After the words "the revised draft Island Plan 2011" insert the words –
"except that in Policy TT10 – Off Street public parking provision in St. Helier (page 322), after the first paragraph, insert a new paragraph, as follows –
During the Plan period, the Minister for Planning and Environment will support proposals that increase the proportion of short-stay off-street public parking and which limit or reduce the quantity of long-stay off- street public parking in St. Helier , in accord with the objectives of the Sustainable Transport Policy (2010), and in accord with the overall level of off-street public parking provision permitted.' ".
MINISTER FOR PLANNING AND ENVIRONMENT NOTE:
This amendment has been lodged by the Minister for Planning and Environment for less than 8 weeks before the start of the debate in accordance with the provisions of Article 4A of the Planning and Building (Jersey) Law 2002. Paragraphs 4A(2), (3) and (4) are in the following terms –
4A Procedure for and following lodging of draft Island Plan
"(2) An amendment to a draft Island Plan cannot be debated by the States
unless it has been lodged for a minimum period of 8 weeks.
- An amendment to an amendment to a draft Island Plan cannot be debated by the States unless it has been lodged for a minimum period of 6 weeks.
- Paragraph (2) or (3) does not apply to an amendment lodged by the Minister if the States agree that the amendment may be debated forthwith or on a day or at a time approved by the States."
In accordance with the provisions of paragraph (4) the Minister for Planning and Environment will seek the agreement of the States to debate this amendment during the debate on the Island Plan 2011: approval' (P.48/2011).

REPORT
This amendment relates to Part 19 of the 38th amendment brought by the Connétable of St. Helier .
The Minister is sympathetic to the intent of the Connétable 's proposed amendment, which seeks to increase the level of short-stay off-street public parking – of benefit to visitors to the town, be they shoppers or tourist. As drafted, however, the Minister considers that parts (a), (b) and (c) of the proposed amendment would have damaging consequences for the objectives of both the revised draft Island Plan and the Sustainable Transport Policy (2010) and are undeliverable through the planning system.
On the basis of the above, the Minister for Planning and Environment is required to reject the form of the Connétable 's amendment, but proposes his own further amendment which seeks to support the intent of the original amendment, whilst also seeking to accord with the Sustainable Transport Policy (2010) in a way that is relevant, and not beyond the appropriate remit, of the planning system.
The Minister's amendment seeks to rebalance public parking in St. Helier from long stay (commuter) parking towards increased short stay (shopper/visitor) provision, for which there is widespread support, but within an overall cap on the number of spaces. This approach accords with the aims of the Sustainable Transport Policy (2010) and the strategic aims of the revised draft Island Plan, each of which is founded on the approved States Strategic Plan (2009-14).
The independent planning inspectors offer support for the Minister's proposed amendment.

There are no additional financial or manpower implications arising from this amendment.
