The following records of meetings have been approved by the Panel.

In early 2023 the constitution of the Panel changed. On 28th February, Deputy Geoff Southern stood down from his position as Chair. In his absence the Vice-Chair, Deputy Philip Bailhache , stepped in as interim Chair. On 21st March, the Panel folded and a new Chair, Deputy Robert Ward , was appointed.

2. Letter from Minister for Health and Social Security – Follow-up to Quarterly Hearing

The Panel noted the letter from the Minister for Health and Social Services that was received on 19th December 2022 and agreed to consider the response before deciding on any further action.

The Panel requested that the letter be published on the States Assembly website.

3. Jersey Care Model Funding

The Panel noted that an update had not yet been received regarding potential consequences resulting from the Panel's amendment to the funding of the Jersey Care Model. The Officer was requested to follow this up with a letter to the Minister for Health and Social Services.

4. Jersey Care Model Oversight Board

The Panel considered the role of the Jersey Care Model Oversight Board (the Board'), following the dissolution of the Jersey Care Model and requested Officers to invite the Chair of the Board to meet with the Panel to provide an update on its current workstreams  following  the  recent  report  by  the  Minister  for  Health  and  Social Services (R.166/2022).

The Panel agreed to request the Board's minutes from all meetings that had been held since being established.

5. Health and Care Board

The Panel requested an update on the appointment process of the Health and Care Board following the appointment of the Chair. The Panel requested clarity from the Minister for Health and Social Services regarding: the appointment process; the Officers facilitating the process; and to receive a copy of the Terms of Reference being used to facilitate the Board's workstream and its estimated costs.

6. Interim Report

 

 

The Panel requested its Officers seek information regarding the interim report due to be  produced  regarding  changes  within  the  Health  and  Community  Services Department.

7. Medical Benefit

The Panel considered the subject of medical benefits which were paid from the Health Insurance Fund to GP surgeries to help subsidise the price of appointments for members of the public. The Panel agreed to invite the Minister for Social Security and her Officers to a meeting to discuss medical benefits and any alternative investment' that GP surgeries had recently received from the States of Jersey. The Panel also agreed to invite the Primary Care Board to a separate meeting to discuss the same matters. The Officer was requested to make the necessary arrangements.

9. Private Briefing on waiting lists

The Panel noted that it was due to receive the Minister for Health and Social Services for a private briefing on waiting lists at 10:00am on 2nd February 2023. Due to work commitments, the Panel requested that the briefing be moved to 10:30am and the Officer was asked to liaise with the Health and Community Services Department. The Panel agreed to discuss potential questions ahead of the briefing over email.

10. Quarterly Hearings

The Panel noted its scheduled Quarterly Hearings with the Ministers for Health and Social Services and Social Security on 16th of February and 16th March 2023 respectively.

 

11. Westminster Visit

The Panel considered potential dates for its visit to Westminster and requested it be scheduled for the 7th – 8th March 2023. The Panel also requested for arrangements to be made to visit the London Assembly, if possible.

The  Panel  received  a  private  briefing  from  the  Minister  for  Health  and  Social Services, the Director General for Health and Community Services, Carolyn Landon, Management Executive Support, Andrew Carter, and Director of Clinical Services (Interim), Claire Thompson, regarding waiting lists.

The Panel received information packs regarding waiting lists and requested all data and informative material be received ahead of all future briefings.

1.  Quarterly Hearing with the Minister for Social Security

The Panel considered a draft question plan for its Quarterly Hearing with the Minister for Social Security that was due to take place on 16th March 2023. The Panel made a number of minor amendments, and the Officer was asked to make the changes and to re-circulate the question plan to the Panel.

The Vice-Chair allocated the questions to members of the Panel to allow further preparation ahead of the Public Hearing.

2. Quarterly Hearing with the Minister for Social Security

The Panel received the Minister for Social Security, the Assistant Minister for Social Security and Departmental Officers for a Quarterly Hearing. The proceedings were streamed live to the public and a recording was taken so that a written transcript could be produced.

 

3. Jersey Care Model Independent Oversight Board (IOB)

The Panel received the Chair of the IOB, Mike Greenwood, for a meeting to discuss the role of the IOB in overseeing the delivery of the Jersey Care Model Programme in general and the Board's latest report – Assessment of the Review of the Jersey Care Model – that was published on 16th February 2023. This meeting was held in private in accordance with the Freedom of Information (Jersey) Law 2011 (as amended) under Absolute Exemption Article 26 and a private record was taken.

The Officer was requested to draft a letter to the Minister for Health and Social Services requesting clarity as to the future use and purpose of the IOB and to circulate to the Panel for approval.

4. New Health and Care Board

The Panel considered the information it had been provided at its briefing with the Minister for Health and Social Services and her Officers on 14th March 2023. The Panel agreed that consideration would be given to whether it wished to provide formal feedback to the Minister on the draft Terms of Reference of the new Board and would liaise via email regarding this matter.

 

5. Briefing on the Jersey Care Model'

 

 

The Panel noted that it was due to receive a briefing from the Minister for Health and Social Services and her Officers on the Jersey Care Model at 10am on 30th March 2023.

2.  Appointment of Vice Chair

The Panel decided to defer the appointment of a Vice Chair until its meeting on 13th April.

 

3.  Future Meetings, Briefings and Quarterly Hearings

The Panel noted and approved the meeting schedule for the remainder of 2023 but agreed to consider the August dates closer to the time. The Chair advised that he would be unable to attend the meeting on 27th April and the Panel agreed to consider whether to go ahead with that meeting when it met on 13th April.

The Panel noted and agreed the Quarterly Hearing dates for the remainder of 2023. The Panel agreed to limit the number of departmental officers that sat at the table during a Quarterly Hearing and would request that the Minister invites them to the table to speak if, and when, necessary.

The Panel considered and agreed to receive a briefing from the Minister for Social Security on the Incapacity Review and Long-Term Care Review and requested Officers to make the necessary arrangements.

The Panel noted the pre-arranged briefing on Sustainable Health Care Funding on 27th April and requested Officers to re-arrange it for a date in May.

4.  Briefing on the Jersey Care Model'

 

 

The Panel received the Minister for Health and Social Services, Deputy Karen Wilson , and her Officers for a private briefing regarding the Jersey Care Model'. The Panel asked a number of questions relating to any updated work streams.

5. Public Quarterly Hearing with the Minister for Health and Social Services

The Panel considered its draft question plan for the Public Quarterly Hearing with the Minister for Health and Social Services on 13th April. The Panel made some minor adjustments and additions.

The Panel requested the updated draft question plan be circulated once finalised and agreed to allocate the question topics at its next meeting.

6. Work Programme

The Panel noted and considered a briefing paper on the Minister for Health and Social Services and the Minister for Social Security's priorities. The Panel considered a number of potential review topics and requested Officers to organise necessary briefings as a starting point.

The Panel agreed to attend site visits of the new Mental Health facilities and asked Officers to make the necessary arrangements.

The Panel requested a timeline of the Ministers' delivery plans for 2023 be formulated in order to assist the Panel in agreeing its own work programme for the remainder of the year.

The Panel noted and approved the records of meetings held on 14th and 16th March, 6th and 14th April and 4th May 2023.

 

2. Overpayment of Social Security Benefits

The Panel noted and discussed potential next steps following the private briefing on Benefit Overpayments received on 4th May 2023. The Panel expressed concerns regarding the impact that the initiative may have on individuals, especially those who had difficulty comprehending their financial situation.

The Panel stressed the importance of creating a system that accommodated all stakeholders. The Panel discussed public feedback that expressed how individuals found payment expectations to be overwhelming and that charitable assistance was being sought as some individuals did not feel capable of meeting payment demands.

The Panel believed that a review may help to provide clarity and guidance in relation to the most impactful concerns raised. The Officer advised that any review must be designed in relation to specific outcomes that the Panel hoped to achieve.

The Panel discussed a number of potential approaches for the review. It was noted that the overpayment of Income Support benefits had had a significant negative impact on individuals, and it was therefore important to identify the issues with the current system, with the objective of identifying solutions.

The Officer was requested to draft a Scoping Document and Terms of Reference and circulate them prior to the Panel's next meeting.

3. Draft Social Security (Amendment of Law No.18) (Jersey) Regulations 202-

 

 

The Panel noted and discussed potential next steps following the private briefing on Incapacity Regulations received on 4th May 2023. The Panel was satisfied with the briefing  and  expressed  its  desire  to  draft  a  Comments  paper  and  share  the information received within the public domain.

The Panel discussed some of the key points raised and asked the Officer to draft a letter to seek clarity on the effect that Regulation 2 would have, if adopted. It was agreed that the information received could be used within the Panel's Comments paper.

The Panel shared further considerations around regular retrospective evaluations, the historic demand for developed regulations and the importance of encouraging and facilitating those who wished to return to work.

The Panel received the Minister for Health & Social Services, Deputy Karen Wilson , the Assistant Minister for Health & Social Services, Deputy Malcolm Ferey , and Departmental Officers for a briefing on Healthcare Funding Reform. This meeting was held in private in accordance with the Freedom of Information (Jersey) Law 2011 (as amended) under Absolute Exemption Article 26 and a private record was taken.

The Panel noted that the next Quarterly Hearing with the Minister for Social Security was due to take place on 1st June 2023. The Panel identified areas of questioning and asked the Officer to begin drafting the question plan for its consideration.

6. Medicinal Cannabis

The Panel noted the letter received from the Chair of the Economic and International Affairs (EIA) Panel on 2nd May 2023 in relation to Medicinal Cannabis. The Panel expressed discomfort around this topic due to the depth of debate and concerns over regulation. The Panel agreed to ask questions on this matter at its next Quarterly Hearing with the Health and Social Services Minister on 8th June 2023. The Officer was requested to draft a letter to the Chair of EIA advising her of the Panel's decision and inviting the EIA Panel to identify areas of questioning for its consideration.

2. Review of Overpayment of Social Security Benefits

The  Panel  discussed  the  Scoping  Document  and  Terms  of  Reference  for  its Overpayment of Social Security Benefits Review. The Panel made comments on the stakeholder list. It noted the communications strategy for the Review and requested that the Digital and Public Engagement Officer be invited to the Panel's next meeting to discuss it.

The Panel requested the Officer to amend the Scoping Document following the changes discussed and approved both documents.

The  Panel  received  an  update  from  the  Communication  Officers  on  the  draft communication plan for its review of Income Support Benefit Overpayments. It requested that the plan be finalised for its approval.

The Panel agreed that the review should be launched during the week commencing 5th June 2023 and that this should be accompanied by a video, news release and social media posts.

The Panel discussed the draft Population Health Strategy and Action Plan. The Panel requested that a letter be drafted to the Minister for Health and Social Services requesting further information about the department's plan for bringing forward a policy.

5.  Work Programme

The Panel noted the Minister for Social Security's updated work programme/delivery plan following its request and considered the projects and legislation that had been deferred or delayed since the Minister's last update.

The Panel noted that it was yet to receive a similar update from the Minister for Health and Social Services. The Officer was requested to follow-up on the Panel's request.

The Officer informed the Panel that the draft report was currently out for factual checking by the Minister for Social Security, key stakeholders and members of the public who had provided evidence to the Panel. It was advised that the deadline for all comments was Friday 29th September. The Panel noted that it was aiming to publish its report during the week beginning 9th October.

 

3.  Government Plan 2024-27

The Panel discussed the next steps for the Government Plan 2024-27 review. The Officer explained the wider Scrutiny process and how the Panel's review would fit within this structure. The Panel considered the previous Health and Social Security Panel's strategy and effectiveness as a potential option for its own review. The Panel discussed potential areas to include in the review and agreed to reconvene on this matter at its next meeting. The Officer advised the Panel that the Terms of Reference would be drafted imminently, and the aim was to launch the review the week beginning 25th September.

The Panel further noted the Public Hearing dates for the Panel's review which were:

The Panel discussed potential key stakeholders to contact regarding its review and the new revenue expenditure growth that fell under its remit. The Officer was requested to draft letters for the Panel's consideration.

The Panel noted and considered a submission received by a member of the public in relation to parental benefits for parents of twins. The Officer informed the Panel of the number of twins born in 2022 and discussed the current processes in relation to parental benefits. The Panel considered whether it would bring an amendment to the Government Plan and agreed that, due to amendments already lodged or due to be lodged by individual members on areas where it had its own concerns, it would not be lodging its own this year. The Panel further agreed that it would be presenting Comments on the proposition the week beginning 4th December 2023 for consideration by the States Assembly.

 

3.  Review of Income Support Overpayments

The Panel noted that the Ministerial Response to its report was due on  20th November 2023 and further noted the evaluation process for the review. The Officer presented the evaluation document and the Panel considered its next steps to
