REPORT

On 26th September 2022, the Minister for the Environment made a Ministerial Decision delegating certain of his functions under Articles 28, 30 and 30A of the States of Jersey Law 2005 (see Decision reference MD-2022-ENV-599, available at www.gov.je).

The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –

The Minister for the Environment, after receiving the consent of the Chief Minister, has appointed Deputy Hilary Jeune as an Assistant Minister for the Environment.

Article 25 (1) of the States of Jersey Law 2005 allows a Minister to appoint an elected member as his Assistant Minister. Under article 25(2), a Minister may only appoint an Assistant Minister with the prior consent of the Chief Minister.

The Minister has delegated the following functions to Deputy Jeune as Assistant Minister for the Environment:

Functions delegated:

  1. The determination of appeals made under Part 7 of the Planning and Building (Jersey) Law 2002 and the determination of the outcome of complaints under Article 6 of the High Hedges (Jersey) Law 2008 when he is unavailable or when it could be perceived he is conflicted;
  1. All powers and functions conferred upon or vested in the Minister in  relation  to  matters  arising  from  responding  to  the  climate emergency and matters relating to energy policy; this would include strategic planning and operational delivery and, in relation to these specific areas of responsibility only, the Assistant Minister would also be able to answer questions (Standing Order 9 (3); make statements (Standing Order 17 (1) (a), lodge Propositions (Standing Order 19 (c); and present Reports or Comments (Standing Order 68A (3). She would also be able to sign Ministerial Decisions relating to the business areas under these responsibilities. As the Minister ultimately retains political oversight and accountability for all matters for which he is responsible, he would expect to be fully briefed on developments in these areas; and
  1. To deputise for the Minister in his absence and, particularly in the event of the Minister being off-Island or being indisposed, to carry out, as necessary, any of the functions conferred upon or vested in the Minister.
