The  following  enactments  were  laid  before  the  States, namely –

  1. Income  Tax (Small  Maintenance  Payments)  (Jersey) Order, 1981. R & O – 6995.
  2. Depositors and Investors (Prevention of Fraud) (List of Registered Persons) (Amendment No. 2) (Jersey) Order, 1981. R & O – 6997.

Jersey Council for Safety and Health at Work 1980-1981. Report and accounts. R.C.15.

The Social Security Committee by Act dated 12th November, 1981, presented to the States the Report and Accounts of the Jersey Council for Safety and Health at Work for the year 1980-1981.

THE STATES ordered that the said Report and Accounts be printed and distributed.

Matters noted – land transactions.

THE STATES noted an Act of the Finance and Economics Committee dated 18th November, 1981 showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

  1. as recommended by the Public Works Committee, the acquisition from Mr. John James Quigley and Mrs. Bridget Quigley, née Flynn, of 272 square feet of garden land forming part of No. 57, St. Saviour 's Road, St. Helier , required for road improvement purposes, for a consideration of £400 subject to the Committee –
  1. demolishing the existing wall and rebuilding with garage entrance;
  2. constructing a new pedestrian entrance and leaving an opening for garage entrance;
  3. paying the cost of the accommodation works;
  1. as recommended by the Public Works Committee, the purchase from Mrs. Sally Caroline Anne Le Brocq, née Harris on, of 350 square feet of land required for the widening of the road between Samares Lane and St. Clement 's Coast Road, for a consideration of £19 plus the cost of accommodation works and the payment of legal fees;
  2. as recommended by the Fort Regent Development Committee, the leasing to Mercantile Development Brokers (C.I.) Limited of an area in the East Bastion, together with three store rooms, for the purposes of glass blowing, for a period of nine years with effect from 1st January, 1982, at an annual rent of £4,000 with rent reviews based on the Jersey Cost of Living Index, at 1st January, 1985 and 1st January, 1988;
  3. as recommended by the Defence Committee, the leasing to Mr. Maurice John Ferey of Crabbé Farm, St. Mary including about 20 vergées of land, outbuildings and grazing on the Range, as shown coloured Red on

Drawing No. 7/D/3, dated November, 1981, for a period of nine years with effect from 25th December, 1981, at an annual rent of £1,000 with rent reviews every three years;

  1. as recommended by the Defence Committee, the leasing to Mr. Maurice Louis Kergozou de la Boisserie of approximately six vergées of arable land and some waste land at Crabbé, St. Mary , shown coloured Red on Drawing No. 7/D/3 dated November, 1981, for a period of nine years with effect from 25th December, 1981, at an annual rent of £180 with rent reviews every three years;
  2. as recommended by the Defence Committee, the leasing to the Jersey Outdoor Smallbore Rifle Club of the Smallbore Range at Crabbé, St. Mary , shown coloured Red on Drawing No. 7/D/3 dated November, 1981, for a period of nine years with effect from 25th December, 1981, at an annual rent of £50 with rent reviews every three years;
  3. as recommended by the Defence Committee, the granting of a licence to Mr. Maurice Francis Gotel and Mrs. Christine Susan Gotel, née Pattenden, respectively the Chairman and Secretary of the Jersey Skeet and Sporting Gun Club, for the right to undertake clay pigeon shooting on Fields 116, 117 and 118, Crabbé, St. Mary for a period of nine years with effect from 25th December, 1981, at an annual rent of £75, with reviews every three years.

Fort Regent Policy Report 1981. P.140/81.

The Fort Regent Development Committee by Act dated 16th November, 1981, presented to the States the Fort Regent Policy Report 1981.

THE STATES decided to discuss the Report in a Committee of the Whole House.

Island Development Committee Policy Report. P.107/81.

THE STATES acceded to the request of Senator Richard Joseph Shenton that consideration of the Island Development Committee Policy Report be deferred to the last item of Public Business at the present Sitting.

Gorey Village Development – exchange and transfer of administration of land. Statement.

The President of the Island Development Committee made a statement in the following terms –

"On the 17th February, 1981, the States, adopting a Proposition of the Island Development Committee relating to the Gorey Village Development, approved an exchange of land comprising the gift to the Gorey Village Development Company Limited of the site of No. 2, Prairie Bungalows, Gorey, of an approximate area of 400 square metres (4,306 square feet) in exchange for the gift by the said Gorey Village Development Company Limited of part of Field 110, Gorey, of an approximate area of 546 square metres (5,875 square feet).

The Proposition was erroneous in that the proposed gift to the Company was of part only of the site of No. 2, Prairie Bungalows, which measured approximately 634 square metres (6,824 square feet).

In preparing plans for the development of the site, plans which were approved by the Committee on the 17th September, 1981 the Company's architect found it necessary to locate foundations and certain drains under public land outside the boundary of the area of land (4,306 square feet) intended to be conveyed to the Company. Rather than create possible difficulties for the public at some future date arising from the ownership of private foundations and drains in public land, the Committee has agreed to increase the area of the part of the site of No. 2, Prairie Bungalows to be gifted to the Company to 465 square metres (4,997 square feet), with the effect that the public footway of 5 feet in width to be provided bordering the gifted site will be unencumbered. The area to be gifted in exchange by the Company to the Public will remain unaltered at 546 square metres (5,875 square feet).

The Act of the States of the 17th February, 1981, authorised the Attorney General and the Greffier of the States to pass the necessary contracts in the matter. It is proposed, unless any Member of the States signifies his or her objection, that the Attorney General and the Greffier of the States should pass the necessary contract(s) on Friday, 27th November, 1981, or as soon as possible thereafter, on the basis of the authority of the 17th February, 1981, and the revised area measurement referred to in this Statement.".

Crabbé, St. Mary – lease of land to Jersey Rifle Association.

THE STATES, adopting a Proposition of the Defence Committee –

  1. approved the leasing to the Jersey Rifle Association of land comprising the Full Bore Range together with shooting stands and butts at Crabbé, St. Mary , as shown coloured Red on Drawing No. 7/D/3 dated November, 1981, for a period of twenty-seven years, commencing 25th December, 1981, at an annual rent of £100, subject to rent reviews at the end of each third year;
  2. authorised the Attorney General and the Greffier of the States to pass the necessary contract with the Jersey Rifle Association.
  1. authorised the Treasurer of the States to receive the rent as it became due and to credit R.201.

24, Columbus Street, St. Helier .

THE STATES, adopting a Proposition of the Housing Committee –

  1. approved drawings Nos. 2715/4 and 2715/5 showing the rehabilitation and development at 24 Columbus Street, St. Helier , comprising the conversion of one three- bedroomed house and the construction of a block of six one-bedroomed flats;
  2. authorised the Greffier of the States to sign the said drawings on behalf of the States.

Maufant Village Development – Phases 2A and 2B.

THE STATES, adopting a Proposition of the Housing Committee –

  1. approved drawings Nos. 2714 – 36/39/41/43/45/46/47/49 and ES566 showing the development at Fields 231 and 234, St. Saviour , comprising 31 three-bedroomed houses, 21 two-bedroomed houses and four two- bedroomed bungalows;
  2. authorised the Greffier of the States to sign the said drawings on behalf of the States.

Maufant Village Development – gift of land.

THE STATES, adopting a Proposition of the Housing Committee –

  1. ceded by way of gift to the Parish of St. Saviour certain landscaped areas of land in the development at Maufant Village, Maufant, St. Saviour , as shown coloured brown on Drawing No. 2614/42B and the Estate at Jardin à Pommiers, St. Saviour , as shown coloured green on drawing No. 2616/3D;
  1. authorised the Attorney General and the Greffier of the States to pass the necessary contract in the matter.

Bashfords Nurseries, St. Saviour – sale of completed dwellings.

THE STATES, adopting a Proposition of the Housing Committee approved, in principle, the sale on completion of approximately 44 dwelling houses to be constructed at Bashfords Nurseries, St. Saviour , to applicants under the States Loan Scheme.

4, Verulam Villas, St. Helier .

THE STATES commenced consideration of a Proposition of the Fort Regent Development Committee regarding the sale of No. 4, Verulam Villas, Clairvale Road, St. Helier . After discussion, and on the proposition of Deputy Terence John Le Main of St. Helier , the Proposition was lodged "au Greffe".

THE STATES decided to take this subject into consideration on 8th December, 1981.

Midland Bank Trust Corporation (Jersey) Limited (Jersey) Law, 1981.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Midland Bank Trust Corporation (Jersey) Limited (Jersey) Law, 1981.

Appliances for stoma patients – supply.

THE STATES, having adopted an amendment of the Social Security Committee that for the words "under the Health Insurance Scheme" there should be substituted the words "from public funds"; having adopted an amendment of the Finance and Economics Committee that for the words "Social Security Committee" there should be substituted the words "Public Health Committee"; and having adopted an amendment of the Public Health Committee that the word "colostomy" be deleted and that after the word "supplied" there should be inserted the words "to stoma patients", adopted the Proposition of Senator Richard Joseph Shenton and charged the Public Health Committee to take the necessary action to enable appliances to be supplied to stoma patients from public funds.

Road Traffic (No. 21) (Jersey) Regulations, 1981.

THE STATES, in pursuance of the powers conferred on them by the Order in Council of the twenty-sixth day of December, 1851, and by Article 49 of the Road Traffic (Jersey) Law, 1956, as amended, made Regulations entitled the Road Traffic (No. 21) (Jersey) Regulations, 1981.

Loi (1981) (Amendement No. 4) réglant la Procédure Criminelle.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Loi (1981) (Amendement No. 4) réglant la Procédure Criminelle.

Primary Schools – improvements.

THE STATES, adopting a Proposition of the Education Committee, notwithstanding the terms of the Act of the States dated 8th February, 1972, regarding Capital Expenditure, approved in principle, the modernisation and improvement of St. Clement 's and St. Mark's Primary Schools.

Cremation (Amendment No. 12) (Jersey) Regulations, 1981.

THE STATES, in pursuance of Article 3 of the Cremation (Jersey) Law, 1953, as amended, made Regulations entitled the Cremation (Amendment No. 12) (Jersey) Regulations, 1981.

Petroleum (Jersey) Law, 1981.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Petroleum (Jersey) Law, 1981.

Island Development Committee Policy Report.

The Island Development Committee having accepted an amendment that in paragraph (1) for the words "to accept" there should be substituted the words "to note", the States adopting a Proposition of that Committee –

  1. noted the functions and policies described in the Report of the Island Development Committee, dated 5th August, 1981, as those to be followed by that Committee in the 1981-85 period under review;
  2. requested the Policy Advisory Committee to report to the States on the problems caused by the fragmentation of farm buildings.
