REPORT
On 4th January 2024, the Chief Minister made a Ministerial Decision delegating certain of her functions under Articles 28, 30 and 30A of the States of Jersey Law 2005 (see Decision reference MD-CM-2024-5, available at www.gov.je).
Context
On 2nd January 2024, the Minister for Infrastructure tendered his resignation to the Chief Minister in accordance with Article 22(3) of the States of Jersey Law 2005 ("the 2005 Law").
As a consequence, the Assistant Ministers to the Infrastructure Minister ( Deputy Steve Ahier of St. Helier North and Deputy Lucy Stephenson of St. Mary , St. Ouen and St. Peter ) also ceased to hold that office in accordance with Article 25(5) of the 2005 Law.
Interim arrangements for the Infrastructure portfolio and appointment of Assistant Ministers
Article 27(2) of the 2005 Law states –
(2) The Chief Minister may, during the temporary absence or incapacity of a Minister or a vacancy in the office of Minister –
- personally discharge the functions of that Minister; or
- designate another Minister to discharge the functions of that Minister.
The Chief Minister intends to nominate an elected Member for this ministerial office in accordance with Article 23(1) of the 2005 Law. The earliest date on which this nomination can be made is the States sitting commencing on Tuesday 16th January 2024. In the interim period, the Chief Minister will personally discharge the functions of the Infrastructure Minister in accordance with the provision noted above. The Chief Minister wishes to appoint Deputy Ahier and Deputy Stephenson as Assistant Ministers to assist with the discharge of these functions.
Accordingly, Deputy Steve Ahier and Deputy Lucy Stephenson are appointed as Assistant Ministers for Infrastructure in accordance with Article 25(1)(a) of the 2005 Law.
The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –
