review Panel would be too narrow to enable an appropriate scope of scrutiny work to be undertaken in response to the developing situation, which extended across a range of community matters. It was agreed that wider scoping and terms of reference should be drafted for the Review Panel to consider next steps, and that an increase in membership was likely to be required. It was agreed that a letter to the Bailiff would be drafted, for approval by the President, requesting his consideration of a ruling on the matter of the support that it was appropriate for Ministers to receive from Government officers during virtual States Meetings. | TO TO |

4. Democratic Accountability and Governance Sub-Committee The Committee welcomed Senator Tracey Vallois, who shared an update on the draft findings and recommendations of the Democratic Accountability and Governance |
