Decision(s): Under Article 18(4) of the Public Finances (Jersey) Law 2019 (the Law), the Minister for Treasury and Resources hereby notifies the States, and having consulted with any relevant Minister under Article 18(5) of the Law; that she has agreed to the following –

After the expiry of 4 weeks following the presentation to the States of these transfers, the Minister hereby authorises the Treasurer of the States to action the transfers outlined in the table above.

Background

The Our Hospital (OH) scheme has an approved budget in the Government Plan (GP) 2021 – 2024 of £20m. A further £11.167m was allocated by MD-TR-2021-0020. This was designed to finance project expenditure necessary to take the project through to June 2021. The project does not have any other budget and cannot therefore incur any expenditure that exceeds this sum without further approvals.

The Government Plan 2021-2024 allocated sufficient funding to the project to July 2021. These entries in the Government Plan 2021-2024 were on the basis that the Outline Business Case (OBC) would be completed in Spring 2021 and would inform a financing Proposition for debate by the States Assembly to provide funds for the balance of the project from July 2021 thus providing the total estimated cost of £804.5m as identified in the Strategic Outline Case (SOC) (for information the actual drawdown of this sum would be staged as advised by the Treasurer at that time).

However, the Political Oversight Group and project Team advise that the unplanned States  Assembly  debate  on  preferred  access  route,  which  was  triggered  by  an Amendment to the site selection Proposition P.123/2020 Our Hospital Site Selection: Overdale has meant that the project has been delayed by approximately three months. The associated uncertainty in developing a master plan for the Overdale site has meant that design activity could not progress as quickly as anticipated and therefore could not inform the development of the OBC in line with the programme anticipated in the Government Plan 2021-2024.

This report has been drafted as requested and supported by the OH Political Oversight Group (POG) seeking a Ministerial Decision approval from the Treasury Minister for £17.796m to fund the early works. The funding is requested from existing 2021 Government Plan approved capital projects.

The impact of delays in completion of the OBC are that the budget required to fund the Government of Jersey team and Pre-Construction Services Agreement (PCSA) costs from July onwards would not be available.

The Conversion Courtroom and Dewberry House projects were identified as suitable to be funded from the COCF. The Attorney General has consented to the use of the COCF for both these projects, totalling £2,240,000, in an email to the Treasurer of the States dated  11th  September  2020.  These  projects  were  previously  funded  from  the consolidated fund so this decision will enable this budget to be transferred to the Our Hospital head of expenditure and a grant from the COCF will be made to these two projects to replace the budget.
