COMMENTS

Further to the Comments of the Minister for Home Affairs (P.24/2019 Com.) on the proposition from the Deputy of St. John (P.24/2019), the Council of Ministers agrees that any necessary changes in legislation required as part of reorganising government departments should be presented to the Assembly for consideration before the relevant elements are implemented, where legislation is required.

Correctly, public services operate within the legislative framework decided by the Assembly.  This  is  an  essential  feature  of  our  democratic  system  of  government. Ministers and public servants are required to uphold the law at all times, including when implementing changes to departmental functions that are regulated in statute.

The Council is, therefore, fully supportive of the important role of the Assembly in continuing to decide upon changes to the legislative framework for public service functions. Much of the reorganisation of government has proceeded and can proceed without legislative change, and in such instances will proceed as planned.

The Council will, therefore, discuss and agree the policy as requested by part (b) of the Proposition as a matter of priority, and will present this policy, in line with part (b), to the Assembly at the earliest opportunity.
