1. Legal Aid Guidelines Briefing

The Panel welcomed the Judicial Greffier and the Chief Executive of the Law Society as representatives of the Legal Aid Guidelines Advisory Committee, who briefed it on R.191/2021 Publication of the Legal Aid Guidelines. This meeting was held in private in accordance with the Freedom of Information (Jersey) Law 2011 (as amended) under Qualified Exemption Article 35.

 

2. Forward actions

The Panel discussed points raised within the briefing and its scrutiny work more widely.  The  Panel  agreed  that  forming  a  comments  paper  on  R.191/2021 Publication of Legal Aid Guidelines was not necessary, noting the previous work of the Panel and the timeframe. The Panel agreed that it should issue a press release highlighting:

The need for the Legal Aid Guidelines to be clearly communicated to the public, including ability to access the Legal Aid Scheme

That it was anticipated that the guidelines would not be debated

The Panel noted that as Article 11 of the Access to Justice (Jersey) Law 2019 had not yet been brought into effect and that draft Regulations under Article 6 of the Costs in Criminal Cases (Jersey) Law 1961 were not lodged, its work would
