THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, adopted Regulations 1 to 6.
THE STATES, commencing consideration of Regulation 7, adopted an amendment of the Environment, Housing and Infrastructure Scrutiny Panel (P.109/2018 Amd.) that, in the inserted Article 78A of the Road Traffic (Jersey) Law 1956 (scheme for periodic technical inspection of motor vehicles) –
- in paragraph (5)(e) for "the fees" there should be substituted "subject to any Regulations under paragraph (8), the fees";
- after paragraph (7) there should be inserted –
"(8) The States may by Regulations –
- make provision for the fees that are to be charged in relation to inspections; and
- amend a provision of an Order, being a provision made under paragraph (4) or (5)(e), to –
- remove an inconsistency with the provision made under sub-paragraph (a),
- insert a reference to the Regulations, and
- make consequential, transitional, transitory or saving provision in relation to the provision made under clause (i) or (ii).";
- in paragraph (5)(f) for "the designation" there should be substituted "subject to any Regulations under paragraph (9), the designation";
- after paragraph (8), as inserted by paragraph 1 of this amendment, there should be inserted – "(9) The States may by Regulations –
- make provision for the designation of persons as examiners for the purpose of carrying out inspections, including provision –
- as to the approval of premises and equipment to be used by examiners, and
- as to any fees to be charged in relation to that designation or approval; and
- amend a provision of an Order, being a provision made under paragraph (4) or (5)(f), to –
- remove an inconsistency with the provision made under sub-paragraph (a),
- insert a reference to the Regulations, and
- make consequential, transitional, transitory or saving provision in relation to the provision made under clause (i) or (ii).".

THE STATES, in pursuance of Articles 3(4) and 68 of the Education (Jersey) Law 1999, made Regulations entitled the Education (Provided Schools – Amendment of Law No. 2) (Jersey) Regulations 2018.

THE STATES, in accordance with Standing Order 87(2), adopted a proposition of Deputy Russell Labey of St. Helier that the proposition of Deputy Carina Soares Alves of St. Helier entitled Compensation for Mesothelioma sufferers' (P.124/2018) be considered as the next item of business at the present meeting.
Compensation for Mesothelioma sufferers P.124/2018
THE STATES, commencing consideration of a proposition of Deputy Carina Soares Alves of St. Helier entitled Compensation for Mesothelioma sufferers' (P.124/2018), adopted an amendment of the Minister for Social Security (P.124/2018 Amd.) that –
For paragraph (a) there should be substituted the following paragraph –
"(a) to establish a statutory compensation scheme for Islanders who have been diagnosed with diffuse
mesothelioma following exposure to asbestos in Jersey;".
For paragraph (b) there should be substituted the following paragraph –
"(b) to request the Minister for Social Security, subject to the provision of funding as set out in
paragraph (c), to bring forward proposals for an appropriate statutory compensation scheme as described in paragraph (a), to be implemented by 1st October 2019; and".
For paragraph (c) there should be substituted the following paragraph –
"(c) to request the Council of Ministers to make provision in the draft Government Plan 2020 for this
scheme to be funded from 1st January 2020, and to request the Minister for Treasury and Resources to identify the necessary additional funding to provide payments under the Scheme in 2019 from Contingency if costs are unable to be met from within existing approved departmental revenue heads of expenditure.".

THE STATES, adopting a proposition of the Minister for Treasury and Resources entitled Parish of St. Martin : provision of a loan for the former St. Martin 's Primary School redevelopment' (P.117/2018), authorised the grant of a loan to the Parish of St. Martin for the purpose of converting the former St. Martin 's Primary School for retail and commercial use; and agreed that the loan should not exceed £2.60 million, should bear interest at a fixed rate of 4.5% per annum, and should be repayable over a period not exceeding 20 years on terms to be agreed with the Treasurer of the States.
