REPORT

On 8th April 2024, the the Minister for Children and Families made a Ministerial Decision delegating certain of his functions under Articles 28, 30 and 30A of the States of  Jersey  Law  2005 (see  Decision  reference  MD-CEF-2024-277  ,  available  at www.gov.je).

The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –

Following  the  renaming  of  the  ministerial  office  of  Minister  for  Children  and Education' to the Minister for Children and Families' and the transfer of functions to the newly established ministerial office for Education and Lifelong Learning', the Minister for Children and Families ("the Minister") sought to update the delegations to one of his Assistant Ministers – Deputy R. Ward of St Helier Central.

This accordingly replaces the delegation made in R.12/2024. This updated delegation does not impact the delegation made to Deputy Malcolm Ferey in R.14/2024.

Functions delegated:

In the event that the Minister and Deputy Malcolm Ferey of St Saviour are both unavailable or out of the Island, the Minister delegated all powers and functions conferred upon or vested in the Minister, including the power to make an enactment, and all other areas where the Minister would otherwise have to act and be advised.

Scope of delegation:

Full delegation, to include all relevant legislation, in the circumstances set out above.

It should be noted that, following the change in ministerial offices as outlined above, the delegation to Deputy Carina Alves of St Helier Central made in R.14/2024 is effectively otiose. Deputy Alves has confirmed her intention to resign as Assistant Minister for Children and Families  in recognition of the fact  that her  previously delegated functions are now held by the Minister for Education and Lifelong Learning, to whom she is already an Assistant Minister.
