1. Procedural and Administrative Matters

The Panel agreed to appoint Deputy Beatriz Porée as Vice-Chair.

The Panel noted and agreed that future Panel meetings in 2022 would be scheduled to take place, where possible, on Monday mornings from 10am to 12pm.

The Panel noted that, where possible, the Panel would undertake its work in a public manner to ensure accountability and transparency.

The Panel noted that personal matters related to constituents or members of the public could only be dealt with by States Members on an individual basis, and outside the scope of the Panel's work.

 

2. Declarations and Conflicts of Interest

The Panel noted the Code of Practice for Scrutiny and Public Accounts Committee Proceedings, and requested physical copies be provided to the Vice-Chair.

3. Working Practices

The Panel discussed the forum for undertaking its scheduled meetings and agreed to meet in-person but reserved the option to undertake meetings virtually and in- person if required.

The Committee and Panel Officer informed the Panel that Microsoft Teams was the default means by which information would be shared with the Panel. The Panel requested that information also be shared via email.

The Panel was then informed that the Committee and Panel Officer was the Panel's dedicated resource, and that the time of the Research and Project Officer was split between the work of the Panel and the Public Accounts Committee.

4. Scrutiny Member Training

The Panel noted that the Scrutiny Liaison Committee had considered a training package for all States Members to include guidance on effective scrutiny, Chair training, media training and question training, to take place in the latter half of 2022.

 

 

The Panel also noted proposed visits to the House of Commons, Portcullis House and Westminster Hall in London, to take place in 2022.

The Panel requested a copy of the States Greffe organisational chart and also to make enquiries about a contacts list which was being produced by the Members' Resources team of the States Greffe.

5. Work Programme

The Panel noted the content of the Legacy Report which had been produced by the previously constituted Panel.

The Panel discussed recent school closures following a period of extreme heat in Jersey in July 2022. The Panel requested that the Officer send correspondence to the Minister for Children and Education to question this matter and, also query topics of public interest, namely, Ministerial priorities for the new political term, teacher recruitment and retention and the Children's Service.

The Panel also requested that correspondence was sent to the Minister for Home Affairs for an update on Justice and Home Affairs priorities in the new political term.

The Panel also noted a number of areas of interest and requested that the Panel's officers undertake research for its consideration.

The Panel noted the benefits of visiting various sites within their remit. The Panel asked Officers to make enquiries and arrangements for a variety of site visits for Panel members during August and September 2022.

1. Site visit to Child and Adolescent Mental Health Service (CAMHS)

The Panel visited the CAMHS Office at Children's Services (Liberte House), to discuss the services provided by CAMHS with Darren Bowring, Head of Children's Health and Wellbeing, Children, Young People, Education and Skills (Head of Children's Health and Wellbeing).

The Head of Children's Health and Wellbeing informed the Panel about the key services provided by CAMHS, the challenges faced by the service and the changes that were underway following the establishment of the Children and Young People's Emotional Wellbeing and Mental Health Strategy 2022-2025 and, also, additional money provided in the Government Plan.

The Panel was advised that the Jersey Comptroller and Auditor General had recently undertaken a review of CAMHS. The report had not been finalised and published yet, but the Panel was advised that publication was expected within the next few weeks.

The Panel also noted that CAMHS would be subject to a review from the Jersey Care Commission in early 2023.

The Panel received a tour of the first floor of Liberte House and was shown rooms used for meetings, medical assessments, an art therapy room, and the office used by CAMHS staff. It was explained that the long-term location for CAMHS was not secure (beyond approximately 5 years) and further decisions had to be made on where the service would be located in the future.

The Panel thanked the Head of Children's Health and Wellbeing for his time, and they concluded the site visit of Liberte House.

1. Site visit to Customs and Immigration Service, Maritime House, La Route du Port Elizabeth, St Helier, JE1 1JD

The Panel visited the Jersey Customs and Immigration Service (JCIS) based in Maritime House to discuss its work with Mark Cockerham, Head of Service, Customs and Immigration (Head of Service) and Andrew Hunt, Deputy Operations, Customs and Immigration, ( Deputy Operations).

The Panel received an initial presentation from the Head of Service and Deputy Operations which included an overview of the various aspects of JCIS, including border  control,  revenue  collection,  the  issue  of  passports,  deportations, naturalisations, work visas, work permits and the investigation of customs offences.

It was explained that Maritime House was the administrative base for JCIS but that it was operational over a large area, including the harbour, airport and Jersey Post site.

The Panel was advised that Brexit had been transformative in the way that the JCIS operated – in all aspects such as work permits and goods control.

Details about the different immigration work permits, that were available for people moving to Jersey, were discussed. The Panel noted that the permits included a route for skilled workers and also various temporary routes (dependant on the sector: for example construction, agriculture, hospitality).

The Panel received a brief overview of the goods control process. It was explained that JCIS facilitated the collection of approximately £88 million in revenue for Jersey through excise duty, Import Goods and Services Tax, third country customs duty (EU), and vehicle emissions duty.

In response to queries from the Panel it was confirmed that political direction was vital  for  JCIS,  particularly  with  regards  to  sensitive  aspects,  for  example,  the approach Jersey took in relation to accommodating refugees from Ukraine.

 

 

The Panel was also advised that JCIS had joint units to work with the States of Jersey Police, the Jersey Financial Crime Unit (for MoneyVal assessment) and that there were  also  close  working  relationships  with  the  United  Kingdom  Border  Force, Guernsey Border Agency, and French Customs.

The Panel received a tour of Maritime House, including introductions to the customs and immigration officers working in areas relating to policy, passports, and customs declarations.

The Panel thanked the Head of Service and the Deputy Operations for their time, and they concluded the site visit of the Service at Maritime House.

1. Records of Meetings

The Panel approved the records of its meetings held on 25th July and 3rd August 2022 and noted the file note of the informal meeting held on 2nd August 2022.

 

2. Student Loans Support Group

The Panel welcomed Ms. Nicola Heath representing the Jersey Student Loans Support Group (JSLSG') (the Representative') to the meeting.

During the meeting the Representative provided an overview of concerns and the challenges that were facing Jersey students in higher education and their families. The following matters were discussed:

  • The Government's proposed mini-budget': It was stated that the mini- budget proposition did not include any support for higher education students who were experiencing significant challenges in meeting the cost of living, especially when based in the UK. The JSLSG had submitted evidence to the Corporate Services Scrutiny Panel for consideration as part of their review.
  • Government's  promised  review  of  student  finance  has  not  been undertaken: The JSLSG had contact with the previous Education Minister(s) to follow up about the review of student finance and higher education funding (note: reference to P.33/2018, as amended). Aspects which had not been evaluated  included  the  suitability  of  a  stepped'  system  with  particular impacts for those on the edges of the income bands and, also, the lack of student bank loan options.
  • Uplift to the student maintenance grant has not kept pace with the cost of living: The most recent uplift of 2.9% as a result of the Education (Grants and Allowances) (Amendment No. 3) (Jersey) Order 2021 has not matched

 

 

increases in RPI% over the same period. The Representative referenced that the UK RPI increase over the same period was 16%.

  • Changes for separated families: Previously a single parent household had be assessed on one income within that household, however, subsequent changes were made to the way in which parental income is assessed under the scheme. It was confirmed that the income of both parents (in the event of divorce or separation) needed to be considered for higher education grants.
  • Postgraduate funding: There was no regulation for the use of public money in the use of postgraduate funding and the scheme in place had not been reviewed for over 20 years.

The Panel thanked the Representative for her time and she left the meeting.

 

3. Draft Marriage and Civil Partnership (Amendments) (Jersey) Law 202-

The Panel welcomed the Senior Policy Officer, SPPP, to the meeting. The Senior Policy Officer provided the Panel with a briefing on the proposed Draft Marriage and Civil Partnership (Amendments) (Jersey) Law 202- (the Amendment') and was advised that the Minister for Home Affairs intended to lodge the Amendment shortly, so that it would be included on the Order Paper for the States Assembly sitting on 4th October 2022.

The Panel was advised that the draft Law was required to amend both the Marriage and Civil Status (Amendment) (No. 5) (Jersey) Law 2022 (P.6/2022) and the Civil Partnership (Amendment) (Jersey) Law 2022 (P.7/2022) (the Laws'), which were both approved by the States Assembly in March 2022, but are yet to receive Royal Assent.

The Panel was advised that, following States Assembly approval, the Laws had been sent to the UK Ministry of Justice for review ahead of presentation to the Privy Council. At this point an issue was identified with the schedules used in each of the Laws that made them non-compliant with the European Convention on Human Rights, following the ruling in the case of B and L v. United Kingdom.

The purpose of the draft Laws is to primarily address the identified issue. The Panel understands that the Laws will not be presented to the Privy Council for Royal Assent without compliance with the provisions set out in the European Convention on Human Rights.

The Panel had a number of queries in relation to safeguarding and these were responded to by the Senior Policy Officer.

The  Panel  requested  its  officer  to  draft  a  comments  paper  in  relation  to  the Amendment.

The Panel thanked the Senior Policy Officer for his time and the briefing ended.

4. Scrutiny Member Training: Update

The Committee and Panel Officer (CPO) provided the Panel with an update on the status of the Teams, Outlook and media training that had been previously requested for some members. The CPO requested clarification of each members' requirements. It was confirmed that the sessions were in the process of being arranged with external training providers.

 

 

5. Correspondence with the Minister for Children and Education

The Panel noted the written response dated 2nd August 2022, from the Minister for Children and Education. The letter had been received in response to the Panel's letter of 25th July 2022 querying, inter alia, the Minister's priorities for the next six months.

In addition to Ministerial priorities, the letter had asked questions about school closures in extreme heat, teacher recruitment and retention, and the Children's Service.

The Panel noted that it would meet the Minister informally in September 2022, ahead of the first public quarterly hearings (which would likely be scheduled for October).

 

6. Correspondence with the Minister for Home Affairs

The Panel noted the written response dated 10th August 2022, from the Minister for Home Affairs. The letter had been received in response to the Panel's letter of 25th July 2022 querying the Minister's priorities for the next six months.

The Panel noted that it would meet the Minister informally in August 2022 ahead of the first public quarterly hearings (which would likely be scheduled for October).

 

7. Site visits / briefings with the relevant Ministers and Departments

The Panel noted the schedule of site visits which had been arranged so far for August and September 2022.

The Panel had already undertaken visits to CAMHS (Child and Adolescent Mental Health Services) and the Customs and Immigration Service and had also planned visits to: the States of Jersey Police; States of Jersey Ambulance Service; States of Jersey Fire Service; and Probation and After-Care Service during August 2022. Further activity was planned for September.

The Panel agreed to share that they had undertaken the visits in a social media post towards the end of August.

8. Work Programme

The Panel noted the template work programme that would be used to plan the Panel's future work and reviews going forward.

The  Committee  and  Panel  Officer  explained  that  this  was  a  live'  document, maintained by the Panel's officers and that would be regularly shared with the Panel to help them identify current and known upcoming workstreams for scrutiny panel work. It was also noted that the document would be shared with the Scrutiny Liaison Committee on a regular basis.

1. Site visit to the States of Jersey Police (SoJP)

The Panel and Connétable Mark Labey visited the SoJP Headquarters on La Route du Fort, St Helier, to discuss policing in Jersey with Robin Smith, Chief Officer, Stewart Gull, Deputy Chief Officer and Alison Fossey, Detective Superintendent, Head of Criminal Investigation Department for the SoJP, and toured the facilities at the SoJP Headquarters.

The Panel initially received a presentation which was led by Robin Smith, Chief Officer and provided an overview of the operational structure of the SoJP, the remits of  various  departments  within  the  SoJP,  policing  priorities  and  performance indicators; policing statistics and notable police cases that received media attention. The Panel discussed the key challenges that related to policing recruitment and retention and trends related to specific crimes and crime statistics.

The Panel then received a tour of the facilities of the SoJP Headquarters from Gemma Neil, Sergeant/Staff Officer and Iain Ford, Acting Police Sergeant/Staff Officer for the SoJP. The Panel was shown the SoJP custody suite, basement parking, operational areas and the 24/7 control room.

The Panel thanked the Officers for their time, and they concluded the site visit of the SoJP Headquarters.

1. Site visit to the States of Jersey Ambulance Service (SoJAS)

The Panel visited the SoJAS Station on Rouge Bouillon, St Helier, to discuss the service  with  Peter  Gavey,  Chief  Ambulance  Officer  and  Gary  Kynman,  Senior Ambulance Officer for SoJAS, and toured the facilities at the SoJAS Station.

The Panel initially received a tour of the facilities by the Chief Ambulance Officer and were  shown  various  staff  facilities,  ambulance  equipment  and  medical  supply storage, the interior of an Ambulance, the Ambulance parking bays, different types of Ambulances and the SoJAS control room.

The Panel then received a presentation which was led by the Chief Ambulance Officer and the Senior Ambulance Officer, who provided an overview of the SoJAS business plan which included 36 Red Amber Green' objectives, SoJAS recruitment and retention, the relationship between the SoJAS and the Jersey Care Model, training and development of paramedics, the Ambulance Response Programme, staff wellbeing and safety and the management of complaints to SoJAS.

The Panel thanked the Officers for their time, and they concluded the site visit of the SoJAS Station.

Action

1. Meeting: End Cannabis Prohibition Jersey

The Panel received Simon Harris on, Coordinator (Coordinator') of the End Cannabis Prohibition Jersey (ECPJ') Campaign for a meeting to discuss the work of the ECPJ to promote reform of the Island's approach to cannabis.

The meeting was led by the Coordinator, who informed the Panel that he was a representative of the ECPJ and had been in contact with many States Assembly candidates during the 2022 elections in Jersey.

It was advised that the ECPJ began lobbying for cannabis related issues in 2019, that concerned the legalisation of medicinal cannabis, improvements in patient access to medicinal cannabis and on-Island research related to drug issues in Jersey.

The Coordinator informed the Panel that the previous substance misuse strategy had concluded at the end of 2019, and advised that the ECPJ then requested an update on the development of a new substance misuse strategy from the Health and Community Services Department in 2020, and that this correspondence had been unsuccessful, and led to the ECPJ liaising with the previously constituted Children, Education and Home Affairs Scrutiny Panel. It was advised that there had been a lack of information and resources related to substance misuse on the Government of Jersey website and that the previous substance misuse strategy had not been updated or replaced. It was also advised that the Coordinator was concerned about the terminology used to describe drug issues, such as misuse' and abuse' which only accounted for drug related issues once they became problematic. It was further advised that the Coordinator was concerned that the Minister for Home Affairs (Minister')  had  recently  announced  the  development  of  a  substance  misuse strategy', rather than a substance use' strategy.

The Panel noted that the Minister had commented on the need for appropriate language and harm reduction in relation to drug issues and asked whether it was important to limit the breadth of any future substance strategy. It was advised that

 

 

any drug strategy had to be broad to ensure it addressed the wide range of issues that affected people with drug related problems.

The Panel asked what should be regarded as a substance, and whether a substance use strategy should also include alcohol. It was advised that a substance use strategy should be a combined drugs and alcohol strategy and made reference to the combined alcohol and drugs strategy developed in Guernsey. It was also advised that a combined strategy should promote healthy lifestyles and wellbeing, and that there had been a lack of on-Island resources to educate people about the impacts of drug and alcohol.

The Panel questioned why the Coordinator believed there was a lack of available resources and information on drug related matters. It was advised that the crossover of responsibility for substance misuse between different Government Departments, potentially created challenges for Government in the development of resources and provision of information.

The Panel noted that discussion about decriminalisation of cannabis in Jersey would lead to some concerns about the outcomes of decriminalisation and asked what the answers to those concerns were. It was advised that research undertaken in other jurisdictions did not evidence an increase in the number of young people using cannabis but did show an increase in cannabis consumption by pre-existing cannabis users. It was also advised that whilst there was some evidence of an increase in cannabis  use  following  decriminalisation  in  other  jurisdictions,  there  was  also evidence of a corresponding decrease in the use of more harmful drugs. It was further advised  that  appropriate  regulation  was  crucial  to  ensure  control  over  the marketplace following decriminalisation of any controlled substance.

The Panel expressed concern about the black-market economy and the illegal resale of medicinal cannabis and asked how this could be deterred. It was advised that the illegal resale of medicinal cannabis was unique to Jersey and that there was an on- Island cannabis sharing culture'. It was also advised that the Coordinator believed the only means to remove the black-market element, was to allow Islanders to grow cannabis at home, and cited Luxembourg as an example of another jurisdiction that enabled residents to legally possess and grow cannabis, to eliminate the black market.

The Panel asked the Coordinator to summarise the main points that ECPJ had campaigned for. It was advised that ECPJ campaigned for the progression of a new substance use strategy for Jersey and the removal of terminology related to misuse' and abuse', a public consultation on drug related issues and to highlight that decriminalisation  of  cannabis  already  existed  in  part  in  Jersey,  through  the development of Attorney General directives over the past 25 years, that meant that Islanders were able to possess up to 15 grams of cannabis without a criminal conviction, and were instead issued fines and warnings through the Parish Hall Enquiry system.

The Panel thanked the Coordinator for this time, and they concluded the meeting.

The Panel noted and approved the records of meetings held on 11th, 15th, 16th and 18th August 2022, and the file notes from 11th, 16th, 18th and 25th August 2022. The Panel requested that the Officer make an amendment to the 25th August 2022 file note.

3. Scrutiny Member Training: Update

The Panel noted that the proposed dates and times for Microsoft Teams and Outlook training sessions would be sent to the Panel for its consideration in due course.

The Officer informed the Panel that dates for the visits to the House of Commons would be provided once Parliament reconvened and that it was likely to take place in December and January, due to the Panel's availability.

The Panel noted that it had met informally with the Minister for Home Affairs (Minister') on 31st August 2022, and that some of the areas of discussion could form question areas for future Quarterly Public Hearings with the Minister, as well as options for a potential review.

2. Introduction to the work of the Digital and Public Engagement (DPE) Team

The Panel received Jenny O'Brien, Head of Digital and Public Engagement, to discuss the role of the DPE Team at the States Greffe.

The Panel was informed that Scrutiny Panels were supported by Communications Officers, whose role included implementation of the Panel's communication strategy, discussion of the use of social media prior to any meetings or Hearings, options for asking the public questions related to the work of the Panel and the publication of press notices.

The Panel asked how the budget for Panel communications was determined. It was advised that there was currently no fixed methodology for the budget available to Scrutiny Panel's for communications and that a budget process would need to be agreed by the Scrutiny Liaison Committee.

 

 

The Panel noted that it would need to use communications to highlight its ongoing work. It was advised that internal discussions had taken place about the options for Scrutiny Panel's to communicate their workstreams with the public on a regular basis. It was also advised that the Panel could ask questions via written correspondence to Minister's to follow-up on any areas of concern, which would then be published on the Panel's website.

 

3.  Youth Parliament

The Panel noted that the Jersey Youth Parliament was scheduled to meet at 4:30pm during the afternoon of 26th September 2022.

 

4.  Ministerial Decisions

The Panel noted five Ministerial Decisions that had been made by the Minister for Home Affairs in August 2022 and agreed that none of them required further action by the Panel.

 

5.  Children and Young People Law

The Panel recalled that it had received a briefing from the Assistant Minister's for Children and Education and Government Officers on 7th September, regarding the Children and Young People (Amendment) Law 202-, and the policy on Independent Advocacy.

The Panel discussed drafting a Comments Paper in response to the proposed Amendment to the Children and Young People Law and agreed to be kept informed about any future policy developments.

 

6.  Proposed Review of Migrant Welfare

The Panel noted that the Officer had drafted and circulated a proposal for the establishment of a Migrant Welfare Review Panel, which had subsequently been approved by the Scrutiny Liaison Committee.

The Officer informed the Panel that a number of changes had been made to the dates and times of the Panels schedule of meetings and site visits which followed the passing of Her Majesty the Queen and included:

7.  Work Programme

The Panel noted its work programme and was advised that the Government Plan 2023-2027 was due to be published on 4th October 2022. It was also advised that

 

 

the Review of the Government Plan would include the Government Programme, Common Strategic Policy, Ministerial Priorities and the 100 Day Plan.

 

8.  Student Finance

The Panel expressed concern about anecdotal reports it had received from members of the public in relation to delays processing Student Finance applications and requested that the Officer draft a letter to the Minister for Children and Education, with questions about the delays and in order to obtain some quantitative data.

9.  States of Jersey Ambulance Service (SoJAS): Staffing Concerns

The Panel expressed concern about reports it had received that the SoJAS recently had to operate with low numbers of qualified frontline staff and requested that the Officer draft a letter to the Minister for Home Affairs with questions about the SoJAS staffing situation.

1. Site visit to Grouville School

The  Panel,  together  with  the  Minister  and  Assistant  Minister  for  Children  and Education, received a tour of Grouville primary school from the Headteacher.

It was explained that the school had a two form entry for children from Reception to Year 6 and also incorporated a pre-school nursery, which had a dedicated space and outside area. The Panel visited the classroom and library space and were also given the opportunity to speak to some children in the learning environment.

The Panel viewed the school hall and heard about the proposed plans for the delivery of hot school meals and the addition of a servery. The Panel heard about the challenges that the school had with the size of, and sound within, the hall and storage space throughout the school building.

The  school  had  a  variety  of  excellent  outside  areas  to  enhance  the  learning environment for the children. There were separate garden play spaces for the nursery and reception classes, together with a playground, artificial grass space and a grass field available for the whole school. The school also benefited from the use of an adjacent meadow, Le Pre Arthur, which was used for a range of outdoor learning. The  Headteacher  explained  that  the  meadow  was  owned  by  a  trust  and  was managed and operated by a team of volunteers. Maintenance of the meadow was largely financed through sponsorship and fundraising.

Vehicle access to the school for drop off and collection times was noted to be a particular challenge but was currently managed by providing different year groups with specific drop off and pick up times.

 

 

The Panel thanked the Headteacher for her time, and they concluded the site visit of Grouville school.

2. Unite, the Union

The Panel welcomed Mr. James Turner, representing Unite, the Union (Unite') (the Representative') to the meeting.

The Panel had invited the Representative to meet with them as part of its introductory programme to the Panel's remit of work. During the meeting, at the request of the Panel, the following matters were discussed with the Representative:

  • Recruitment and retention of staff, by the Government of Jersey as an employer: the Panel indicated that this matter had been highlighted to them as an issue for a number of Government Services.
  • Trainee schemes: The Government's apprenticeship scheme and the Paid Training Initiative through Back to Work was discussed. The Representative advised that Unite had actively promoted the initiative to employers, but there was  no  indication  of  what  the  take-up  rate  had  been.  Attendees  also discussed the rate of minimum wage for trainees and the importance of succession planning and training.
  • States of Jersey Ambulance Service (SoJAS): The Panel explained that it had been made aware of concerns in relation to the SoJAS, namely that it had recently had to operate with low levels of qualified frontline staff. The Representative confirmed that Unite, the Union was aware of these problems through their representatives. It was noted that the Panel had sent a letter to the Minister for Home Affairs on 28th September 2022 and were expecting a response during the course of the week.
  • Working conditions: Minimum holiday entitlement had recently increased in Jersey, however, it was stated that this still fell below the entitlement in the

 

 

UK. Other work benefits could be provided by employers in addition to cash, for example, options for health and dental insurance bolt-on' options.

  • Childcare: Attendees discussed issues arising for employees when work patterns were changed to be less family friendly.
  • Employment  of  ex-offenders:  In  response  to  queries  from  the  Panel regarding the employment of ex-offenders, the Representative confirmed that he would expect any ex-offender to be treated equally to, and have the same conditions and pay as, other employees. The Representative advised that in his role as a union representative for Prison Officers he understood that the training and rehabilitation offer in the prison had been changed.
  • Zero hours contracts: The Representative advised the Panel that Unite, the Union did not support zero hours contracts. Whilst it was recognised that there were certain circumstances where a zero-hours contract could be beneficial  to  both  employee  and  employer,  there  was  also  the  risk  of employees having negative impacts on their life from this type of employment contract. For example, a zero-hours contract would not provide sufficient evidence of income required for a phone contract, or property lease.
  • Minimum  wage:  The  Panel  and  the  Representative  discussed  recent changes to the minimum wage in Jersey and conversations about moving to a Living Wage.
  • In work discrimination: It was noted that, since 2017, businesses with over 250 employees in the UK had to report on the gender pay gap, however, this reporting was not required in Jersey. The Panel was advised that Unite was attempting to drive down the gender pay gap. It was suggested that some businesses were not able to recognise their position until they had undertaken work to see the difference between the average earnings of men and women across a workforce. The Representative indicated that, generally, he was aware of fewer complaints of employer to employee discrimination than employee to employee discrimination.
  • Reach  of  the  union:  The  Panel  enquired  whether  the  Union  had representatives from all work sectors and, also, whether people who worked in  Jersey  on  temporary  work  permits  could  become  members.  The Representative advised that Unite was open to memberships for workers in many sectors, but there was generally less membership from sectors such as tourism  and  hospitality.  The  Panel  was  advised  that  a  community membership was also available for individuals who were not in work.

The Panel asked the Representative if there were any matters that he wished to highlight, and the following areas were discussed:

  • Health and Safety: including that Jersey was behind UK standards.
  • Employment Law: The limitation period on unfair dismissal claims in Jersey employment law was 56 days, compared to 90 days in the UK. It was suggested that the 90-day timeframe was tight, and therefore the shorter timeframe in Jersey created further pressure. The Panel was advised that, in some instances, there was not enough time for employees to undertake the process within the available time window.

The Panel thanked the Representative for his time, and he left the meeting.

 

3. Ministerial Decisions

Since its previous meeting, the Panel had not been made aware of any Ministerial Decisions signed by either the Minister for Home Affairs, or the Minister for Children

 

 

and Education. No further Ministerial Decisions had been uploaded to the gov.je website.

 

4. Government Plan 2023-2026 and Common Strategic Policy

The Panel noted that both the Government Plan 2023-2026 (GP) and the Common Strategic Policy (CSP) were due to be published on 4th October 2022. It was expected that there would be various programmes and areas for the Panel to review within the GP.

The Officer reported that the Scrutiny Liaison Committee (SLC) was due to meet during the afternoon of the 3rd of October and would consider the general approach that individual panels should take to both the GP and CSP, to ensure an overhead level of coordination.

It was also highlighted that, whilst the GP and CSP were to be published on 4th October, it was expected that some of the underlying business plans and the appendix would not be available for the Panel to review until approximately 17th October 2022. The Officer highlighted that this could truncate the review time available, and the Panel would need to be mindful of this.

The Officer confirmed that further details would be circulated to the Panel at the earliest opportunity, including a draft terms of reference and scoping document for the Panel to consider, in due course.

The Panel recalled that it wished to assess whether the 2022 Jersey Youth Manifesto (Manifesto) created by children, young people and the Office of the Children's Commissioner, had been considered by Government in the development of the Common Strategic Policy (CSP).

The Panel noted a briefing paper provided by the Officer with regard to the Panel's Review of Government Plan 2023-2026 which included:

The Officer informed the Panel that areas of questioning and correspondence could be drafted to various stakeholders in regard to Government Plan projects within the Panels remit.

The  Panel  asked  about  the  Education  Reform  -  Inclusion  Review  item  in  the Government Plan. It was advised that the Panel was due to receive a briefing on the Education Reform - Inclusion Review in November 2022.

The Panel wished to know about Government Plan funds labelled as Reserves'. It was advised that Reserves' were Government business cases that had not yet received approval.

The Panel noted the draft Terms of Reference and Scoping documentation for the Government Plan review and approved that the Chair be designated to provide approval for the final drafts, following insertion of the Digital and Public Engagement budget.

6. Scrutiny Member Training: Preparation for Public Hearings

The Officer delivered a presentation to the Panel with regard to the conduct of Scrutiny Panel's in relation to Quarterly Public Hearings. The presentation included an overview of the background and context in which Quarterly Public Hearings took place, the role of question plans, the format of Quarterly Public Hearings, the role of the Panel Chair and proposed timescales for the Panels 2022 Quarterly Hearings.

The Panel was given the opportunity to ask questions about process and operational procedure ahead of its first public hearing, scheduled for 20th October 2022.

 

7. Quarterly Public Hearing with the Minister for Children and Education

The Panel noted that it was due to receive the Minister for Children and Education for a Quarterly Public Hearing on 20th October 2022 at 10am and noted and discussed the draft question plan.

The Officer informed the Panel that a list of the attendees to the Quarterly Public Hearing would be provided to the Panel in advance of the Hearing, and that name plates would be provided for each attendee.

The Panel visited HM La Moye Prison (Prison) to discuss the services provided by the Prison, the physical environment available to Prisoners and their families, a tour of the key facilities at the Prison and the opportunity to informally discuss the key Prison services and challenges with Prison staff.

The Panel discussed key Prison services and challenges with Suzie Richardson, Prison Governor and Artur Soliwoda, Deputy Prison Governor and Prison Officers for HM La Moye Prison, Justice and Home Affairs. It was advised that whilst overall the Prison catered well for the needs of Prisoners, key challenges included recruitment and retention of Prison Officers.

The Panel then received a tour of the Prison by the Deputy Prison Governor. The Panel were shown horticultural grounds, a carpentry workshop, a gym and sports hall, a residential wing, the Prison control room and the visitor area.

The Panel was introduced to a number of Prison staff present during the tour which provided an opportunity to informally discuss the delivery of Prison services.

The Panel thanked the Deputy Prison Governor for his time, and they concluded the site visit of the Prison.

3. P.97/2022: Government Plan 2023-2026 (GP)

The Panel noted the briefing paper prepared by the Panels Officers in respect of the review of the Proposed GP (GP review).

The Panel discussed the draft Terms of Reference and the draft Scoping Document, which focused on the Panel's remit and specific areas of interest in the GP.

The draft Terms of Reference for the GP review had been drafted in collaboration with other scrutiny panels. They were:

1. To review components of the Government Plan 2023-2026 Proposition which are relevant to the Children, Education and Home Affairs Scrutiny Panel to determine the following:

  1. The impact of the Government Plan proposals on departmental budgets, savings and staffing levels.
  2. Whether  the  proposed  additional  revenue  programmes  and  capital projects are appropriate and likely to have a positive impact on Islanders and Island life.
  3. How additional revenue programmes and capital projects align with the Common Strategic Policy and the aims and objectives of the Ministerial Plans.
  4. If the resources allocated to projects are sufficient, ensure value for money and are best use of public funds.

The Panel considered options for the output of its GP review. It was considered too early to determine whether the Panel would present a scrutiny report or a comments

 

 

paper and this could be agreed at a later date. The Panel also noted that it could make amendments to the GP, if any suitable areas were identified.

After due consideration and discussion, the Panel noted and approved the draft Terms of Reference and Scoping Document for the GP review.
