Dear Sirs
I refer to the above investigation and write in support of the Managing Director of Romerils in connection with the description of retail.
I suggest that you consider using the description of retail as in the Use Classes Order 1987 as amended and this is summarised below:-
"Class A1 (Shops): Use for all or any of the following purposes:
- for the retail sale of goods other than hot food,
- as a post office,
- for the sale of tickets or as a travel agency,
- for the sale of sandwiches or other cold food for consumption off the premises,
- for hairdressing,
- for the direction of funerals,
- for the display of goods for sale,
- for the hiring out of domestic or personal goods or articles,
- for the washing or cleaning of clothes or fabrics on the premises, [1991/1567]
- for the reception of goods to be washed, cleaned or repaired, [1991/1567]
- as an internet café;
where the primary purpose of the premises is to provide facilities for enabling members of the public to access the internet [2005/84] where the sale, display or service is to visiting members of the public."
Retail warehouses such as B & Q are included as retail Class A1 but Builders Merchants are sometimes included in A1 and at other times described as Sui Generis, that is that they do not fall into any of the described use classes. As they sell to both builders and members of the public, it would make sense for Builders Merchants to be included in the Jersey version of the Retail Use Class description.
