The following enactment was laid before the States, namely –

Health  Insurance  (Pharmaceutical  Benefit)  (Prescribed List)  (Amendment  No. 11)  (Jersey)  Order,  1981. R & O. 7011.

Minimum  Annual  Increase  on  Old  Age  Pensions:  Report. P.1/82.

The Social Security Committee by Act dated 10th December, 1981,  presented  to  the  States  the  Report  on  Minimum  Annual Increase on Old Age Pensions.

THE STATES ordered that the said Report be printed and distributed.

Matters noted – land transactions.

THE STATES noted Acts of the Finance and Economics Committee dated 16th December, 1981 and 13th January, 1982, showing that, in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –

  1. as recommended by the Public Works Committee, to the Public being party to a Deed of Sale by Mrs. Christina Clyde, née Chapman, and others to Mr. John Dixon Habin and Mrs. Peggy Joyce Habin, née Smith, his wife, of the property Beauvoir, Mont Arthur, St. Brelade , to confirm the position of the boundary stones between that property and land forming part of the Old Railway Track;
  2. as recommended by the Harbours and Airport Committee, the leasing to Miss Lilian Jemima Le Couteur of Archirondel Cottage, St. Martin , for a further period of three years, with effect from 25th December, 1981, at an annual rent of £340;
  3. as recommended by the Harbours and Airport Committee, the renewal of the lease to the Royal National Lifeboat Institution of the store on the Albert Pier, Port of St. Helier , for a further term of three years, with effect from 25th December, 1981, at a nominal annual rent of 5p;
  4. as recommended by the Harbours and Airport Committee, to the transfer of the lease of the Café known as the Sailor's Rest, New North Quay, Port of St. Helier , from Mr. Andrew Hamilton Dinnen, to Mr. Charles Jones and Mrs. Marion Hazel Jones, née Matson, with effect from 18th December, 1981, for the remaining term of the lease which would expire on 31st March, 1982, at the existing annual rent of £1,500, and to the renewal of the said lease to Mr. and Mrs. Charles Jones for a term of three years commencing 1st April, 1982, at an annual rent of £1,500, on the understanding that it would not be renewed after that term and subject to the Committee's right to terminate the lease by giving six months' notice at any time during the three year term;
  1. as recommended by the Harbours and Airport Committee, the leasing to St. Catherine's Angling Association of accommodation in one of the archways at St. Catherine's Breakwater, for a further term of three years with effect from 1st November, 1981, at an annual rent of £115;
  2. as recommended by the Harbours and Airport Committee, the renewal of the lease to St. Catherine's Sailing Club of the Club House and adjoining land at St. Catherine's, for a further term of nine years with effect from 25th December, 1981, subject to rent review clauses at the third and sixth years of the lease, at an annual rent of £1,700;
  3. as recommended by the Public Works Committee, the cession free of charge by Mr. Norman Philip Pallot of 1,120 square feet of land required for the proposed road- widening at Field 957, La Grande Rue, St. Mary , as shown on Drawing No. 330, subject to the Committee paying for the laying of kerbstones and the construction of a 3 foot earthbank (the bank being on land owned by Mr. Pallot which would not be ceded) and paying the legal fees (together estimated at approximately £5,000);
  4. as recommended by the Housing Committee, the sale to Mr. Giacinto Notarianni and Mrs. Heather Venement Notarianni, née Baker, of a small strip of land adjoining their property 41, Le Clos Orange, St. Brelade , measuring approximately 150 square feet, as shown on Drawing No. 2640/20A, for a consideration of £100 inclusive of legal expenses, and on condition that they erected a matching wall from the existing wall up to the wooden fence at the rear of their property;
  1. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mrs. Jennifer McMullon, née Gaudin, of 4/5 Clare Street, St. Helier , required for use as States' rental accommodation, for a consideration of £58,000 for the realty, plus the payment of legal fees;
  2. as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mrs. Joyce Leslie Greening, née Picot, of No. 8, Parade Road, St. Helier , together with the ground opposite on the south side of the road, required for the development of the two sites with 14 units of accommodation, for a consideration of £65,000, on the basis of each party paying its own legal fees;
  3. as recommended by the Housing Committee, the leasing from Mrs. Nancy de Wolfe Arthur, née Miller, of Flat 2, Sydney Court, Beaumont, St. Peter , for a period of two years and one month, with effect from 2nd November, 1981, at an initial rent of £140.83 a calendar month plus a service charge of £43.75 a month, the rent to be increased to £260 a calendar month and the service charge to be increased to a figure related to the proportion of the service charges for the whole block, with effect from 21st February, 1983, together with the payment of the lessor's legal expenses of £45, the property being required by the Establishment Committee for occupation by a Traffic Engineer to be seconded from the United Kingdom Department of Transport under the temporary housing scheme for essential employees.

Matter noted – financial transactions.

THE STATES noted Acts of the Finance and Economics Committee dated 13th January, 1982, showing that, in pursuance of Rule 5 of the Public Finances (General) (Jersey) Rules, 1967, as amended, the Committee had noted that –

  1. the Housing Committee had accepted the lowest of eight tenders, namely that submitted by Mark Amy Limited in the sum of £139,463 with a contract period of 32 weeks for the redevelopment of 24, Columbus Street, St. Helier ;
  2. the Housing Committee had accepted the lowest of five tenders, namely that submitted by Charles Le Quesne (1956) Limited in the sum of £1,034,318 with a contract period of 39 weeks for the development of Maufant Village Scheme, Phase 2B.

Land for Industrial Development. Questions & Answers.

Deputy Terence John Le Main of St. Helier asked Deputy Norman Stuart Le Brocq of St. Helier , President of the Island Development Committee, the following questions –

"(1) Can the President tell the House if his Committee has any

plans either to zone or re-zone land for industrial development?

(2)  Is the President able to assure the House that, in view of the concern which is currently being expressed about the lack of accommodation which is available for light industry, particularly the smaller enterprises, the charges levied by the Committee in relation to such land as may be made available will not be prohibitive?"

The President of the Island Development Committee replied as follows –

"(1) I refer the Deputy to the Policy Report and Proposition of

the previous Committee debated in the States on November 24th, 1981. On page 11 of that Report will be found the policy of the previous Committee in relation to industrial sites. It is not the intention of the present Committee to vary that policy. The Rue des Prés land mentioned in the Report does not require zoning, and it is the intention of the Committee to bring a zoning proposal for the La Collette land during this Session.

(2)  I am able to assure the House. Discussion has taken place with the Finance and Economics Committee on rents for industrial sites owned by the States, and it is envisaged that rents charged will be no higher than called for by normal market forces. However, it must be said that there is no intention to subsidise these rents in order to provide hidden benefit to particular businesses."

Transport Advisory Council – Appointment of Members.

13, Royal Square – Renewal of Lease.

THE STATES, adopting a Proposition of the Public Works Committee –

  1. approved the leasing from G.R.E.A. Real Property Investments Limited of office accommodation at 13, Royal Square, St. Helier , occupied by sections of the Viscount's Department and the Judicial Greffe, for a further period of five years with effect from 29th November, 1981, at an annual rent of £6,000, with an option for the States to break the lease in November, 1984, and, in the event of that option not being exercised, with a rent review at that date;
  2. authorised the Greffier of the States to pass the necessary contract;
  3. authorised the Treasurer of the States to pay the rent as it became due.

Reconstruction of Le Dicq Pumping Station (Stage II).

THE STATES, adopting a Proposition of the Resources Recovery Board –

  1. approved Drawing No. P.284 showing the work to be carried out in connexion with the reconstruction of Le Dicq Pumping Station (Stage II);
  2. authorised the Greffier of the States to sign the said Drawing on behalf of the States.

THE STATES, subject to the sanction of Her Most Excellent Majesty in Council, adopted a Law entitled the Finance (Jersey) Law, 1982.

Milk (Sale to Special Classes) (Amendment) (Jersey) Regulations, 1982.

THE STATES, in pursuance of the powers conferred on them by the Order in Council of the fourteenth day of April, 1884, made Regulations entitled the Milk (Sale to Special Classes) (Amendment) (Jersey) Regulations, 1982.
