AGRICULTURAL LAND (CONTROL OF SALES AND LEASES) (EXEMPTED TRANSACTIONS) (JERSEY) REGULATIONS 1974

THE STATES, in pursuance of Article 2 of the Agricultural Land (Control of Sales and Leases) (Jersey) Law 1974,2 have made the following Regulations –

Article 2 of the Agricultural Land (Control of Sales and Leases) (Jersey) Law 1974[3] (hereafter called the "Law") shall not apply to the renewal of any lease (whether parol or in writing), not being a registered contract of lease, where the lease was entered into before 2nd October 1974 or with the consent of the Minister and where the lessee is a bona fide inhabitant of Jersey engaged wholly or mainly in work of an agricultural or horticultural nature in Jersey and uses the land leased for agricultural or horticultural purposes, and accordingly any such transaction as aforesaid shall be deemed to be a transaction exempted from Article 2 under paragraph (5)(d) thereof:

Provided that, except in the case of the renewal of a parol lease for a period not exceeding 12 months, this Regulation shall only apply if, not later than 14 days after the renewal, both parties advise the Minister in writing of their names, the address or other identification of the land concerned and its surface area, and the duration of the lease.

Article 2 of the Law shall not apply to any transaction being the sale, transfer or lease of an established garden measuring not more than one vergée situated within the _artilage of a dwelling house.4
