REPORT
On 2nd August 2022, the Minister for the Environment made a Ministerial Decision delegating certain of his functions under Articles 28, 30 and 30A of the States of Jersey Law 2005 (see Decision reference MD-ENV-2022-498, available at www.gov.je).

Functions delegated: | i. The determination of appeals made under Part 7 of the Planning and Building (Jersey) Law 2002 and the determination of the outcome of complaints under Article 6 of the High Hedges (Jersey) Law 2008 when he is unavailable or when it could be perceived he is conflicted; ii. All powers and functions conferred upon or vested in the Minister in relation to matters arising from responding to the climate emergency; this would include strategic planning and operational delivery and, in relation to this specific area of responsibility only, the Assistant Minister would also be able to answer questions (Standing Order 9 (3); make statements (Standing Order 17 (1) (a), lodge Propositions (Standing Order 19 (c); and present Reports or Comments (Standing Order 68A (3). She would also be able to sign Ministerial Decisions relating to the business areas under these responsibilities. As the Minister ultimately retains political oversight and accountability for all matters for which he is responsible, he would expect to be fully briefed on developments in these areas; and iii. To deputise for the Minister in his absence and, particularly in the event of the Minister being off-Island or being indisposed, to carry out, as necessary, any of the functions conferred upon or vested in the Minister. |
