Decision(s): Under Article 18(4) of the Public Finances (Jersey) Law 2019 (the Law), the Minister for Treasury and Resources hereby notifies the States, and having consulted with any relevant Minister under Article 18(5) of the Law; that she has agreed to the following –

After the expiry of 4 weeks following the presentation to the States of these transfers, the Minister hereby authorises the Treasurer of the States to action the transfers outlined in the table above.

Background

In January 2019, the Ambulance and Fire & Rescue Control function moved to Police Headquarters  to  create  what  was  then  called  the  Combined  Control  Room'. Subsequently renamed the ESCC and following a strategic intention to create a fully combined  control  function,  with  staff  and  systems  working  together  in  an omnicompetent' way to support the delivery of an effective and efficient control function for all three emergency services, the Police Control staff moved from SoJP line management to JHA line management, creating one unified staff team in 2023. Cross training began later that year, with the intention of all staff being fully trained by the middle of 2024.

Following the major incidents at the end of 2022 and in 2023 however, the Programme Board has carefully considered options for continuation of the strategic objective to create a fully combined control room, and in consultation with the Heads of the Emergency Services reached the conclusion that reverting to the pre-2023 arrangements would deliver more effective control functions, allowing controllers to focus on one or two specialisms. The ESCC would remain co-located at Police Headquarters with a recognition that moving away from cross training will allow the time to train more deeply and broadly in each specialism and therefore improve the delivery of control functions for each of the services in a different and more effective way than was originally envisaged.

The  requested transfer is to remove  the  Police  Control resources from  JHA  line management and revert to an SoJP command structure. The Head of Finance Business

Partnering, Minister for Justice and Home Affairs and Chief Officers of both JHA and SoJP have all agreed to this budget transfer.

Recommendation

The Minister is recommended to approve the recurring budget transfer from JHA to SoJP  with  effect  from  1st  June  2024  to  ensure  improved  service  delivery  and coordination of ESCC resources.

Reasons for Decision

Article 18(1)(a) of the Public Finances (Jersey) Law 2019 states that a specified amount appropriated for one head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure that is set out in the government plan.

Article 18(4) of the Public Finances (Jersey) Law 2019 states that the Minister shall give the States Assembly at least 4 weeks' notice before an amount is transferred under paragraph (1)(a).

Article 18(5) of the Public Finances (Jersey) Law 2019 states that if a direction under this Article would affect a head of expenditure that relates to the responsibilities of any Minister, that Minister must be consulted before the direction is made. The Minister for Justice and Home Affairs has been consulted.

To comply with P.67/1999 which charges the Minister for Treasury and Resources to regulate the number of persons that may be employed by the States.

Resource Implications

The JHA head of expenditure will decrease while the SoJP head of expenditure will increase by 10 FTE and the following amounts for the specified years:

This decision does not change the total amount of expenditure approved by the States in the Government Plan for 2024-27. Transfers from 2025 onwards will be reflected in the Government Plan 2025-2028.
