On 7th January 2009, the Minister for Housing made a decision delegating certain of his functions under Article 28 of the States of Jersey Law 2005 in respect of the legislation as detailed below.
The terms of the delegation were recorded in a Ministerial Decision as follows – -----------------------------------------------------------------------------------------------------
The Minister, in pursuance of Article 28 of the States of Jersey Law 2005, is asked to agree to give authority to the Director – Population Office, and in his absence, the Housing Control Manager, the following delegated powers with immediate effect.
- Legislation – Housing (Jersey) Law 1949 as amended
F u n c tion delegated – The power to grant consent to applications made under Part 4 of the Law relating to
the control of sales and leases of land and property transactions, and to attach conditions to consents issued.
- Legislation – Building Loans (Jersey) Law 1950 as amended
F u n c tion delegated – The power to approve applications for building loans with the additional allowance
to attach conditions to any consent to the loans approved without limitation, and the power to refuse application of a building loan where an applicant clearly falls outside eligibility as contained in the legislation.
- Legislation – Lodging Houses Registration (Jersey) Law 1962 as amended
F u n c tion delegated – The power to approve the registration and the renewal of registration of Lodging
Houses. Officers are also empowered to impose conditions to registrations approved though not the power to refuse formal applications for registration.
