Matthew Green
Good afternoon,
I understand you're calling for public evidence with relation to the above draft law.
I've done my best to read through the draft but I can't seem to see anywhere that would clarify my status of being in a same-sex marriage from a jurisdiction outside of Jersey (in my case, Canada).
My partner and I were married in Canada in 2009, before Civil Partnerships were recognised in Jersey. Under the Civil Partnership law as it was subsequently introduced, our marriage was legally recognised as a Civil Partnership in Jersey and the tax office has treated us as Civil Partners from the date at which that law came into effect.
Naturally, upon the enactment of equal marriage in Jersey we would like our marriage to be immediately recognised as such and I suspect there are other couples who are legally married in other jurisdictions and presently recognised as in a Civil Partnership who would want this position clarified.
Regards Matthew
