REPORT
On 19 October 2022, the Minister for Health and Social Services made a Ministerial Decision delegating certain of her functions under Articles 28, 30 and 30A of the States of Jersey Law 2005 (see Decision reference MD-HSS-2022-655, available at www.gov.je).
The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –

Scope of delegation: | The Minister appointed Deputy Ferey of St Saviour to the role of Assistant Minister for Health and Social Services and delegated responsibility for: · Rehabilitation · Adult services and social care policy; and · Stakeholder engagement with charitable organisations for those areas within his responsibility and the wider Health and Social Services portfolio. |
MD-HSS-2022-494 and the associated report (R.116/2022) states that as Assistant Minister for Health and Social Services, Deputy Rose Binet 's scope of delegation is: "in the event that the Minister is unavailable or out of the Island, the Minister delegated all powers and functions conferred upon or vested in the Minister, including the power to make an enactment, and all other areas where the Minister would otherwise have to act and be advised."
In light of the Minister appointing Deputy Malcolm Ferey to the role of Assistant Minister for Health and Social Services, the order of delegations will now be that: In the event that that the Minister is unavailable or out of the Island, the Minister delegates all powers and functions conferred upon or vested in the Minister, including the power to make an enactment, and all other areas where the Minister would otherwise have to act and be advised to Deputy Rose Binet of Grouville (existing arrangements).
Then, in the event that Deputy Rose Binet of Grouville is unavailable or out of the Island, all powers and functions will be delegated to Deputy Malcolm Ferey of St Saviour (new arrangements).
