THE STATES noted an Act of the Finance and Economics Committee dated 23rd March, 1983, informing the House that it had made available to the Resources Recovery Board the sum of £50,000 from the Contingencies vote of credit to enable that Committee to provide a subsidy for the processing and export of "fragmentised light metal" from the Island by Picot and Rouillé Limited.

THE STATES noted an Act of the Finance and Economics Committee dated 23rd March, 1983, informing the House that it had made available to the Public Works Committee the sum of £16,000 from the Contingencies vote of credit to enable that Committee to carry out remedial works on the rock face above Snow Hill car park.
Matters noted – land transactions.
THE STATES noted Acts of the Finance and Economics Committee dated 23rd March and 6th April, 1983, showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved –
- as recommended by the Housing Committee, the cession, free of charge, to the Parish of St. Helier , of an area of land measuring approximately 218 square feet on part of the western boundary of La Collette Flats, St. Helier , as shown coloured Red on Drawing No. 1/H/16 (the Parish being owners of the adjacent Green Street Day Nursery) subject to the Parish paying the legal costs involved;
- as recommended by the Public Works Committee, the leasing to Mr. Denis James Gilpin of Rozel Mill for a period of 21 years on a full repairing basis, with an option to renew for a further 21 years, at an annual rent of £100, subject to the right of review of the nominal rent every 7 years and with the right to assign the unexpired portion of the lease should the main property (Rozel Mill House) ever be sold;
- as recommended by the Public Works Committee, the cession, free of charge, by Mr. Thomas William Darnell and Mrs. Daisy Louise Evelyn Darnell, née Townsend, of 630 square feet of land required for the provision of a footpath at Rue de la Cote, Grouville , subject to the Committee meeting the expense of reconstructing the roadside wall in double-faced granite and being responsible for the legal costs involved in the preparation of the contract;

- as recommended by the Harbours and Airport Committee, the assignment by Mr. and Mrs. Charles Jones to Mr. James Wilfred Kent and Mrs. Ann Kent, née Le Bleaus, of the remaining period of the lease of the Café known as the Sailor's Rest, New North Quay, Port of St. Helier , with effect from 1st April, 1983, and which would expire on 31st March, 1985, at the existing annual rent of £1,500 subject to the Committee's right to terminate the lease by giving six months' notice at any time during the term;
- as recommended by the Harbours and Airport Committee, the leasing from Mr. John Le Sueur Gallichan of approximately 900 square feet of land at La Croiserie, Trinity , on which the instrument landing system marker beacon was situated, for a further period of nine years with effect from 25th March, 1983, at an annual rent of £150 for the entire period of the lease;
- as recommended by the Public Works Committee the assignment from R. & V. Furnishing House Limited to McAra Limited of the unexpired portion of the twenty-one year lease of 24, Esplanade, St. Helier which was due to expire on 23rd June, 1994 subject to Messrs. Jose Antonio Ara and Philip McDermott personally guaranteeing the rent.

The Jersey Mutual Insurance Society, Incorporated – amendment of the Fundamental Rules – Petition.
The Connétable of Trinity presented to the States a Petition of The Jersey Mutual Insurance Society, Incorporated regarding the amendment of the Fundamental Rules.
THE STATES referred the said Petition to the Legislation Committee and lodged the relevant Proposition "au Greffe".
Milk Yields. Answer.
The Vice-President of the Agriculture and Fisheries Committee replied to questions regarding milk yields (asked in the House on 15th March, 1983) in the following terms –
"The following information is based on financial results for the year ending 31st December, 1981. The results for 1982 are now being prepared but will not be ready until early April, 1983.
- The average gross margin for cows and heifers-in- milk as available from the Farm Costings Service was £426 per head in 1981.
This gross margin is derived from costing 28 dairy herds involving 1,056 cows of the 4,202 milking animals declared at the October 1981 Census, representing 25% of the population.
The Gross Margin of an Enterprise is its OUTPUT less its VARIABLE COSTS.
FARM PROFIT is the Total Gross Margins of all the Enterprises on the Farm less the sum of the FIXED COSTS incurred. It represents the surplus before imputing any NOTIONAL CHARGES such as Unpaid Family Labour Costs and Notional Rent.
Fixed Costs are available from nine farms which are specialist dairy farms.
The average fixed costs on these nine farms were £193 per cow with an additional £59 per cow paid labour.
The PROFIT would therefore be £174 per cow.
- The range of gross margins was from £177 per cow at the lowest to £550 per cow at the highest.
- The herd with the highest gross margin is a specialised dairy herd comprising, in 1981, a total of 76 cows and heifers-in-milk. It is based on a self- feed silage and loose housing system with the milking carried out through a herringbone milking
parlour. The adjusted forage area is 181 vergées and the stocking rate is 1.82 vergées per cow. The herd with the lowest gross margin is also a specialised dairy farm with 65 cows on a cubicle house and hay feeding system milked through a milking parlour. The adjusted forage area is 1.93 vergées per cow.

Farms are costed under a seal of Confidentiality and to proceed with this analysis any further would break this confidence and betray the mutual trust in the Farm Costings Service painstakingly built up over the past ten years."
La Route des Quennevais – work being carried out. Questions and Answers.
Deputy Margaret Sylvia Rose Beadle of St. Brelade asked Deputy David John de la Haye of St. Ouen , Vice-President of the Resources Recovery Board, the following questions –
"1. Could the President inform the House if the works
being undertaken by the Board on the western side of La Route des Quennevais in the Parish of St. Brelade involve the relaying of piping originally laid some years ago?
- If the answer to question 1 is in the affirmative, could the President tell the House the reason for these works?
- Who was responsible for laying the drains two years ago?
- What is the cost of the present undertaking?
- Will there be any financial redress if the necessity for the present works is due to incompetence or lack of supervision by the organisation responsible for the original works?"
The Vice-President of the Resources Recovery Board replied as follows –
"1. The answer to this question is Yes'. The original
sewer along La Route des Quennevais consisted of concrete pipes, which over a period of some twenty years, were heavily attacked by hydrogen sulphide. In 1980, these pipes were replaced by extra strength vitrified clay pipes and it is these which are currently being replaced.
- Following the occurrence of several blockages in the length of sewer between Mont à la Brune and the Belle Vue Pleasure Park, the pipeline has been surveyed using the Board's closed circuit television system.
A large number of pipe fractures have been located over the length of some 330 metres and this length is being relaid in its entirety. This section was laid between June and October 1980.
Careful excavation and examination of the damaged pipeline has revealed evidence of sub-standard workmanship, but the damage extends beyond the point where such evidence had been found and the Board is, therefore, seeking to ascertain whether the pipes themselves were defective in any way.
At an early stage a representative of the pipe manufacturer visited the site, but he observed only the sub-standard workmanship in laying the sewer and found no inherent fault with the pipes. The Board has, therefore, sent samples of the pipes used in 1980 to specialist testing engineers in the United Kingdom for detailed examination.
- The defective sewer was laid by a team from the Board's Direct Labour Force supervised by members of the Board's staff.
- The work of relaying and investigation is not yet complete, but up to 30th March, 1983, £33,581 has been spent or committed on remedial works.
- There will be no financial redress unless the independent examination of the pipes used in 1980 reveals material or manufacturing faults, in which case the matter will be taken up strongly with the pipe manufacturer.
The Board can only regret what has happened but until it is satisfied that the problem is entirely due to sub-standard workmanship and is not in any way due to material or manufacturing fault, a decision on any disciplinary action which may be necessary will be deferred."
New North Quay – lease of accommodation to Brit-European Transport (C.I.) Ltd.
THE STATES, adopting a Proposition of the Harbours and Airport Committee –
- approved the lease to Brit-European Transport (C.I.) Limited of 4,760 square feet of warehouse accommodation on the New North Quay, St. Helier , for a further period of 3 years, with effect from 1st February, 1983, at an annual rent of £9,520, representing a rate of £2 a square foot;
- authorised the Greffier of the States to sign the necessary agreement;
- authorised the Treasurer of the States to receive the rent as it became due.
New North Quay – lease of accommodation to Sealink U.K. Ltd.
THE STATES, adopting a Proposition of the Harbours and Airport Committee –
- approved the lease to Sealink U.K. Limited of accommodation on the New North Quay, St. Helier , for a further period of 3 years, with effect from 1st January, 1983, subject to either party having the right to terminate the lease on the basis of six months' written notice, at a total rent of £32,689.50 a year, made up as follows –
- 13,475 square feet of storage accommodation at a rate of £2.10 a square foot, yielding an annual rent of £28,297.50;
- 526 square feet of office accommodation at a rate of £5 a square foot, yielding an annual rent of £2,630;
- 374 square feet of amenity areas at a rate of £2.50 a square foot, yielding an annual rent of £935;
- 827 square feet of loading-bay accommodation at a rate of £1 a square foot, yielding an annual rent of £827;
- authorised the Greffier of the States to sign the necessary agreement;
- authorised the Treasurer of the States to receive the rent as it became due.
Archirondel – transfer of land.
THE STATES, adopting a Proposition of the Harbours and Airport Committee, approved the transfer of administration from that Committee to the Public Works Committee of land at Archirondel, shown coloured red on Drawing No. 219/12.
Housing Assistance for States Employees: amendment.
THE STATES, adopting a Proposition of the Establishment Committee, agreed to substitute for sub-paragraph (a) of their Act dated 30th November, 1977, the following sub-paragraph –
"(a) to authorise the Establishment Committee to assist a
number of States' employees with the purchase of suitable residential property in the Island and with the purchase of any land required as additions to any such property;".
Maincrop Potato Marketing Scheme (Amendment No. 3) (Jersey) Act, 1983.
THE STATES, in pursuance of paragraph (6) of Article 2 of the Agricultural Marketing (Jersey) Law, 1953, as amended, made an Act entitled the Maincrop Potato Marketing Scheme (Amendment No. 3) (Jersey) Act, 1983.

THE STATES, in pursuance of Articles 10 and 15 of the Housing (Jersey) Law, 1949, as amended, made Regulations entitled the Housing (General Provisions) (Amendment No. 7) (Jersey) Regulations, 1983.
Currency Notes (Variation of Maximum Amount of Issue) (Jersey) Regulations, 1983.
THE STATES, in exercise of the powers conferred on them by paragraph (2) of Article 1 of the Currency Notes (Jersey) Law, 1959, as amended, made Regulations entitled the Currency Notes (Variation of Maximum Amount of Issue) (Jersey) Regulations, 1983.
Disposal of Agricultural Waste.
THE STATES, adopting a Proposition of the Agriculture and Fisheries Committee –
- agreed that agricultural and horticultural waste be composted on the two sites presently used by the Public Works Committee, for the composting of bannelais and vraic, the former process being integrated with the latter, at a capital cost of £7,000 and an estimated revenue cost of £14,000;
- agreed that a sum of £8,750 be paid to the University of Cardiff in order to enable that establishment to undertake further research into the capacity of the anaerobic digester to destroy plant pests and diseases.
Purchase of Field 107, Maufant, St. Saviour .
THE STATES, adopting a Proposition of the Housing Committee –
- approved the purchase from Hirondelle Investments Limited of Field 107, Maufant, St. Saviour , measuring about 18.4 vergées, and as shown on Drawing No. 02.134.1 at a rate of £1,200 a vergée (about £22,080) subject to a condition that, in the event of the land being used for non-agricultural purposes within 25 years of passing the deed of sale, the States shall make a further payment to the aforesaid Company which shall be the difference at that time between the rate of agricultural land and the rate of land used for the purpose in question;
- authorised the Island Development Committee to restore the field to an agricultural condition suitable for letting by the clearance of the remains of former glasshouses and re-seeding of the land at an estimated cost of £16,000;
- authorised the Greffier of the States to sign the said Drawing No. 02.134.1;
- authorised the Attorney General and the Greffier of the States to pass the necessary contracts in the matter;
- authorised the Treasurer of the States to debit the cost of acquisition, including legal fees, and of restoration, to the Capital Vote of Credit granted to the Committee under the heading "Acquisition and Servicing of Land" (Vote C.0903).

THE STATES commenced consideration of the draft Protection of Employment Opportunities (Jersey) Law, 198 and adopted the Preamble. The States deferred consideration of the Articles until the next Sitting.

THE STATES, by virtue and in exercise of the powers conferred on them by the Order in Council of the fourteenth day of April, 1884, made Regulations entitled the Petroleum-Spirit (Control) (Jersey) Regulations, 1983.

Rent Tribunal: Appointment.
THE STATES, adopting a Proposition of the Housing Committee appointed, in pursuance of paragraph (1) of Article 3 of the Dwelling Houses (Rent Control) (Jersey) Law, 1946, as amended, the following persons to act as Chairman and Members of the Rent Control Tribunal, for one year with effect from 12th April, 1983, namely –
