1. Data Controller
This privacy notice explains how I use your personal data when you contact me for assistance or representation.
As a States Member, I am the data controller for the personal data I process when representing you, responding to your enquiries, or assisting with casework.

2. What personal data I collect
When you contact me I may collect and process:
  • Your name, address, email, and telephone number
  • Details of your enquiry, correspondence, or casework
  • Supporting documents you provide (e.g., letters, forms, ID)
  • Special category data when necessary to resolve your case, such as:
  • health information
  • ethnicity
  • political opinions
  • trade union membership
  • religious or philosophical beliefs
  • information relating to criminal allegations or convictions
Only information relevant to your enquiry or casework is collected and processed.

3. Why I process your personal data (Art. 9(1) Lawful basis)
As a States Member, I have been elected to represent constituents, undertake casework, make representations, scrutinise government, participate in debates, and perform other functions of a public nature.
I process your information in order to:
  • respond to your correspondence
  • assist with individual casework
  • make enquiries or representations on your behalf
  • raise issues with relevant Government departments, agencies, or service providers
  • carry out my functions as a States Member
This may include contacting third parties, making enquiries on your behalf, and sharing relevant information with organisations involved in your case where necessary.

4. Conditions for Processing
a.            Public Functions – Schedule 2, Part 1, Paragraph 4(a)-(d) (Personal Data) and Part 2, Paragraph 13(a)-(d) (Special Category Data) Data Protection (Jersey) Law 2018
In most cases, I process personal data and special category data because it is necessary for the exercise of a public function or a function of a public nature exercised in the public interest.
This applies to my work representing constituents and fulfilling my official duties as a States Member.
b. Consent to processing – Schedule 2, Part 1, Paragraph 1 (Personal Data) and Part 2, Paragraph 6 (Special Category Data) Data Protection (Jersey) Law 2018
I do not normally rely on consent to undertake constituency casework or represent constituents. However, in some limited circumstances, I may ask for your consent. Where I rely on consent, you may withdraw that consent at any time.
Where an enquiry includes special category data, I will process that information only where a relevant condition under Schedule 2 applies. In some circumstances, I may seek your explicit consent where this is appropriate.
I will only collect special category data where it is relevant to assisting you.

5. Who I share your personal data with
Your information may be shared with:
  • The States Greffe, in particular the Constituency Support Team, who may assist me in managing correspondence and casework. Authorised members of this team may access and process your personal data on my behalf for the purpose of progressing your enquiry
  • Government Departments, local authorities, and public bodies relevant to your case
  • Members of the States of Jersey Complaints Panel if I am investigating a complaint on your behalf
I will not share your data with third parties for unrelated purposes and will only share what is strictly necessary to progress your case. If necessary, I may disclose information to other departments to comply with a legal obligation or where permitted under other legislation.

6. Progressing of Personal Data relating to Children and Vulnerable Adults
If you contact me about a child or vulnerable adult, or on their behalf, I will process only the minimum personal data necessary. Where appropriate, I may request evidence that you have authority to act on their behalf.

7. Your rights under the Data Protection Law
You have the following rights:
  • Right of access to your personal data
  • Right to rectification of inaccurate information
  • Right to erasure (in certain circumstances)
  • Right to restrict processing
  • Right to object to processing

8. Retention: How long your data is kept
Retention periods will be determined based on the nature of the casework, relevant legal requirements, and applicable records management guidance.
You may, however, request deletion where appropriate, in keeping with the rights outlined above.

This notice may be updated periodically to reflect changes in legislation or practices.
