To consider the advantages and disadvantages of the current pre-application process.
Terms of reference
1. To consider the advantages and disadvantages of the current pre-application process, with particular regard to – a) the rôle performed by officers, b) the value of the process to potential applicants, and c) the degree of neighbour / public involvement. 2. To assess the effectiveness of the existing planning application process and to consider the implications arising from the forthcoming introduction of the new Planning and Building (Jersey) Law 2002. 3. To consider the degree to which decisions taken by the Minister, Applications Panel, former Committee or Sub-Committee have been influenced by – a) interpretation of Island Plan policies, b) precedent, and / or c) the prospect of litigation on the part of applicants. 4. To review the extent to which officers within the Planning and Building Services Department exercise delegated powers. 5. To assess the extent of, and the implications arising from, limitations on the ability of the States to direct the Planning Minister.
