  4. 74 LA COLOMBERIE, ST. HELIER – LEASE.

REPORT

Decision(s): Under Standing Order 168(3) the Minister for Treasury and Resources hereby notifies the States that he has accepted the recommendation of the Property Holdings Department to agree to the following –

(a)  Land transaction –

  1. The Minister decided to accept the recommendation of the Minister for Economic Development to approve the following –
  1. John Le Fondré Hall , Jersey Airport – the termination of the 125 year lease which was deemed to have commenced on 1st June 1996 between the Public and the Bank (now HSBC); and
  2. the termination of the 25 year lease which was deemed to have commenced on 1st June 1996 between the Bank (now HSBC) and the Public.
  1. To confirm  the above  decision after  giving  the  States  15 working days' notice of the transaction, and to cause the transaction to be completed.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

  1. Land transaction –
  1. To transact with the present leaseholders of Apartment No. 172, Clos des Sables, to cancel their existing 99 year lease and to transfer to them  the  Public's flying  freehold  interest;  in accordance  with  the approved  policy  (under  MD-PH-2012-0124),  and  the  independent valuation  arranged  by  JPH,  for  an  agreed  consideration,  plus reasonable costs incurred.
  2. To confirm  the above  decision after  giving  the  States  15 working days' notice of the transaction, and to cause the transaction to be completed.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

  1. To grant a new lease to the First Tower Community Association (the sitting tenant and currently holding over under previous lease) for the areas within the OTC building as shown for identification purposes on the attached plan.
  2. To confirm  the above  decision after  giving  the  States  15 working days' notice of the transaction, and to cause the transaction to be completed.

After the expiry of 15 days following presentation to the States the transaction may be concluded.
