The   Bailiff  informed  the  Assembly  that  a  letter  had  been received expressing the thanks of The Prince and Princess of Wales for the Addresses which the States had sent to them on the occasion of their marriage and saying that they had been most touched by the kind messages.

Mr. George Le Feuvre – welcome.

The Bailiff welcomed Mr. George Le Feuvre, better known as George d'la Forge, who continued to write articles and letters in Norman French, who was present in the Gallery and congratulated him on celebrating his 90th birthday.

The Bailiff also welcomed Abbé Marcel Lelégard of the Abbaye de la Luce rne, Normandie and paid tribute to his work in maintaining the ties between Jersey and Normandy.

Senator R. Vibert – best wishes.

The Bailiff , on behalf of the States, sent best wishes for a speedy recovery to Senator Ralph Vibert , who had undergone an operation.

Contingencies vote of credit – Public Works Committee.

THE STATES noted an Act of the Finance and Economics Committee dated 4th August, 1981 informing the House that it had made available to the Public Works Committee out of its Contingencies vote of credit the sum of £34,200 to enable the purchase of No. 4 Patriotic Street, St. Helier , to proceed in connexion with an additional multi-storey car park.

THE STATES noted an Act of the Finance and Economics Committee dated 4th August, 1981 informing the House that it was making available the sum of £20,000 out of its contingencies vote of credit to enable the investigation by Merz and McLellan into future electricity sources to commence.

Matters noted – land transactions.

THE STATES noted Acts of the Finance and Economics Committee dated 4th, 12th and 26th August and 9th September, 1981 showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

  1. as recommended by the Education Committee, the renewal of the lease from the Estate of the late Glen Arthur Mathew of No. 4, Isipingo Villas, Beaumont, St. Peter for a period of one year with effect from 1st June, 1981, at an annual rent of £2,275, for use as teachers' accommodation;
  2. as recommended by the Education Committee, the renewal of the lease from Mrs. Eileen May Gaudin, née Le Sueur , of Nos. 1 and 2 Belle Rive Villas, Le Hocq Lane, St. Clement , for a period of three years, with effect from 1st August, 1981, at an annual rent of £2,125 for each property, for use as teachers' accommodation;
  3. as recommended by the Public Works Committee, the leasing to La Chasse Farm (St. John Limited) of approximately 20 vergées of grazing land at the old Mont Mado tip site, for a period of five years, with effect from 25th December, 1981, at an annual rent of £300;
  4. as recommended by the Public Works Committee and in pursuance of an Act of the States dated 25th March, 1980, the purchase from Mr. Philip Moran Benest of No. 4, Patriotic Street, St. Helier , required in connexion with the provision of an additional multi-storey car park, for the sum of £180,890 plus the cost of conveyancing fees, and vacant possession in twelve months' time;
  5. as recommended by the Harbours and Airport Committee, the assignment from Mr. P.J.M. Gosselin to Mr. Jeffrey Douglas Norman of the lease/licence agreement in respect of the premises on St. Catherine's Breakwater used as a fishing tackle shop, and for the deckchair concession, with effect from 1st August, 1981, on the same terms as notified to the States on 17th February, 1981;
  6. as recommended by the Public Works Committee, the leasing to Miss Carolyn Mary Tanner of approximately 9½ vergées of land situated to the south of Field 691, St. Brelade , for a period of three years, with effect from 24th June, 1981, at an annual rent of £100, in order to exercise and graze her horses;
  1. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Beren-Gaed Holdings Limited of the site forming the corner of St. Saviour 's Road and Woodville Road, St. Helier (formerly properties known as Beren- Gaed, St. Saviour 's Road) and South Lynne (otherwise known as Hillside) Woodville Road, required for the building of 12 one-bedroomed flats for use as States' rental accommodation and approximately 450 square feet of the land fronting onto St. Saviour 's Road which would be required by the Public Works Committee for road widening purposes, for a consideration of £72,000 on the basis of each party paying its own legal costs;
  2. as recommended by the Harbours and Airport Committee, the leasing to Sealink (U.K.) Limited of 516 square feet of storage accommodation on the Albert Pier, Port of St. Helier , for a further period of three years with effect from 1st July, 1981, at an annual rent of £877.02 representing a rate of £1.70 a square foot;
  3. as recommended by the Harbours and Airport Committee, the leasing to Emeraude Ferries Limited of 100 square feet of accommodation on the Albert Pier, Port of St. Helier , for a period of three years, with effect from 1st August, 1981, at an annual rent of £350, representing a rate of £3.50 a square foot;
  4. as recommended by the Island Development Committee, and in pursuance of an Act of the States dated 18th April, 1978, the purchase from Miss Nora Faro of an area of land known as Site 31, St. Ouen 's Bay, measuring one vergée, for a consideration of £700 plus legal fees;
  5. as recommended by the Tourism Committee, the leasing to Mrs. Kathleen Muriel Hart , née Glover, of First Tower Kiosk, St. Helier , for a period of three years with effect from 25th December, 1981, at an annual rent of £1,000;
  1. as recommended by the Tourism Committee, the leasing to Mr. Gerald Aubert and Mrs. Patricia Maria Aubert, née Cooke, of Old Station House Café, Millbrook, for a period of three years with effect from 25th December, 1981, at an annual rent of £1,400;
  2. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mr. Eric George Renouf of No. 26, Aquila Road, St. Helier , which property was suitable for use as States' rental accommodation, for a consideration of £7,500 for the realty, plus the payment of legal fees and the Committee accepting responsibility for re-housing the existing tenant;
  3. as recommended by the Harbours and Airport Committee, the leasing to Owner's Services Limited of 776.75 square feet of office accommodation in the airline administration building, comprising letting Nos. B157, B158, B159 and B165 for a term of three years commencing 1st September, 1981, at an annual rent of £3,107, representing a rate of £4 a square foot a year;
  4. as recommended by the Public Works Committee, the granting to Mr. Martyn John Le Breton of a right of way over land owned by the public for the purpose of making a vehicular access to the rear garden of his property, 2 Wellswood, Plat Douet Road, St. Clement , for the sum of £100 and the payment of legal expenses, and subject to a disclaimer being incorporated in the contract that the Committee accepted no responsibility, if at any time, because of the access being obstructed. Mr. Le Breton was not able to gain entry to his property.

THE STATES noted Acts of the Finance and Economics Committee dated 1st July and 4th August, 1981 showing that in pursuance of Rule 5 of the Public Finances (General) (Jersey) Rules, 1967, as amended, the Committee had noted that –

  1. the Resources Recovery Board had accepted the lowest of eight tenders, namely that submitted by Miller and Baird (C.I.) Limited in the sum of £147,015.80 for the construction of a pumping station on the north-west boundary of the F.B. Fields, St. Clement ;
  2. the Education Committee had accepted the lowest of four tenders, namely that submitted by A.C. Mauger and Son (Sunwin) Limited in the sum of £238,269.00 in a contract period of 50 weeks for the redevelopment of St. Saviour 's School.

Deputy Sir Robert Marett of St. Brelade asked Senator John Roland Christopher Riley, President of the Defence Committee, the following question –

"Can the President give an assurance that the draft work permit enabling legislation will be presented to the States for debate  during  this  session, bearing in mind that the States agreed on 23rd October, 1979, that such legislation should be prepared."

The President of the Defence Committee replied as follows –

"The drafting of the legislation was completed in 1980 and the Law Draftsman forwarded comments on the Bill to the Law Officers of the Crown early this year with a request that they be sent in reply to those comments received from the Home Office. Those comments have now been given to the Home Office and a reply awaited. Until that reply has been received, the Committee is unable to proceed."

Flooding in St. Helier and eastern part of the Island. Statement.

The President of the Resources Recovery Board made a Statement in the following terms –

"During the early hours of the morning of Saturday, 26th September, 1981, many properties in St. Helier and the eastern half of the Island were flooded as the consequence of exceptionally heavy rainfall.

In the period of twenty-four hours between 10.00 B.S.T. on 25th September, and 10.00 B.S.T. on 26th September, rainfall was recorded as follows –

St. Louis 64.2mm (2.53 inches) of which

50mm (approximately 2 inches) fell in one hour between 02.00 and 03.00 B.S.T. on 26th September.

Two and a half inches of rainfall produces 36.3 million gallons of water for each square mile of surface. Two inches of rainfall in a period of one hour grossly overtaxed sections of the Island's drainage system and it was this which caused flash flooding in many properties.

High tide on Saturday occurred at 06.13 B.S.T. and the early discharge of the storm was not affected by the tide.

Many of the Board's Engineers and workforce were called out between 01.00 and 03.30 and the Storm Water Pumping Stations which are normally under automatic operation and monitored remotely from Bellozanne were placed under hand control. Sandbags for flood protection and pumps for floodwater removal were despatched to the various trouble spots in conjunction with the States Fire Service. Tankers were used throughout Saturday to pump out flooded basements in St. Helier .

Rainfall in a period of 24 hours, exceeding that which was measured at the St. Louis Observatory and at Grands Vaux at the weekend, occurs only a few times in a century. Statistically, and based upon figures for the South of England, rainfall of 2 inches in one hour is likely to occur less frequently than once in 100 years.

From this it will be readily understood that the Board cannot provide surface water drainage which would give total protection against a storm of such severity. However, the Board is very conscious of the distress to property owners and occupiers which a disaster such as occurred on Saturday morning causes and I give an undertaking that we will seek to

continue to carry out works to extend and improve the Island's surface water drainage systems. Each incident reported to the Board  will  be  investigated  by  our  Engineers  and  where solutions to localised problems can be found, they will be implemented as quickly as possible.

Storm warning systems using Radar are now in use in the United Kingdom and the Board has already agreed that the application of such systems to Jersey should be investigated as a matter of urgency.

At this stage we can only ask the public to cooperate with us to warn us of any areas where the free flow of water might be  impeded  in  order  that  our  Engineers  may  have  an opportunity of rectifying the problems and if possible averting situations similar to those which occurred in St. Helier and St. Saviour last weekend."

THE STATES, adopting a Proposition of the Public Works Committee –

THE STATES commenced consideration of a Proposition of the Tourism Committee concerning the lease of West Park Café, St. Helier . After discussion, and on the proposition of Senator Mrs. Jane Patricia Sandeman, the Proposition was lodged "au Greffe".

Gorey Telephone Exchange.

THE STATES, adopting a Proposition of the Housing Committee, approved the transfer to the Education Committee from the Housing Committee of the administration of the Telephone House at the Old Gorey Telephone Exchange, Gorey, coloured green on Drawing No. APP 5/81.

Rue des Prés Trading Estate – exchange of land.

THE STATES, adopting a Proposition of the Island Development Committee, agreed that in order to amalgamate two sites at the Rue des Prés Trading Estate and to provide a new pedestrian access from Rue des Prés to the Trading Estate, the following transactions in land should be approved –

  1. the gift by the public of the Island to Commodore Shipping Services Limited of an area of public land measuring 391 square metres and shown on Drawing 7966/2B situated between Plots 8 and 26, Rue des Prés Trading Estate, subject to adequate safeguards in respect of access at all times to the mains services lying under the said area;
  2. the gift by Commodore Shipping Services Limited, to the public of the Island, of an area of land measuring 179.3 square metres and shown on Drawing 7966/2B situated to the south of Plot 26, Rue des Prés Trading Estate;
  3. the authorisation for the Attorney General and the Greffier of the States to pass the necessary contracts in the matter.

Field 869, Chemin de Landes, St. Ouen wet weather sludge disposal site.

THE STATES, adopting a Proposition of the Resources Recovery Board –

  1. approved the purchase from Miss Elizabeth France Montier of Field 869, Chemin de Landes, St. Ouen , measuring approximately 3 vergées, 13 perch and shown coloured green on Drawing No. A.P.P. 4/81 for a consideration of £2,000 plus all legal fees and Messrs. H.W. Maillard's own negotiating fee of £40;

West Telephone Exchange – sale of land.

THE STATES, adopting a Proposition of the Telecommunications Board –

  1. approved the sale to Mr. William McFarlane of approximately 438 square feet of public land, being a strip of land running parallel to part of the north boundary of the West Telephone Exchange for the sum of £219.00, each party to be responsible for their own legal fees;
  1. authorised the Attorney General and the Greffier of the States to pass the necessary contract in the matter; and
  2. authorised the Treasurer of the States to receive the said sum to be paid into vote of credit R.1001.

Public Lotteries Board – appointment of member.

THE STATES commenced consideration of the draft Policing of Parks (Amendment No. 3) (Jersey) Regulations, 198 (P.78/81 – lodged on 30th June, 1981) and adopted the Preamble and Regulation 1.

THE STATES, on the Proposition of Deputy Francis Hedley Morel of St. Saviour , referred back Regulations 2 and 3 to the Public Works Committee.

Attendance Allowances (Amendment No. 8) (Jersey) Regulations, 1981.

THE STATES, in pursuance of Articles 2 and 3 of the Attendance Allowances (Jersey) Law, 1973, as amended, made Regulations entitled the Attendance Allowances (Amendment No. 8) (Jersey) Regulations, 1981.

Advisory Training Council: Assisted Training Scheme.

THE STATES, adopting a Proposition of the Education Committee, approved the establishment of an Assisted Training Scheme to enable local employers to create up to an additional 15 apprenticeships or other traineeships leading to a recognised craft or trade qualification.

Juvenile Unemployment: Job Opportunity Scheme and Community Service Scheme.

THE STATES, adopting a Proposition of the Education Committee, approved the establishment of a Job Opportunity Scheme and a Community Service Scheme to alleviate Juvenile Unemployment, to run for a period of one year commencing 1st October, 1981.

Beau Port, St. Brelade – purchase of land.

THE STATES, adopting a Proposition of the Island Development Committee –

  1. approved the purchase by the Committee on behalf of the public of the Island from –
  1. the Honourable Barbara Jacqueline Norman, née Boot, former wife of Willoughby Rollo Norman;
  2. the Honourable Jocelyn Mary Gold, née Boot, wife of Michael Gold;
  3. the Honourable Margaret Ann Macdonald, née Boot, widow of Somerledd Macdonald; and

Overdale Hospital: transfer of funds.

THE STATES, adopting a Proposition of the Public Health Committee, approved the transfer of £20,000 from the Capital Vote of Credit granted to the Committee under the heading "Overdale Hospital – Passenger Lift" (C.0653) to a new Capital Vote of Credit under the heading "Overdale Hospital – Day-Room Extension" in order to provide funds for extending the existing ground floor day-room.

Health Insurance (Medical Benefit) (Amendment No. 19) (Jersey) Regulations, 1981.
