REPORT

The Council of Ministers appreciates that legislation against discrimination has not progressed significantly in recent years because of other high priority matters faced by the Council during its term of office.

The  Council  of  Ministers  wishes  to  confirm,  however,  that  it  now  proposes  to prioritise the  introduction  of  a  Discrimination  Law  and is committed  to bringing forward the legislation for States debate by the end of 2012.

While supporting the introduction of a Discrimination Law, the amendments lodged by the Council of Ministers will ensure that legislation is introduced within a workable timescale, is adequately funded, and is the responsibility of the appropriate Minister.

The Council supports the comments of the Minister for Home Affairs and proposes that responsibility for the introduction of a Discrimination Law should be that of the Minister for Social Security.

The Council also proposes that the timescale in which a Discrimination Law should be introduced is amended to read the "end of 2012" as opposed to March 2012. Ministers believe that a deadline of March 2012 is unrealistic, and that the timeframe proposed by the Council is more achievable and will allow the necessary work to be undertaken.

The final amendment will ensure that the Law is properly funded without committing an exact sum until work has been done to fully assess the likely cost of introducing the legislation.

The Council of Ministers urges States members to accept these amendments. Financial and manpower implications

The Minister for Treasury and Resources has agreed with the Council of Ministers that,  should  this  amendment  be  approved,  funding  for  the  necessary  strategic development and law drafting will be accommodated within existing resources in 2012.

The Council of Ministers has also committed to bring forward proposals for adequate implementation funding as part of the 2013 Annual Business Plan (or equivalent) within the spending limit agreed by the States in the 2011 Budget.
