After the words "every proposition", insert the words "or amendment submitted by a Minister or Assistant Minister".

Note:  After this amendment, the proposition would read as follows –

  1. that  in  addition  to  the  existing  requirements  under  Standing Order 21(2), every proposition or amendment submitted by a Minister or  Assistant  Minister  should  also  be  accompanied  by  a  statement estimating the impact of its implementation on the public of Jersey in both time and money, along with an explanation as to how the proposer has calculated his or her estimate;
  2. to request the Privileges and Procedures Committee to bring forward amendments to the Standing Orders of the States of Jersey to give effect to this change.

REPORT

The reasoning given for the main proposition is to help the States Assembly to better balance the desirability of new Propositions, Laws and Regulations against their direct cost to the economy and the people of Jersey.

I have proposed the above amendment as it is the Ministers and their Assistant Ministers who bring forward Projets to change Laws and Regulations. Backbencher propositions will request the appropriate Minister to bring forward changes to Laws and Regulations.

Backbenchers do not have access to the same resources as the Ministers, made available within their ministerial departments, and it would be unfair to expect backbenchers to make an accurate impact assessment without having the same resources made available to them.

In addition, making the appropriate resources available for backbenchers to accurately assess the impact of their propositions would considerably change the financial and manpower statement in the main proposition.

Financial and manpower implications

There are no financial or manpower implications for the States arising from the adoption of this amendment.
