Jersey Flag.

The Bailiff informed the House that H.M. The Queen had now approved the new design of the Jersey Flag in accordance with the request of the House. The official description of the new flag was as follows –

"Argent  a  Saltire  Gules  in  the  honour  point  an Escutcheon  also  Gules  thereon  three  Lions  passant guardant Or (being the Royal Arms as used and borne by Our  Island  of  Jersey)  ensigned  by  an  Ancient  Crown (such as has been attributed unto Our Royal Predecessors being of the House of Plantagent) of Gold."

The new flag was operative from now but the Bailiff added that it was not an Ensign and should not therefore be worn on the ensign staff of Jersey yachts which would continue to use the Red Ensign, or Blue or White in the case of members of certain yacht clubs.

Harbours and Airport Committee – appointment.

THE STATES appointed Deputy Clarence George Farley of St. Helier as a member of the Harbours and Airport Committee in the place of the Connétable of St. Helier .

Social Security Report and Accounts 1980.

The Social Security Committee by Act dated 22nd January, 1981, presented to the States its Report and Statement of Accounts for the year ended 30th September, 1980.

THE STATES ordered that the said Report and Accounts be printed and distributed.

Matters noted – land transactions.

THE STATES noted an Act of the Finance and Economics Committee dated 25th March, 1981, showing that, in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

  1. as recommended by the Public Health Committee, the leasing from International Investment Trust Company of Jersey Limited of No. 16, Manor Court Flats, Undercliffe Road, St. Helier , from 1st March, 1981, to 30th April, 1982 at an annual rent of £805, for occupation by nursing staff from whom the full rent would be recoverable;
  2. as recommended by the Public Health Committee, the renewal of the lease from Weetwood Investments Limited of No. 5, Roseville Gardens, Roseville Street, St. Helier , for a further period of 3 years, with effect from 10th February, 1981, at an annual rent of £936 for the flat, plus £78 a year for the parking space, with a rent review after two years, for occupation by nursing staff from whom the full rent would be recoverable;
  3. as recommended by the Housing Committee, the leasing from Mrs. Nancy de Wolf Arthur, née Miller, of No. 40, Nomond Avenue, La Pouquelaye, St. Helier , required by the Establishment Committee for occupation by a Management Services Assistant, under the Temporary Housing Scheme for essential employees, for a period of 3 years with effect from 1st April, 1981, at a weekly rent of £55;
  4. as recommended by the Housing Committee, the leasing from Mr. Edward Malcolm Pearmain Machon of No. 2, Glendale Close, Samares Coast Road, St. Clement , required by the Establishment Committee for occupation by a newly appointed Air Traffic Control Officer and his family, under the Temporary Housing Scheme for essential employees, for a period of 3 years with effect from 1st June, 1981, at a weekly rent of £52.50;
  5. as recommended by the Public Works Committee, the leasing to the Royal Channel Islands Yacht Club, of 273 square yards of land used for car park and boat parking services at St. Aubin, for a further period of 5 years, with effect from 25th December, 1980, at an annual rent of £1,050;
  1. as recommended by the Public Works Committee, the leasing to Mr. Terence Robert Forsdike of the shop premises at 46/48, Kensington Place, St. Helier , at a weekly rent of £50 for the period 1st April to 25th December, 1981;
  2. as recommended by the Public Works Committee, and in pursuance of an Act of the States dated 25th March, 1980, the purchase from Mr. Thomas Charles Swanson of Nos. 6 and 8, Patriotic Street, St. Helier , required for the construction of a multi-storey car park, for the sum of £170,000 plus the payment of legal fees.

Matters noted – financial business.

THE STATES noted Acts of the Finance and Economics Committee dated 1st December, 1980 and 11th March, 1981, showing that, in pursuance of Rule 5 of the Public Finances (General) (Jersey) Rules, 1967, as amended, the Committee had noted that –

  1. the Housing Committee had accepted the lowest of six tenders, namely that submitted by C.A. Mauger Ltd. in the sum of £151,376 in a contract period of 41 weeks for the development of six one-bedroomed houses and two one-bedroomed flats at Normandy Cottages and Villas, Albert Street, St. Helier ;
  2. the Housing Committee had accepted the lowest of six tenders, namely that submitted by Peter Cameron Ltd. in the sum of £455,872.34 in a contract period of 55 weeks for the development of 8 one-bedroomed and 8 two- bedroomed flats at Rope Walk, St. Helier ;
  3. the Resources Recovery Board had accepted the lowest of eight tenders, namely that of Inter-Island Construction Company Ltd. in the sum of £108,746.93 for the extension of the sewers to serve Rue St. Thomas, Longueville, St. Saviour ;
  4. the Resources Recovery Board had accepted the lowest of seven tenders, namely that of Kenmac Construction Company Limited in the sum of £294,845.06 for the extension of main sewers from St. Martin to Rozel.

Matters lodged.

The following subjects were lodged "au Greffe" –

  1. Don Farm, Quennevais Road: rezoning of land. P.35/81. Presented by the Island Development Committee.
  2. Draft Milk Marketing Scheme (Amendment No. 6) (Jersey) Act, 198 . P.36/81.

Presented by the Agriculture and Fisheries Committee.

The States decided to take the abovementioned subjects into consideration on 28th April, 1981.

The following subjects were lodged "au Greffe" on 31st March, 1981 –

  1. Draft  Act  with  regard  to the provision of a minimum income for elected Members of the States. P.33/81. Presented by the Legislation Committee.
  2. Rue Fondon (formerly Fields 800/801), St. Peter : gift of land. P.34/81.

Presented by the Island Development Committee.

THE STATES decided to take the abovementioned subjects into consideration on 28th April, 1981.

Jersey Gas Co. Ltd. – purchase of land. Statement.

The President of the Island Development Committee made a statement in the following terms –

"In June, 1980, the States adopted a Proposition of the Island Development Committee and approved the purchase by that Committee on behalf of the Public of the Island from the Jersey Gas Company Limited of three areas of land –

Area C. An area of land of approximately 50,000 square feet at a rate of £10.00 per square foot.

Area D. An area of land of approximately 34,000 square feet at a rate of £10.00 per square foot.

Area E.  An  area  of land of approximately 20,000 square feet at a rate of £8.00 per square foot.

The States also agreed to pay the sum of £200,000 to the Jersey Gas Company Limited as a contribution towards the cost of removing gas mains, technical equipment and buildings from the land.

After States' approval, it became apparent that the Company had not intended to remove the redundant subterranean pipework from sites C and D, not to remove the gas holder from site E, nor to be responsible for the removal of various small buildings and equipment from the land to be acquired.

As a result of further negotiations, the Company has agreed to remove the gas holder (but not the foundations and apparatus established beneath normal ground level), at its expense, being an estimated cost of £45,000 while the following items are regarded by the Committee as reasonable variations on the part of the Public from the Report and Proposition approved by the States –

  1. Underground gas mains on sites C and D will not be removed following their replacement elsewhere or their redundancy, but will be purged and made safe by the Company. No material detriment to future development will arise from these pipes being left in the ground.
  2. The boundary of site D and that of the land to be retained by the Company has been subject to minor realignment, to leave the Company in possession of the westernmost of its two existing accesses to Tunell Street.
  3. The Public will be responsible for work to make safe a former tar well on site D and for the demolition of certain buildings to be left by the Company on sites C and D. The cost of this work is estimated at £15,000.
  4. A blockwork or brickwork wall, 8 feet in height, will be built by the Public to divide site D from the land to be retained by the Company within 3 months of the Public taking possession of that site. The cost of this work is estimated at £17,200.
  1. The Public will have immediate vacant possession of that part of site C now leased as a public car park on passing contract. £500,000 for site C and £100,000 (one half of the contribution of £200,000) will be paid on passing contract. Within two years of passing contract, the Company will divert all live gas mains from beneath sites C and D, will remove all equipments, steel works and redundant gas pipes from above ground and will purge and make safe the redundant gas pipes below ground, whereupon the Public will have vacant possession of the remainder of site C and of site D and will pay the consideration for the purchase of site D in the sum of £329,180 (the area of site D having been reduced to 32,918 square feet) and £100,000 (the balance of the contribution of £200,000).
  2. Within three years of passing contract, the Company will demolish and remove the gas holder from site E and will purge and make safe any redundant pipes and equipment below ground, whereupon the States will receive vacant possession of site E and will pay £172,536 to the Company. (Site E has been measured and has an area of 21,567 square feet, at £8 per square foot).
  3. Until vacant possession is given and received there will be reciprocal indemnities against injury to persons or damage to property.

This additional information having been presented to the States, the Committee is satisfied that there is now no reason why the Attorney General and the Greffier of the States should not proceed with the passing of the necessary contract in the very near future."

General Hospital Redevelopment Scheme Phase 1B.

THE STATES, adopting a Proposition of the Public Health Committee –

  1. approved  Drawings  Nos.  2683-01;  2699/5/10  and  11 showing  Phase 1B  of  the  General  Hospital Redevelopment Scheme;
  1. authorised  the  Greffier  of  the  State  to  sign  the  said Drawings on behalf of the States.

Education Committee – amalgamation of votes for purchase of sites and allocation of funds for clearance of Oakfields site.

  1. approved the amalgamation of four capital votes of credit, namely –

Parade Offices sale of land to Jersey Electricity Company Limited.

THE STATES, adopting a Proposition of the Public Works Committee –

  1. approved the sale to the Jersey Electricity Company Limited of a small parcel of land measuring 148 square feet at the Parade offices development scheme, as shown red on Drawing No. 2581/A111/01B for the sum of £1 plus the payment of all legal expenses, for the siting of an electricity sub-station;
  2. authorised the Attorney General and the Greffier of the States to pass the necessary contract in the matter;
  3. authorised the Treasurer of the States to receive the said sum of £1 and to credit it to Vote No. 2082 Public Buildings'.

St. Saviour 's Road/Pleasant Street, St. Helier Nos. 61 and 61a.

THE STATES, adopting a Proposition of the Public Works Committee –

  1. approved the following transactions in land with Mr. Charles Francis Journeaux –
  1. the sale to Mr. Journeaux of an area of land measuring 152 square feet at the corner of St. Saviour 's Road/Pleasant Street shown coloured red on Drawing No. 306 at the rate of £1.50 a square foot for a total consideration of £228;
  2. the purchase from Mr. Journeaux of an area of land measuring 530 square feet at the corner of St. Saviour 's Road/Pleasant Street shown coloured green on Drawing No. 306 at the rate of £1.50 a square foot for a total consideration of £795;
  1. in  addition  to  pay  the  costs  of  the  following accommodation  works  and  legal  fees  connected therewith –
  1. the wall bordering the road to be constructed to a  height  of  6'6"  above  the  back  of  footpath level;
  2. the wall to have a granite face on the roadside and Ronez type split block on the inside;
  3. all the granite in the old wall to be retained by Mr. Journeaux;
  4. a  door  opening  to be  made  to replace  the existing one;
  5. the existing wooden shed to be replaced with a new one of the same dimensions;
  1. authorised the Attorney General and the Greffier of the States to pass the necessary contracts in the matter;
  2. authorised the Treasurer of the States to receive and pay the  said  sums  from  and  to Mr. Journeaux  out  of  the Capital Vote of Credit granted to the Committee under the  heading  Roads –  Property  Acquisition  and Investigation' – Vote No. 0303.

Public Works Committee – amalgamation of votes to provide and improve public lavatories.

THE STATES, adopting a Proposition of the Public Works Committee, authorised that Committee to amalgamate the balance remaining in the undermentioned votes of credit –

  1. public lavatories at La Pulente and Les Laveurs – C.0337  £83,500
  2. public  lavatories  at  St. Catherine's –

C.0340  £9,600 and   Carried forward  £93,100

Fields 231 and 234, Maufant, St. Saviour .

THE  STATES,  adopting  a  Proposition  of  the  Housing Committee,  approved  in  principle,  the  sale  of  the  completed dwellings  to  be  constructed  on  Fields  231  and  234,  Maufant, St. Saviour , to applicants under the States Loan Scheme.

Rent Control Tribunal – appointment.

THE  STATES,  adopting  a  Proposition  of  the  Housing Committee,  appointed  the  following  persons,  in  pursuance  of paragraph (1) of Article 2 of the Dwelling Houses (Rent Control) (Jersey) Law, 1946, as amended, to act for one year with effect from  12th  April, 1981, as Chairman and Members of the Rent Control Tribunal, namely –

Sir Robert Hugh Le Masurier, Chairman Mrs. Margaret Le Quesne, née Lee Oscar Le Quesne Mourant, Esq.

and appointed the following persons in pursuance of paragraph (2) of the said Article 3 to act for the same period in place of members of the Tribunal unable to act by reasons of absence or incapacity, namely –

St. Brelade 's Hospital – development

THE STATES, adopting a Proposition of the Housing Committee –

  1. approved Drawings Nos. 2722/5-8 inclusive, showing the development at St. Brelade 's Hospital, St. Aubin, comprising 10 one-bedroomed flats and 6 bedsitters;
  2. authorised the Greffier of the States to sign the said Drawings on behalf of the States.

Aid to Glasshouse Industry.

THE STATES, having accepted an amendment that the words "maintained and" be deleted from paragraph (a), adopted paragraph (a) of a Proposition of Senator Richard Joseph Shenton regarding Aid to the glasshouse industry and agreed that the glasshouse industry in Jersey should be supported.

Paragraphs (b) to (e) inclusive were withdrawn.

Senator Mrs. Jane Patricia Sandeman, having declared an interest in the matter, withdrew from the Chamber.

Draft Administrative Decisions (Review) (Jersey) Law, 198 .

THE STATES acceded to the request of the President of the Special Committee to consider the relationship between Committees and the States that consideration of the draft Administrative Decisions (Review) (Jersey) Law, 198 (lodged on 24th February, 1981 – P.28/81) be deferred from the present Sitting to a later date.

Family Allowances (Jersey) Regulations, 1981.

THE STATES, in pursuance of Articles 7 and 21 of the Family Allowances (Jersey) Law, 1972, as amended, made Regulations entitled the Family Allowances (Jersey) Regulations, 1981.

Balmain Nurseries, St. Helier – rezoning of land.

THE STATES, adopting a Proposition of the Island Development Committee, agreed to rezone approximately 4.5 vergées of land, being the site of the former Balmain Gardens and Nurseries, Undercliffe Road, St. Helier , as shown on Map No. 01.105.01, from educational to residential use.

Public Holidays and Bank Holidays (Jersey) Act, 1981.

THE STATES, in pursuance of Article 2 of the Public Holidays and Bank Holidays (Jersey) Law, 1951, as amended, made an Act entitled the Public Holidays and Bank Holidays (Jersey) Act, 1981.

Channel Islands Lottery – Association of Jersey Charities.

THE STATES, adopting a Proposition of the Gambling Control Committee, referred to their Act, dated 8th June, 1976, agreeing that future profits accruing to Jersey from the Channel Islands Lottery, until such time as the States otherwise direct, should be set aside for the repayment of the capital expenses of the Sports Hall at Fort Regent, and agreed that the profits accruing to Jersey from one draw each year of the Channel Islands Lottery shall be allocated to the Association of Jersey Charities.
