Summary

Under Article 3(3) of the Competition Regulatory Authority (Jersey) Law 2001, the Assistant Chief Minister is required to notify the States of appointments of members of the Jersey Competition Regulatory Authority ("J.C.R.A.").

After consultation with the Chairman of the J.C.R.A. (Mr. Michael O'Higgins), the Assistant Chief Minister has re-appointed Mr. Michael Byrne and Mrs. Louise Read to the Board of the J.C.R.A., with effect from 24th July 2017, for a period of 4 years, until 23rd July 2021. The appointments are subject to the continuance of the arrangement between  the  J.C.R.A.  and  the  Guernsey  Competition  and  Regulatory  Authority ("G.C.R.A.")  whereby  executive  members  are  shared  under  the  Channel  Islands Competition and Regulatory Authorities ("C.I.C.R.A.") framework. Mr. Byrne and Mrs. Read will therefore be executive members of the Board within this period subject to their ongoing tenure as Chief Executive and Director respectively of both the J.C.R.A. and G.C.R.A.

On 24th July 2017, the States of Guernsey's Committee for Economic Development unanimously approved the re-appointment of Mr. Byrne and Mrs. Read as members of the G.C.R.A. Their re-appointment to the Board of the J.C.R.A. ensures uniformity in the board structures of the J.C.R.A. and the G.C.R.A.

Re-appointment of Mr. Michael Byrne

Mr. Byrne has extensive experience applying regulation and competition law in the broadcasting, telecommunications, postal and energy sectors in the U.K. and Channel Islands.

His previous roles include: Chief Statistician at the S.D.O. (R.S.A.), Head of Macro- Economic Assessment at the Office for National Statistics (U.K.), Head of Strategy and Economic Assessment at the Independent Television Commission (U.K.) and Senior Manager in the Retail Competition Division, Office of Gas and Electricity Markets (U.K.). He joined the Guernsey regulator in May 2005 and was appointed to the position of Deputy Director-General in December 2007.

Mr. Byrne holds a diploma in Company Direction from the Institute of Directors and a Master's Degree in Business Administration from the University of Warwick. He has a post-graduate qualification from King's College, London, in European Competition Law. He holds a 1st Class post-graduate Bachelor of Science Degree in Mathematical Statistics from the University of Natal, South Africa, and a Bachelor of Science Degree studying Statistics, Economics and Mathematics from the same university.

Re-appointment of Mrs. Louise Read

Mrs. Read joined the J.C.R.A. in 2009 and was appointed a member of the J.C.R.A. and G.C.R.A. in August 2012.

Mrs. Read is a chartered accountant, with extensive experience of managing finance, personnel and operational aspects of business. She is secretary to the Board and the Audit and Risk Committee.

Mrs. Read was previously the Group Financial Accountant at Jersey Post, and worked with many of Jersey's businesses during her time at PwC.

Mrs. Read is a Chartered Director of the Institute of Directors, a fellow of the Institute of Chartered Accountants in England and Wales, and holds a BSc in Accounting and Management Sciences from the University of Southampton.

Resource implications

The Authority is funded via licence fees and a grant from the Department to administer the Competition Law. No additional funding or resources are required as a consequence of this decision.

There are no other financial or manpower implications for the States.
