In paragraph (a)(i) after the words "pages 11 and 13 of the Annex" insert the words –
" ex c ept that in Objective 1, for Performance/success criteria (viii) substitute the following
Performance/success criteria –
(v i ii ) R eplacement for the Waterfront Enterprise Board debated by the States.".

REPORT
The reason I have amended this Performance/success criteria is that the States must be involved in any replacement of the Waterfront Enterprise Board as the Board exercises control over a relatively large amount of very valuable real estate belonging to the States.
Presently this property or the financial returns derived from it aren't recognised in the States accounts and furthermore, the Waterfront Enterprise Board does not come under the direct control of the States.
I am aware that we have States representatives on the Board; however, if the Chief Minister's Department are to establish a replacement then it is extremely important that this Assembly is involved in that process.
Members should also be aware that in February this year, the Public Accounts Committee reported on the States Property Plan. In that report the Committee fully supported the creation of Jersey Property Holdings and underlined the fact that all property management responsibilities should be transferred to the States of Jersey Property Holdings without unreasonable delay. The Public Accounts Committee also stated that it would be returning to this subject after the end of 2007.
Members should be aware that during the course of the review the Committee was informed that there were proposals contained in the 2007 for Jersey Property Holdings to become a trading organisation. Furthermore, it became apparent that if Jersey Property Holdings was turned into a trading organisation it would be distinct from the development organisation proposed to be established on the foundation of the Waterfront Enterprise Board.
If this is to be the case then it is only right that States members have the opportunity to fully consider any proposal prior to its establishment, hence the reason for this amendment.
There are no financial or manpower implications arising from this amendment.
