REPORT

Decision(s): Under Article 18(4) of the Public Finances (Jersey) Law 2019 (the Law), the Minister for Treasury and Resources hereby notifies the States, and having consulted with any relevant Minister under Article 18(5) of the Law; that he has agreed to the following –

After the expiry of 4 weeks following the presentation to the States of these transfers, the Minister hereby authorises the Treasurer of the States to action the transfers outlined in the table above.

Background

As part of the Children's Legislation Transformation Programme (CLTP), funding was approved in the Government Plan 2020 to 2023, to enable statutory registration and inspection requirements to be introduced for services to children and their families. Draft regulations were presented to the Council of Ministers on 15 February, which are a continuation of the existing phased approach to extending the remit of the Jersey Care Commission (JCC) and fulfil a Ministerial policy commitment.

The funding was allocated to CYPES, representing the fees that will be paid  by Government services to the JCC to cover the costs incurred in independent regulation and inspection.

It has since been agreed that the funding should transfer to the JCC, through SPPP as the sponsoring department, which will then eliminate the need to charge for the work. This will also allow the JCC to start recruitment of additional inspectors and to prepare for when the regulations come into force
