STATES OF JERSEY LAW 2005: DELEGATION OF FUNCTIONS – MINISTER FOR SOCIAL SECURITY - REVISED DELEGATIONS FEBRUARY 2021

REPORT

On 16th February 2021 the Minister for Social Security made a Ministerial Decision delegating certain of her functions under Articles 28, 30 and 30A of the States of Jersey Law 2005 (see Decision reference MD-S-2021-0016, available at www.gov.je).

Article 28 of the States of Jersey Law 2005 permits a Minister to delegate, wholly or partly, functions to an Assistant Minister or an officer.

The Law states, inter alia

"28  Power of Minister to delegate functions

  1. A Minister may delegate, wholly or partly, functions conferred upon or vested in the Minister by or under this Law or any other enactment or any enactment of the United Kingdom having effect in Jersey, to –
  1. one of his or her Assistant Ministers;
  2. an officer.

(1A)  A Minister shall not delegate to an Assistant Minister any function the

delegation of which is wholly prohibited by an enactment.

(1B)  Where a Minister delegates to an Assistant Minister a power to make an enactment, paragraphs (4) and (5) of Article 26 shall apply to the making

of an enactment by the Assistant Minister, in exercise of the delegated power, as they would apply to the making of the enactment by the Minister.

  1. A Minister shall not delegate to an officer –
  1. any power to make an enactment;
  2. any power to decide an appeal under an enactment;
  3. any function the delegation of which is prohibited wholly, or to an officer, by an enactment.
  1. The delegation of functions by a Minister under this Article shall not prevent the Minister exercising those functions personally.
  2. Where any licence, permit or authorization is granted in purported exercise of functions delegated under paragraph (1), no criminal proceedings shall lie against any person for any act done, or omitted to be done, in good faith and in accordance with the terms of the licence, permit or authorization, by reason that the functions had not been delegated, or that any requirement attached to the delegation of the functions had not been complied with.
  3. In this Article –

"Minister" includes the Chief Minister;

"officer" means a States' employee within the meaning of the Employment of States of Jersey Employees (Jersey) Law 2005 and includes a member of  the  States  of  Jersey  Police  Force  and  an  officer  appointed  under paragraph 1(1) of Part 1 of Schedule 2 to the Immigration Act 1971 as extended to Jersey by the Immigration (Jersey) Order 1993.

  1. The  States  may  by  Regulations  amend  the  definition  "officer"  in paragraph (5)."

"30  Ministerial delegations to be presented to States

  1. A Minister who delegates functions under Article 28 shall present to the States a report specifying the functions delegated and to whom.
  2. A Minister shall not be required to present a report under paragraph (1) where the delegation is so immediate and of such brief duration that it is not practicable to present the report before the delegation ends.

30A  List of delegations to be published

  1. The Chief Minister shall cause to be established, maintained and published a consolidated list of –
  1. the functions for the time being discharged by the Chief Minister and by each Minister;
  2. the functions for the time being delegated by the Chief Minister and each Minister under Article 28, and to whom.
  1. The list shall also specify which Minister is discharging, for the time being, the functions of another Minister under Article 27(1) or (2).
  2. The information described in paragraph (1)(b) or (2) is not required to be incorporated in the list where the period for which the delegation has effect or for which one Minister's functions are being discharged by another is so immediate and of such brief duration that it is not practicable to amend and publish the list to incorporate the information before the end of the period.
  3. It shall be sufficient if the list is published on a website."

2 Article 49 of the Social Security (Jersey) Law 1974 has been interpreted to cover the administration of all Laws for which the Social Security Minister is responsible. This excludes Control of Housing and Work (Jersey) Law 2012 and the Register of Names and Addresses (Jersey) Law 2012, although these are administered by Customer & Local Services.

 

 

2 Social security numbers and contribution liability notices

  1. A person on becoming an insured person must apply to the Minister for –
  1. a social security registration number; and
  2. a contribution liability notice.
  1. The contribution liability notice shall take the form of a code comprising –
  1. the letters "FR1" in the case of a person who is liable for contributions; and
  2. the letters "XR1" in the case of a person who is not liable for contributions.
  1. The application must be made –
  1. not later than the end of the month in which the person becomes an insured person; and
  2. in the manner directed by the Minister.
  1. An insured person who has a contribution liability notice in the form "XR1" and who becomes liable for contributions must, within 7 days of becoming so liable, apply to the Minister for a contribution liability notice in the form "FR1".
  2. An insured person who has a contribution liability notice in the form "FR1" and is no longer liable for contributions must, as soon as reasonably practicable, apply to the Minister for a contribution liability notice in the form "XR1"

As per article 3, through information provided by an insured person:

3 Periods of absence

If  an  insured  person  whose  liability  to  pay contributions ceased during a period of absence from Jersey  returns  to  Jersey  and  becomes  ordinarily resident in Jersey, the person must, within 7 days of becoming ordinarily resident, inform the Minister.

14 Application for supplementation

  1. This Article applies where a person claims to be  entitled  to  have  his  or  her  contributions supplemented  out  of  the  Social  Security Fund in accordance with Article 9 of the Law.
  2. An application for supplementation must –
  1. be made in writing in such form as the Minister may approve or direct; and
  2. be  accompanied  by  such  evidence  of  the applicant's income and contributions the applicant has paid or been credited with as the Minister may require.
  1. The Minister shall not approve the application unless it is satisfied that the sum of the contributions that the applicant is required to pay and entitled to be credited  with  entitles  the  applicant  to  have  those contributions  supplemented  in  accordance  with Article 9 of the Law.

(4) Despite paragraph (3), the Minister shall not approve the application if it is satisfied that applicant has intentionally arranged his or her affairs to take advantage of Article 9 of the Law.

ADMINISTRATION OF INCOME SUPPORT

  3. both an assessment to be made in accordance with sub-paragraph (a) and an approval to be given in accordance  with  sub-paragraph (b),

in support of a claim under Article 4 to entitlement of the  person's  household  to  the  special  component referred to in paragraph (3)(b).

To require an assessment or approval of care package in order to entitle a household to claim for the special component referred to in paragraph (3)(b) of the Law

The Determining Officer may require the payment of such interest, if any, as the Determining Officer may specify; or the repayment of the amount in question, plus any interest to be charged, by means of such instalments as the Determining Officer may specify.

Article  15,  administrative  expenses.  To  pay remuneration and expenses to a member of a tribunal mentioned in Article 9(2) of this Law

  1. In the case of a claimant who is unable to act who –

(c) does not have a tuteur,

the officer may, on receipt of a written application, appoint a person to act on the claimant's behalf.

  1. However, such appointment shall terminate –
  1. if the claimant is received into guardianship, or has appointed, in relation to him or her, such a person as mentioned in paragraph (1)(b) or a tuteur;
  2. at the request of the person appointed;
  3. if revoked by the officer; or
  4. if the claimant becomes able to act.
  1. In this Article "claimant" includes any member of a claimant's household  who is required, under Article 7,  to  furnish  information  and  evidence  in support of a claim

In the case of a claim for child personal care, the information  to  be  included  in  the  claim  is  such information as the Determining Officer requires to be satisfied that the requirements and criteria for that payment are met.
