Statistical Digest.
The Finance and Economics Committee by Act dated 23rd November, 1981, presented to the States a Statistical Digest.
THE STATES ordered that the said Digest be printed and distributed.
Contingency vote of credit – Defence Committee.
THE STATES noted an Act of the Finance and Economics Committee dated 2nd December, 1981 informing the House that it was making available the sum of £60,000 out of its contingencies vote of credit to enable that Committee to appoint six additional Officers to the Police Force.
Matters noted – land transactions.
THE STATES noted an Act of the Finance and Economics Committee dated 2nd December, 1981 showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

- as recommended by the Education Committee, the renewal of the lease from the Trustees of Aquila Road Methodist Church Trust of No. 28, Ralegh Avenue, St. Helier , for a further period of one year, commencing 1st August, 1981, at an annual rent of £2,500, for use as teachers' accommodation;
- as recommended by the Harbours and Airport Committee, the leasing to the Air Training Corps No. 2498 (Island of Jersey) Squadron of Garrison House and the associated land at Mont à la Brune, St. Peter , for a term of nine years commencing 1st January, 1982, at an annual rent of £800, subject to the Committee's right to give nine months' notice at any time during the nine year term;
- as recommended by the Public Health Committee, the granting to Incline Limited and to Mr. Derek Michael Harley and Mrs. Margery Louise Harley, née Hutchinson, of the following rights in respect of properties erected on part of the property Sandown', St. Aubin's Road, St. Helier , for a consideration of £1,000 plus legal fees and on the condition that the portion of the road alongside the properties was surfaced with suitable tarmac, namely –
- a vehicular right of way at all times and for all purposes to go to and from St. Aubin's Road over part of the road leading to the rear entrance of Overdale Hospital, on condition that a proportionate contribution towards the maintenance and upkeep of the road was made; it being understood that the right of way would not include any right to park on any part of the road; (as shown on Drawing No. 1023/10);
- the right to connect to drains, sewer and services in the said private road, on condition that it was reinstated as and when connexions took place and the payment of a just proportion towards the maintenance of the said drains, sewer, etc.

Finance Centre Activities.
THE STATES acceded to the request of Senator Richard Joseph Shenton that consideration of the Proposition regarding Finance Centre Activities (P.126/81 – lodged on 3rd November, 1981) be deferred from the present Sitting.
Queen's Valley. Compensation – Madame Travert. Question and Answer.
Deputy Arthur Bertram Carter of Grouville asked Deputy Donald George Filleul of St. Helier , President of the Public Works Committee, the following questions –
"1. What compensation is likely to be offered to Madame
Travert, the present occupier of the farm in Queen's Valley, in the event of the valley ever being flooded?
2. What alternative site has the Waterworks Company been able to offer her?"
The President of the Public Works Committee replied as follows –
"1. As it is only three weeks since the States confirmed their
decision to allow the Jersey New Waterworks Company Limited to build a reservoir in Queen's Valley it is surely premature to enquire what arrangements are to be made to alleviate the distress caused thereby to Mrs. Travert who must now have been gravely unsettled about her future domicile ever since 1975.
The question of compensation has not yet been discussed either with Mrs. Travert or her legal adviser and the basis on which this should be considered is not yet clear. It will surely depend to some extent on the eventual outcome of the accommodation problem posed in question 2.
2. The House will be aware that Mrs. Travert occupies Crown property in respect of which she holds no lease, but from which no-one particularly the Company, would wish to see her expelled without the offer of suitable alternative accommodation, preferably equally income- productive.
The Company has assured the President of the Public Works Committee of its desire to find a sympathetic and acceptable solution to this very deeply-felt problem and has also noted the fact that in the early planning stages a suitable property had been found and earmarked for Mrs. Travert; the ensuing delays have robbed the Company of this opportunity and it is actively seeking a solution compatible with the precise requirements made know to them by Mrs. Travert's solicitor.
The House is reminded that the Public Works Committee has limited powers in this matter and whilst it is as concerned as the Members that justice should be done for the claims of all those involved it cannot be a party to the financial aspects of the land purchases, its authority is limited to assuring itself that proper negotiations have taken place in the event of Compulsory Purchase powers being requested by the Company."
Jersey New Waterworks Company Limited – financing of new resource. Question and answer.
Senator Jane Patricia Sandeman asked Senator Ralph Vibert , President of the Finance and Economics Committee, the following question –
"The final paragraph of the Jersey new Waterworks Company report dated June, 1981 reads as follows –
It must be grasped by all interested parties that the decision to develop any new water resource cannot be divorced from the problems of financing the development and the consequences of higher water charges. The acceptance of increased charges, environmental change and the control of demand (whether by limiting the number of consumers or by discouraging consumption) is a political issue – The Company needs to be informed that the consequences in the terms of higher water charges and a higher level of financing are accepted by and are acceptable to the States for it to act with confidence in developing a new resource and incurring fresh financial burdens.'
Will the President say what information and assurances have been given by the Finance and Economics Committee to the Jersey New Waterworks Company concerning "higher water charges and a higher level of financing' to enable the Company to develop a new resource with confidence."
The President of the Finance and Economics Committee replied as follows –
"I have not regarded the point raised in the paragraph quoted from the Report of the Jersey New Waterworks Company as being addressed to the Finance and Economics Committee but to the States as a whole. The question was not referred to my Committee by the States, nor was its views requested before or during the debate by any individual member, including Senator Sandeman.
The fact that the development would ultimately be financed by higher water charges was one of the factors considered and argued at length during the debate and in my view the Assembly has given the Company the information sought by its decision that the development should proceed."
J Category housing permits. Questions and answers.
Senator Richard Joseph Shenton asked Senator John Le Marquand, President of the Housing Committee, the following questions –
"1. Would the President inform the House as to the number
of J Category housing permits issued in the last twelve months.
- Would the President inform the House as to the occupations for which J Category permits were issued.
- Is the President aware that bank employees are still being brought into the Island for positions which could well be filled by locally qualified staff?
- Would the President inform the House of the number of properties at present owned by the major clearing banks in the Island."
The President of the Housing Committee replied as follows –
"1. Housing Law statistics are compiled on a calendar year
basis. The following figures cover the period from 1st January, 1981 to 27th November, 1981. During that period the Committee issued 63 consents to lease and 5 consents to purchase in respect of first-time applicants on grounds of essential employment.
- The 63 leasehold consents can be analysed as follows –

The 5 consents to purchase can be analysed as follows –

- Before granting essential employment status to any expatriate bank employee, the Committee satisfies itself that there is not a local person available with the qualifications and experience to do the jobin question. The Committee at present has no knowledge of expatriate employees in respect of whom a housing consent is not required. However, the Committee has received complaints that some banks are employing expatriate staff injobs which could be done by local residents. The Committee has, therefore, in conjunction with the Policy Advisory Committee, asked the Economic Adviser to investigate the allegations and to report back with his findings.

Franchise Law – right to vote. Question and answer.
Deputy Hendricus Adolphus Vandervliet of St. Lawrence asked Senator Ralph Vibert , President of the Legislation Committee, the following question –
"There are amongst the population of the Island residents who were brought here by their parents as minors from foreign lands and who have been resident here since then and have married local electors. Is it possible that legislation might be enacted which would give these residents of long standing a right to be enfranchised?"
The President of the Legislation Committee replied as follows –
"The right to vote in elections has always been restricted to British Subjects and I would be surprised if a similar position did not apply to most countries as it certainly does in all EEC countries, or at least it did until 1979 when the matter was last considered by the Legislation Committee.
The ground for exclusion presumably is that one should not be involved in the political affairs of one country if one's allegiance is to another. There is a similar bar in respect of membership of this House.
In answer, however, to the specific question it would be possible to change this position by legislation, as it would be possible to do almost anything else. The legislation would require both the approval of the States and Royal Sanction. It could perhaps be thought that the status of aliens should be the same throughout the British Isles. It could be, on the other hand, that if and as the Common Market moves into a closer community, the whole question of nationality within Europe could be affected.
Insofar as the particular persons mentioned are concerned, that is men and women who have been here from infancy and some of whom are married to British subjects, there should be no difficulty whatsoever in their becoming full British subjects by naturalization. Those to whom the Deputy refers, have presumably decided for one reason or another that they prefer to remain citizens of their native country.
It is usual after triennial elections for the Legislation Committee to reconsider electoral procedure generally and I would expect the new Committee to bear this point in mind."
Defence expenditure. Statement.
The President of the Finance and Economics Committee made a statement in the following terms –
"During the budget debate I obtained information on U.K. Defence expenditure which suggested that the cost per head of population was around £100. I now find that this figure related only to the cost of maintaining the active forces and was for 1980/81.
The total expenditure for which the Ministry of Defence is responsible, which includes research and development costs, the cost of civilian staff, the cost of building work, production, repairs and associated facilities in the U.K., and the cost of war and contingency stocks etc., now totals £12,270 million for 1981-82 or about £220 per head of population. Pro-rata this would represent a cost of nearly £17 million for Jersey."

THE STATES, adopting a Proposition of the Finance and Economics Committee, accepted the bequest of the late Mrs. Nina Madeleine Brockhurst, née Pirouet, of the residuary funds of her personal Estate to be held by the Treasurer of the States on behalf of the States and to be used either for bungalow or cottage home dwellings (not high rise) for aged married couples, preference being given to those of Jersey birth or origin, or for the treatment of the sick and suffering at the General Hospital, or at Overdale Hospital, or generally in any other way in providing homes for the aged.

THE STATES rejected a Proposition of Deputy Alfred Durell Le Brocq of St. John that the prayer of a Petition of Mr. Wace Frederick Philo and others be granted, that because of the need for a retaining wall beneath the Cheval Roc Hotel, Bonne Nuit, St. John , due to the collapse of the cliff face, the States should either –

Lease of Airport Freight Bays to Air Jersey International Limited.
THE STATES, adopting a Proposition of the Harbours and Airport Committees –
- approved the renewal of the lease to Air Jersey International Limited of Freight Bays Nos. 7 and 8 in the Freight Terminal Building, Jersey Airport, comprising 2,880 sq.ft. for a term of 3 years, commencing 1st January, 1982, at a rent of £6,048 a year representing a rate of £2.10 a square foot a year;
- authorised the Greffier of the States to sign the necessary agreement with Air Jersey International Limited;
- authorised the Treasurer of the States to receive the payments as they became due.
Exchange of letters regarding Trilateral Agreement on Social Security between the United Kingdom, Guernsey and Jersey.

- approved the draft exchange of letters amending the Trilateral Agreement on Social Security between the United Kingdom, Guernsey and Jersey; and

THE STATES, in pursuance of Article 15 of the Building Loans (Jersey) Law, 1950, as amended, made Regulations entitled Building Loans (Miscellaneous Provisions) (Amendment No. 16) (Jersey) Regulations, 1981.
Subsidised Interest Rate on monies borrowed by Growers: Revised Scheme.
THE STATES, adopting a Proposition of the Agriculture and Fisheries Committee approved a Scheme to provide growers with an interest subsidy on monies borrowed from the Clearing Banks for the purchase of items used directly in the production and packaging of produce in accordance with a list approved by the Agriculture and Fisheries Committee, the level of subsidy to be the difference between 6.5 per cent and the individual base lending rate of the Clearing Bank, and the subsidy to apply in respect of interest on borrowings accrued during the period 1st December 1981 to 31st October 1982.
Sale of 4, Verulam Villas, St. Helier .
THE STATES, adopting a Proposition of the Fort Regent Development Committee –
- approved the sale by the Public of the Island to Terrion Investments Limited of No. 4 Verulam Villas, Clairvale Road, St. Helier , for a consideration of £45,000;
- authorised the Attorney General and the Greffier of the States to pass the necessary contract in the matter;
- authorised the Treasurer of the States to receive the said sum of £45,000 for the credit of the Capital Vote D1205.

Student Grants. Statement.
The President of the Education Committee made a statement in the following terms –
"As the House knows discussions have continued with Her Majesty's Government during the past year over the cost of providing higher education in the United Kingdom for Jersey students.
At the last meeting held in the Home Office on Monday, 24th November I met together with representatives of the Isle of Man and Guernsey officials of the Department of Education and Science, the Treasury and the Home Office. Agreement was reached among those present at the meeting to recommend the following proposals to their respective governments. I have been awaiting a formal statement of the proposals from the Home Office through the Bailiff before bringing them to the House for consideration. However, I understand that the President of the Guernsey Education Council is making the details of the proposal known to the Guernsey States tomorrow in advance of their confirmation and I feel bound therefore to inform the members of this House.
The proposals are that in respect of each recognised Jersey student in Higher or Advanced Further Education (that is attending a University, Polytechnic or College of Higher Education) the States of Jersey will pay to Her Majesty's Government a sum equivalent to 2½ times the home tuition fee. This payment which will replace the annual payment in respect of Teacher Training will be payable in March of each year and will be phased in' with effect from March, 1982. The precise details of the payment requested have yet to be confirmed but I can say that the phasing in' will begin with a payment in respect of those students who began the University and other courses in September, 1981.
The amount to be paid to Her Majesty's Government will be reduced by the expenditure incurred locally on in-service and induction training of teachers. Jersey students will be treated in every respect as "home students" and given full parity with United Kingdom and European Community students. Until the proposals have been more precisely framed it is impossible to provide members with other than a broad estimate of the costs involved. It is possible that the payment required by Her Majesty's Government in March, 1982 will be in the order of £400,000. This amount will increase annually and by 1985/86 could amount to £900,000 or £1 million at current rates.
I repeat that these proposals have not yet been put formally by Her Majesty's Government to the Island and I have as yet received no indication of Her Majesty's Government's reaction. We were advised that the final ratification on behalf of Her Majesty's Government would have to be at Ministerial level and for that reason I must emphasise the preliminary nature of this statement. However, in the circumstances I have already referred to I felt that I owed it to members to provide them with as much information as I have at this stage. I shall bring the matter forward again when the positive proposals have been put forward on behalf of Her Majesty's Government."
