The Council of Ministers accepts all parts of this amendment. The current position in respect of those indicators proposed in part 2b matters deserves mention to demonstrate the base from which we will be working.

Effective channels of communication with the French authorities in respect of the nuclear activities being carried out on the Cotentin peninsular are established

Jersey is already initiating discussions with the Prefecture de la Manche on this subject.

Appropriate arrangements are put in place for compensation to be paid to the Island following any nuclear accident or incident which proves harmful to the health of Islanders or to the Island's economy or

environment

Jersey is included in the U.K. ratification of the Nuclear Energy Liability Convention (6th March 1981) and the Convention Supplementary to the Convention on Third Party Liability in the Field of Nuclear Energy of 29th July 1960 with Additional protocol (9th May 1983) – the "Paris/Brussels Convention".

The conventions replace the normal principles of tort law in the event of nuclear damage by placing a strict and exclusive liability on a nuclear operator. Currently the limit of liability is up to about £250 million, and there is a current proposal to increase this amount up to about £500 million. The Law Officers are presently considering the application of the Convention to Jersey.

Accurate, timely and independent information is provided to the public of Jersey about the French nuclear activities

Jersey is included in the U.K. ratification of the International Convention on Nuclear Safety. Article  16 of the Convention requires each party to take appropriate steps to ensure that its own population and the competent authorities  of States  in  the  vicinity  are  provided with  appropriate information  for  emergency  planning  and response.

"Independent" information – Jersey receives information from the Commission Locale d'information de Flamanville (CLIF) which is independent of the nuclear power operators, EDF. The composition of the CLIF includes representatives of local government, local organisations and scientific experts. The CLIF aims to answer any concerns and provide open and transparent information.
